HomeMy WebLinkAboutR-23-0191City of Miami Resolution R-23-0191 alldl 11 li.Rl I + Legislation File Number: 13744 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 4/27/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE ACCEPTANCE OF A GRANT ALLOCATION FROM THE UNITED STATES CONGRESS AND ADMINISTERED BY THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("HUD"), ECONOMIC DEVELOPMENT INITIATIVE COMMUNITY PROJECT FUNDING ("EDI-CPF") FOR THE 2023 FISCAL YEAR ("FY2023 ACT"), IN THE AMOUNT OF FOUR MILLION DOLLARS ($4,000,000.00), AS MORE PARTICULARLY SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED, TO ASSIST WITH FLOOD MITIGATION AND RIGHT-OF-WAY IMPROVEMENTS IN MIAMI JOSE MARTI PARK AND ITS NEIGHBORHOOD, MANAGED BY THE CITY OF MIAMI OFFICE OF CAPITAL IMPROVEMENTS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS INCLUDING AMENDMENTS, RENEWALS, EXTENSIONS, AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS. WHEREAS, on December 29, 2022, President Joe Biden signed the Consolidation Appropriation Act, 2023, (H.R.2617) into law, which included $2,982,285,641 for 1,616 congressionally directed Economic Development Initiative Community Project Funding ("EDI- CPF") Grants; and WHEREAS, on March 2, 2023, the City of Miami ("City") received a letter from U.S. Department of Housing and Urban Development ("HUD") announcing a grant allocation to the City of Miami ("City"), in the total amount of Four Million Dollars and 00/100 ($4,000,000.00) ("Funds"); and WHEREAS, these allocations were authorized by the Fiscal Year 2023 Consolidated Appropriations Act (P.L. 117-328) (TY2023 Act"); and WHEREAS, the allocated Funds will be used to fund Office of Capital Improvements ("OCI") Jose Marti Park and Neighborhood Flood Mitigation, Project No. 40-13193500, to assist with flood mitigation and right-of-way improvements, including a hybrid of seawall and living shoreline, rain garden, blue street and bioswales, in Jose Marti Park and its neighborhood ("OCI Project No. 40-13193500"); and WHEREAS, the funding guidelines allows for the reimbursement of all soft costs incurred after December 29, 2022, meeting the eligibility criteria in 2 CFR 200.403; and City of Miami Page 1 of 2 File ID: 13744 (Revision: A) Printed On: 5/8/2023 File ID: 13744 Enactment Number: R-23-0191 WHEREAS, any balance remaining after all allowable soft and administrative costs have been reimbursed shall be added to flood mitigation and right-of-way improvements costs of OCI Project No. 40-13193500; and WHEREAS, the City's Administration recommends the acceptance of the Funds and the allocation of the Funds as specified in Exhibit "A" attached and incorporated, to assist with flood mitigation and right -of way improvements in Office of Capital Improvements Jose Marti Park and Neighborhood Flood Mitigation, Project No. 40-13193500; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The acceptance, allocation, and appropriation of EDI-CPF funds from the FY2023 Act in the amount of Four Million Dollars and 00/100 ($4,000,000.00), as specified in Exhibit "A," attached and incorporated, to assist with the flooding and right -of way improvements in Office of Capital Improvements Jose Marti Park and Neighborhood Flood Mitigation, Project No. 40-Bl93500, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, in a form acceptable to the City Attorney, for said purpose, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: la J ria i "ndez, Cify Kttor iey 4/17/2023 ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
