RESOLUTION NO.
A RESOLUTION ACCEPTING THE PLAT ENTITLED
"H.U.D. BON AIRE", A SUBDIVISION IN THE CITY OF
MIAMI; AND ACCEPTING THE DEDICATIONS SHOWN ON
SAID PLAT; AND AUTHORIZING AND DIRECTING THE
CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT
AND PROVIDING FOR THE RECORDATION OF SAID PLAT
IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the Department of Public Works recommends the
acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The plat entitled "H.U.D. BON AIRE", is a replat
of Lot 14 and the south 10 feet of Lot 99 Block 6, of "BON AIRE",
(7-12), all lying in Section 26, Township 53 South, Range 41
East, City of Miami, Dade County, Florida, which subject plat by
reference is made a part hereof as if fully incorporated herein
and which plat, together with the dedications shown thereon, and
the dedications to the perpetual use of the public of all
existing and future planting, trees and shrubbery on said
property, is hereby accepted and confirmed by the City of Miami,
Florida.
Section 2. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same

to be recorded in the Public Records of Dade County, Florida.

REPORT OF PROPOSED RECORD PLAT OF
H.U.D. BON AIRE
LOCATED AT N. W. 25 STREET BETWEEN N.W. 10 & 11 AVENUES
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying plat entitled "H. U. D. BON AIRE" was prepared by
Crowder, Mahoney, Makowski, Rice, Inc. It is in correct form for
submission to the City Commission and is forwarded with a
recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
1. The property platted is a replat of Lot 14 and the
south 10 feet of Lot 9, Block 6, of "BON AIRE", (7-
12). The plat consists of one lot and is zoned RG
1/3.
2. The location of the streets and the widths conform
with the standards of the Department of Public
Works of the City of Miami, Florida.
3. As certified to by Frank Makowski, Registered Land
Surveyor, this plat complies with the plat filing
laws of the State of Florida.
4. The attached Certificate of Title Examination
dated February 20, 1985, signed by Murray A.
Greenberg, Attorney, indicates that the fee simple
title to the property platted is correctly vested
in Dade County, and the Plat has been correctly
executed.
5. The area plat is not encumbered by mortgages.
6. Since all the required subdivision improvements on
this property have been previously placed and
accepted, this plat will be forwarded to the City
Commission of Miami, Florida, without the usual
formality of providing Bond and Contract.
7. The location of the property is shown colored in
red on the accompanying copy of a portion of. City
of Miami, Florida Zoning Sheet No. 20.
8. The attached Resolution has been prepared for the
acceptance of the Plat by the City Commission of
Miami, Florida.

Opinion of Title
Fla. 5-100, Allapattah
You have requested an Opinion of Title concerning real
property located in Fla. 5-100, Allapattah.
An application 'for final approval of the plat, in accordance
with Chapter 28 of the Metropolitan Code, is being prepared.
Section 28-8(d)(3) of the Code provides that the application for
final approval must be accompanied by a "current opinion.of title
from an attorney authorized to practice law in this state." In
compliance with this provision of the Code, I certify that I am
an attorney authorized to practice law in the State of Florida.
Dade County acquired fee simple title to Parcel No. 07-31-01
pursuant to Warranty Deed from Clara Hart dated February 9, 1983,
1 and recorded in 0. R. Book 11707, at Page 507 of the Public
Records of Dade County, Florida. Parcel No. 07-31-01 is
described as follows:
The South 10 feet of Lot 9 and all of Lot 14,
in Block 6, of BON AIRE, according to the Plat
thereof, as recorded in Plat Book 7, at Page
= 12, of the Public Records of Dade County,
Florida.
Based upon the premise that no liens or judgments have been
filed against the property subsequent to Dade County's obtaining
i title and based on the title review by Dade County HUD, I am of
the opinion that, subject to any conditions, restrictions,
covenants, limitations, reservations, easements, liens of record
or zoning regulations, Dade County has good and marketable fee
simple title to the property hereinabove described.
