WHEREAS, the Miami Police Property Unit serves a necessary funttion
within the Police Department; and
WHEREAS. the ltllamI Police property Unit is charged with receiving,

cataloging, warehousing and maintaining all personal property which has been
seized or recovered by Departmental personnelt and

WHEREAS, the Miami Police Property Unit has experienced a significant
increase in the volume of personal property which has been seized for forfeiture

proceedings; and

WHEREAS, this increased volume of personal property which has been seized

for forfeiture proceedings has created the necessity for additional personnel to

receive, catalogue, warehouse and maintain such personal property and to prepare

and record the required documentationassociated with these additional duties; and

WHEREAS, the recent appointment of a second Assistant City
Attorney/Police Legal Advisor, whose primary area of responsibility is forfeiture

proceedings and litigation, will create an additional increase in Property Unit

duties associated with personal property seized for forfeiture proceedings and '
a, WHEREAS, the Miami Police Resource Management division has Identified a

need for the hiring of two (2) additional Property Specialists I to address these
additional needs of the Police nepartment; and
WHEREAS, funds to coves the necessary expenses of two (2) additional
k Property Specialists I have not been Included in the Police Department's normal
operating budget for fiscal year 1984 -5; and
'WHEREAS, funds to cover these expenses are available in the City of Miami
Law Enforcement Trust Fund;

It is recommended that the City Commission adopt a l+esolution
allocating funds in an amount not to exceed forty-four thousand dollars
($4a 000.00) from the City of Miami Law Enforcement Trust Fund to

the emnlov-rent of two (2) additional Property Specialists I to be

The Police Department has recently hired a second Assistant City Attorney; Police

Legal Advisor who will, among his other duties, assist with the litigation and

settlement of forfeiture cases. Current activity regarding the seizures and
forfeiture of currency, vehicles and other personal property indicates a significant
increase in volume that requires additional property unit personnel to address
forfeiture -related tasks. These tasks include forfeiture orooerty record
maintenance, property inspection and general appraisal, preparation for property
and vehicle auctions, and title acquisition.
It is anticipated that the forfeiture activity will require an additional two (2)

Property Specialists I who will be integrated into the Confiscation Detail (under
the supervision of one Sergeant); one corresponding with the day shift of the
Property Unit, the second corresponding with the afternoon shift of the Property
�rV
Unit.
In our efforts to explore' possible funding alternatives for personnel, the legal
advisor has indicated that sufficient monies to fund these positions are available in
and may properly be drawn from the Law Enforcement Trust Fund.
It is, therefore, recommended that the City Commission authorize funding for
these two additional positions from the Law Enforcement Trust Fund,
