HomeMy WebLinkAboutR-85-0663At J-85-604 *63 RESOLUTION NO.y5,.0 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO ZEOLA DORSEY THE SUM OF $5,500.00 WITHOUT THE ADMISSION OF LIA- BILITY IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY, PERSONAL INJURY, PROTEC- TION LIENS, CLAIMS, DEMANDS AGAINST THE CITY OF MIAMI AND UPON THE EXECUTION OF A RELEASE RELEASING THE CITY FROM ALL CLAIMS AND COUNTERCLAIMS AND DEMANDS. WHEREAS, Zeola Dorsey filed a claim against the City of Miami through her attorney Gary E. Garbis for alleged bodily injuries and pain and suffering and future medical expenses re- sulting from a fall on a sidewalk located at 918 N.W. 45 Street, Miami, Florida owned by the City of Miami on July 7, 1982; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's office and in accordance with Ordinance No. 8417 which created a City of Miami self-insurance program, the City Attorney's office together with the Risk Manage- ment Division of the Finance Department recommend that this claim be settled, without the admission of liability for the sum of Five -Thousand Five -Hundred Dollars; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Director of Finance is hereby authorized to pay to Zeola Dorsey the sum of Five -Thousand Five -Hundred Dollars ($5,500.00), without the admission of liability, in full and com- plete settlement of all bodily injuries, past and future claims, and expenses, counterclaims demands against the City of Miami, and from all bodily injuries past and future claims, expenses, counter- claims and demands. City of Miami rty Circuit Court Case #83-39645 D/A: July 7, 1982 Location: 918 N.W. 45th Street Miami, Florida Zeola Dorsey through her attorney, Gary E. Garbis, filed an action against the City of Miami to recover damages for injuries received when she tripped and fell on a City sidewalk. As a result of the accident, Ms. Dorsey sustained an injury to her right arm and hand fracturing the base of the 5th right metacarpal. This fracture extends into the joint laterally. Her treating physician, Dr. George L. Richards has given Ms. Dorsey a 12% per- manent physicial impairment of the hand. The doctor has also stated that Ms. Dorsey has definite limitation of grasp and holding with her left hand. The Plaintiff's attorney originally made a demand against the City for $15,000.00 in settlement of this claim. However, Plaintiff has agreed to accept $5,500.00 from the City in settlement of all claims arising out of the accident. This claim has been investigated by the City Attorney's office in accordance with Ordinance No.8417, which created the City's Self Insurance Program. The City Attorney's office, together with the Finance Department, Division of Risk Management, recommend that the City of Miami pay $5,500.00 in settlement of this claim.
