DAY'S SUB (3-16) FROM RG-2/5 GENERAL RESIDENTIAL AND SPI-3 COCONUT GROVE MAJOR STREETS OVERLAY DISTRICT TO RO-2.1/6 RESIDENTIAL -OFFICE ELIMINATING THE SPI-3 AND BY CHANGING THE ZONING CLASSIFICATION OF THE SOUTH 1/2 OF LOT 12, LOT 13 AND LOT 14 COR4. UAY' S ST33 ( 3-16 ) FROM RG-1/3 GENERAL RESIDENTIAL (ONE AND TWO-FAMILY) TO RO-2.1/6 RESIDENTIAL -OFFICE ALL OF SAID LOTS BEING GENERALLY DESCRIBED AS 2701-03 DAY AVENUE AND APPROXIMATELY 3191 CENTER STREET, MIAMI, FLORIDA; MAKING FINDINGS AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 46 OF SAID ZONING ATLAS MADE A FART OF ORDINANCE NO. 9500 BY REFERENCE AND DESCRIPTION IN ARTICLE 3, SECTION 300, THEREOF; CONTAINING A REPEALER PROVISION AND A SEVERARILITY CLAUSE. WHEREAS, the Miami Zoning Board, at its meeting of May 20, 1985, Item. No. 2, following an advertised hearing, made a motion to recommend approval of a change of zoning classification as hereinafter set forth, which failed by 4 3 vote, thus constituting a RECOMMENDATION OF D IAL. DAY's SUB (3-16) of the Public Records of Dade County, Florida, from RG-2/5 General Residential and SPI-3 f Coconut Grove Major Streets Overlay District to RO-2.1/6 Resi- M- YZ -!p /% 5. W. 2 7 t h Ave-65=673 --t I M June 15, 1985 The Miami City Commission The Residents of Apogee, located on the 3100 block of Center Street, do hereby Petition the Miami City Commission and the Planning and Zoning Board to DENY the request to rezone property located at 2701-03 Day Avenue and approximately 3191 Center Street from residential zoning to commercial zoning. We request Denial of Zoning change for the following reasons: Introduction of commercial zoning could and would encourage other property owners on 27th Avenue to request rezoning to commercial. There is no justification for this site to be commercial. A majority of the sites are in a duplex area and only a small strip extend to 27th Avenue. r The lots requesting rezoning constitute spot zoning. ° Commercial structure would be an intrusion into a strong and quiet residential neighborhood. The proposed rezoning would create considerable additional traffic on Day Avenue since entrance and egress may not be permitted at the narrow intersection of 27th and Day, The overflow parking from this Use would line the residential street with street parking. The token five feet residential strip would only encourage other sites on 27th Avenue to be rezoned to within five feet of Center Street, thus creating a commercial wall on one side of Center Street rather than a quiet residential street. ° The proposed rezoning will enable one individual not part of the neighborhood the opportunity to create a tax shelter at the cost of all the adjacent property owners who have invested their life savings in the neighborhood in which they live. ° We would welcome the development of residential uses for the property. DAY SUBDIVISION PLAN a/k/a 2701-03 Day Avenue and 3191 Center Street. The Petitioner represents that the pending changes on 27th Avenue constitute justification for rezoning of this currently residential. property to office use. We the undersigned would like to point out that only a sliver of the Petitioner's property in bound on 27th Avenue and that the majority of the property extends along Day Avenue and Center Street which is a clearly residential district.
