Purpose of Item:
AUTHORIZING THE ACCEPTANCE OF A GRANT ALLOCATION FROM UNITED
STATES CONGRESS AND ADMINISTERED BY UNITED STATES DEPARTMENT OF
HOUSING AND URBAN DEVELOPMENT ("HUD"), "), ECONOMIC DEVELOPMENT
INITIATIVE COMMUNITY PROJECT FUNDING ("EDI-CPF") FOR THE 2023 FISCAL
YEAR ("FY2023 ACT"), IN THE AMOUNT OF FOUR MILLION DOLLARS
($4,000,000.00), AND ALLOCATING THE FUNDS AS MORE PARTICULARLY
SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED, TO ASSIST WITH 8
STREET NEIGHBORHOOD FLOOD MITIGATION PROJECT, MANAGED BY THE
CITY OF MIAMI DEPARTMENT OF RESILIENCE AND PUBLIC WORKS; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
DOCUMENTS INCLUDING AMENDMENTS, RENEWALS, EXTENSIONS, AND
MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS
MAY BE NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE,
AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS.
Background of Item:
On December 29, 2022, President Joe Biden signed the Consolidation Appropriation
Act, 2023, (H.R.2617) into law, which included $2,982,285,641 for 1,616
congressionally directed Economic Development Initiative Community Project Funding
("EDI CPF") FY 2023 Act.
On March 2, 2023, the City of Miami ("City") received a letter from U.S. Department of
Housing and Urban Development ("HUD") announcing a grant allocation to the City of
Miami ("City"), in the total amount of Four Million Dollars ($4,000,000.00).
These allocations were authorized by the Fiscal Year 2023 Consolidated Appropriations
Act (P.L. 117-328) FY2023 Act.
The allocated funds will be used in project B-233606 managed by the City of Miami
Department of Resilience and Public Works, to assist with the flooding mitigation and
right-of-way improvements.
The program allows for the reimbursement of all soft cost meeting the allowability
criteria in 2 CFR 200.403 incurred after December 29th, 2022.
Any balance remaining after all allowable soft & administrative costs have been
reimbursed shall be added to flood mitigation and right-of-way improvements costs of
project B-233606.
The City's Administration recommends the acceptance of the Funds and the allocation
of the Funds as specified in Exhibit "A" attached and incorporated, to assist with the 8th
Street neighborhood flood mitigation project, managed by Department of Resilience and
Public Works.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE ACCEPTANCE OF A GRANT ALLOCATION FROM THE UNITED

WHEREAS, the funding guidelines allows for the reimbursement of all soft costs incurred
after December 29, 2022, that meet the eligibility criteria in 2 CFR 200.403; and
WHEREAS, any balance remaining after all allowable soft and administrative costs have
been reimbursed shall be added to flood mitigation and right-of-way improvements costs for
RPW Project No. 40-13233606; and
WHEREAS, the City's Administration recommends the acceptance of the Funds and the
allocation of the Funds as specified in Exhibit "A," attached and incorporated, for the 8th Street
Neighborhood Flood Mitigation Project, Project No. 40-13233606, managed by RPW;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The acceptance, allocation, and appropriation of the Funds from the FY2023
Act in the amount of Four Million Dollars and 00/100 ($4,000,000.00), as specified in Exhibit "A,"
attached and incorporated, for the 8th Street Neighborhood Flood Mitigation Project, Project No.
40-B233606, is authorized.'
Section 3. The City Manager is authorized' to negotiate and execute any and all
documents, all in a form acceptable to the City Attorney, as may be necessary for said purpose,
subject to all federal, state, and local laws that regulate the use of such funds.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
Z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
