HomeMy WebLinkAboutO-10018J-85-568 Ordinance No. 10018, AN ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED "SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT TRUST FUND" APPROPRIATING S44,585 IN TAX COLLECTIONS FOR FY'85 BASED ON CALENDAR YEAR 1984 TAX ASSESSMENTS THAT WERE GENERATED AS A RESULT OF THE TAX INCREMENT FINANCING PLAN APPROVED 8Y DADE COUNTY AND THE CITY OF MIAMI FOR THE SOUTHEAST OVERTOWN/PARK (JEST PROJECT AREA; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, on July 29, 1982 the City Commission of the City of Miami passed Resolution No. 82-755 approving the Southeast Overtown/Park West Community Redevelopment Plan; and WHEREAS, on December 7, 1982 the Metropolitan Dade County Board of County Commissioners passed resolution No. 82-1677 approving the Southeast Overtown/Park West Community Redevelopment Plan; and WHEREAS, Florida Statute Section 163.387 provides for the establishment of a redevelopment trust fund for each community redevelopment agency; and WHEREAS, on December 21, 1982 the Metropolitan Dade County Board of County Commissioners passed ordinance No. 82-115 for the Southeast Overtown/Park West Community Redevelopment Trust Fund area through which tax increment monies will be channeled for redevelopment activities; and WHEREAS, on March 6, 1983 the City Commission of the City of Miami passed an ordinance No. 9590, authorizing payment into the Southeast Overtown/Park West Redevelopment Trust Fund, authorizing the City of Miami to take full management responsibilities for said fund; and WHEREAS, calendar year 1982 taxable value of $78,305,502 was established by the Dade County Board of Commissioners as the base taxable value for the Southeast Overtown/Park West Redevelopment Area; and WHEREAS, calendar year 1984 taxable value for Said area is greater than the 1982 taxable value; and WHEREAS, the reported difference between the base taxable value of $78,305,502 set in calendar 1982 and the calendar year 1984 taxable value is the increment taxable value to which applicable City and County millages will be, applied; and WHEREAS, the Dade County flax Collector reports application of said millage rates has generated $44,585 in tax increment revenues for the period of November 1984 through Parch 1985; and WHEREAS, monies received by said fund will be used to repay financial obligations associated with the developing the Southeast Overtown/Park West Project Area; and WHEREAS, subsequent Fiscal Year tax increment monies will be included in the City's annual appropriations ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: Fund Title: Southeast Overtown/Park West Redevelopment Trust Fund Resources: Metropolitan Dade County/Southeast Overtown/Park West Community Redevelopment Trust Fund $44,585 Appropriations: Southeast Overtown/Park West Redevelopment Trust Fund $442585 Section 2. The herein appropriations are tax collections for FY'85 based on calendar year 1984 tax assessments that were generated as a result of the tax increment financing plan approved by Dade County and the City of Miami for the Southeast Overtown/Park West Project area. Section '3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with provisions of this ordinance are hereby repealed. Section 4. Overtown/Park hest Redevelopment Trost ]Fund City Commission Agenda aRaM: Sergio Perelr REFERENCEdune 13, 1985s: _ City Manager ENCLOSURES: l 1 It is recommended that the City Commission adopt the attached ordinance establishing a special revenue fund entitled "Southeast Overtown/Park West Redevelopment Trust Fund", appropriating $44,585 in tax collections for FY'85, based on Calendar Year 1984 tax assessments, that were generated as a result of the financing plan approved by Dade. County and the City of Miami for the Southeast Overtown/Park West Project Area. The Southeast Overtown/Park West Project Area is the City's only designated tax increment redevelopment district. It was established by City and County actions in 1982. State law and local ordinances establishing this district call for increases in ad valorem real estate property tax revenues above the 1982 tax revenues to be placed into a Redevelopment Trust Fund on an annual basis. The 1984 tax year is the first year that the Southeast Overtown/Park West Project Area has a reported increase in taxable valuations over the 1982 base year. In 1983 taxable valuations fell below the 1982 base, resulting in a negative increment. Since this is the first year that a tax revenue increment is being generated, we need to activate the Redevelopment Trust Fund and formally appropriate the tax increment revenue to it, 10018{ r] Honorable Mayor and Members of the City Commission May 290 1985 Page 2 The Redevelopment Trust Fund account is to be maintained by the City, and state law requires that it be used to finance or refinance redevelopment activities. As outined in the June 1984 Financial Strategy, the primary use of tax increment monies flowing into the Southeast Overtown/Park West Redevelopment Trust Fund is the retirement of the Section 108 Loan, which is providing front-end funding for part of the Phase I land acquisition. Expenditures from the Redevelopment Trust Fund will require City and County approval. The latest report from the Dade County Tax Collector is that $44,585 in tax increment funds has been collected through March 1985. For subsequent years, anticipated tax increment monies will be included in the City's annual appropriations ordinance, and separate actions like this one will not be required.
