AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED: "ECONOMIC
STUDY OF THE MIAMI RIVER", AND
APPROPRIATING FUNDS FOR THE OPERATION OF
SAME IN THE AMOUNT OF $75,000, CONSISTING
OF A GRANT FROM THE UNITED STATES
DEPARTMENT Or COMMERCEt NATIONAL OCEANIC
AND ATMOSPHERIC ADMINISTRATION, AND
S40,000 FROM FISCAL YEAR 1984/85 SPECIAL
PROGRAMS AND ACCOUNTS, MATCHING FUNDS FOR
GRANTS; AUTHORIZING THE CITY MANAGER
TO ACCEPT THE GRANT AWARD FROM THE UNITED
STATES DEPARTMENT OF COMMERCE AND TO
ENTER INTO THE NECESSARY CONTRACT(S)
AND/OR AGREEMENT(S) FOR THE ACCEPTANCE OF
THE GRANT; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, on March 1, 1985, the City of Miami submitted a
proposal to the State of Florida: Department of Environmental
Regulation (DER) requesting $50,000. in coastal management funds
available under Section 306 of the federal Coastal Zone
Management Act; and
WHEREAS, on May 29, 1985, DER indicated its approval of a
$35,000. grant award for the aforementioned proposal by including
it in Florida's Coastal Zone Management Program Administration
Grant Application to the United States Department of Commerce:
National Oceanic and Atmospheric Administration; Office of Ocean
and Coastal Resources Management; and
WHEREAS, the grant will provide some of the necessary funding
needed to undertake a thorough data collection and analysis of
economic conditions existing along the Miami River and begin the

preparation of a comprehensive growth management plan; and d
WHEREAS, the development of the goals and objectives of the I
proposal where based on recommendations by the Marine Council and
the Miami River Management Committee; and
WHEREAS, accomplishment of the objectives was based on the
receipt of a $50,000. grant and a $25,000, contribution by the
City; and
WHEREAS, the $35,000. award 'now requires the City to
contribute $40,000, to carry out a comprehensive economic study
of the Miami River; and
WHEREAS, a sum
of $40,000► is available in the fiscal .year
1984/05 General

NOW, THEREFORE, DE IT ORDAINED BY THE COMMISSION Or THE CITY
OF MIAMI,FLORIDA:
Section I
The following Special Revenue Fund is hereby
established and
resources are hereby appropriated as described
herein:

APPROPRIATION: ECONOMIC STUDY OF THE MIAMI RIVER $ 75,000
Section 2. This appropriation is contingent upon the
approval of the City's application by the United States
Department of Commerce and the City Manager's acceptance thereof.
Section 3. The City Manager is hereby authorized to accept
the grant as set forth in the preamble to this ordinance and to
enter into the necessary contract(s) and/or agreement(s) to
accept the grant for the economic study of the Miami river.
Section 4. If any section, part of section, paragraph,
clause phrase, or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies' and to generally carry on the functions
and duties of municipal affairs.
Section 6. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote .of not less than
four -fifths of the members of the Commission,

IT IS RECOMMENDED THAT THE COMMISSION ESTABLISH A NEW

THE GRANT, PER THE EMERGENCY NANCE ATTACHED.
On March 1, 1985, the City of Miami submitted a proposal to the State of
Florida, Department of Environmental Regulation (DER) requesting $50,000 in
Coastal Management Funds available under Section 306 of the Federal Coastal
Zone Management Act.
On May 29, 1985, DER indicated its approval of a $35,000. grant award for the
aforementioned proposal -by including it in Florida's Coastal Zone Management

A sum of $40,000► is available in the fiscal year M4/85 General Fund,
Special Programs and Accounts, matching funds for grants, as the City's
contribution to the grant program.
The resources are to be appropriated as described below:

APPROPRIATION: ECONOMIC STUDY OF THE MIAMI RIVER $ 75,000
It is requested that this Ordinance be considered on an emergency basis to
expedite the consultant selection process prior to state fund availability in
October 1, 1985. This would allow the consultant to complete the study by
late May, 1986. Should the emergency Ordinance not be established the
consultant award would not take place until January, 1986, thus extending the
study completion by 3-4 months.
This appropriation is contingent upon the approval of the City' s application
by the United States Department of Commerce and the City Manager's acceptance.
