HomeMy WebLinkAboutR-85-07830 RESOLUTION NO* 850%783 A RESOLUTION WAIVING THE fttoutREMENTS AND PROHIBITION CONTAINED IN CITY CODE SECTION 2- 302: 8Y VtNDfNd# AFTER A DULL' ADVERTISED PUOUC HEARING., THAT IT IS IN THE 89ST INTEREST OP THE CITY TO PERMIT LUIS AL80 AN EMPLOYEE OP THE DEPARTMENT OP PARRS AND RECREATION, TO PARTICIPATE IN THE HOME RENOVATION AND REHAAtLtTATION PROGRAM ADMINISTERED 13Y THE DEPARTMENT or COMMUNITY DEVELOPMENT'S HOUSING DIVISION THROUGH THE COMMUNITY DEVELOPMENT 9LOCR GRANT PROGRAM OP THE U. 9 1 DEPARTMENT OP HOUSING AND URBAN DEVELOPMENT& WHEREAS, the City of Miamij through the Community Development Klock Grant Program of the United States Department of Housing and Urban Development has embarked upon a home renovation and rehabilitation program for its residents: and WHEREAS, the Community Development Department Housing Division administers this program; and WHEREAS, Luis Albo a City of Miami Parks and Recreation Department employee, who resides within the City, has applied for rehabilitation assistance under this program; and WHEREAS, said employee qualifies in all respects for participation in said program except that he is employed by the City and would be in technical violation of City Code Section 2- 302; and WHEREAS, a waiver must be obtained for Mr. Albo's participation in said program; and WHEREAS, the City can only avail itself of the opportunity to participate in a valid 'housing redevelopment program through offering the program to all residents of the City,, notwithstanding their employment by the City; and WHEREAS, other City employeeowho have applied and qualified for participation in this program h4VO been given A waiver; NOW, TRURZFORE, BE IT RESOLVED by THE COMMISSION OF ARE CITY OF MIAMI, FLORIDA; CITY COP41,11issION MEETING JUL Is 1905 k � Section 1: The aiithoti at obi set forth in sectioh J hereof k is bawd upon the following findings being made by four -fifths of the members of the City after a duly advertised pabile hearing (a) Luis Albo a parks and R@Ctdation Department employee, who resides within the City, has applied and qualified for participation Ih the home renovation and rehabilitation program administered by the City's Community Development Department Housing bivigion through the Coinnunit Development Block Grant. Program of the united Mates Department of Housing and urban Devel.opm6ht. (b) The City of Miami can only avail itself of the, opportunity to participate in a valid housing redevelopment program through offering the program to all residents of the City, notwithstanding their employment by the City. }° (d) The herein proposed participation will be to the best R interest of the City of Miami. Section 2. Based upon the findings set forth in Section 1 hereof, the requirements and prohibition contained in Section 2- 302 of the City Code are hereby waived. section 3. The City of Miami Community Development Department Housing Division is hereby authorized to allow Luis Albo to participate in the home renovation and rehabilitation program which it administers through the Community Development Block Grant Program of the United States Department of Housing ... and Urban Development. City employees who area not me-mbers of the Commission stt and who area not involved in the administration of the program are el zible for assistance if they meet tLe olicibility critc : ia. .:; Fremtime to time, City employees have met the eligibility criteria -and have requested assistance through the: Rehabilitation Program. These employees are required by the Code of the City t of Miami, Section 2-302. to obtain a waiver from the City Commission after a public hearin„ before such assistance can • be approved. The program guidelines established by the, United status Department W? Housing & Urban Development do not allow the City to set up separate classes of citizens based on their employment as a < ! r criteria for eligibility for assistance programs. They do require r that program staff and member, of governing bodies be: ineli�iblH for assistance from certain pro -rams, based on the abotio, it is recommended that the City Commission ,d, ry E approve the Waiver of the Conf lict of Interest, provision to allow approval of the subject application.
