A RESOLUTION OF THE CITY COMMISSION
REAFFIRMING THE EXTSTFNCF OF THE NEED FOR THE
DEVELOPMENT OF RENTAL HO(JSING IN THE CTTY OF
MIAMI AFFORDABLF TO FAMILTFS AND TNDIVTD(JALS
OF LOW AND MODERATE INCOME, INCL(iDING THE
ELDERLY, REAFFIRMING THE PREVTO(JS DESIGNATION
FOR ACQUISITION OF A 3.7 ACRE STTF T,nCATED IN
THE OVERTOWN COMMUNTTY DEVELOPMENT TARGET
AREA FOR THE DEVELOPMENT OF STICH HOUSING,
AND REQTJF,STTNG THAT METROPOLTTAN nADF COUNTY
PROCEED WITH THE ACOUTSITTON OF THE PRIVATELY
OWNED PORTION OF THE STTF THROUGH EMINENT
DOMAIN.
WHEREAS, on October 7, 1981, through Resolution NTo. 81-848,
the City Commission approved implementation of a program to
increase the supply of rental housing in the City affordable tn
families of low and moderate income, including the elderly,
called the Affordable Rental Housinq Development Proqram; and
WHEREAS, on July 22, 1982, through Resolution rTo. 82-678,
the City Commission designated a 3.7 acre site for the
development of such housing and authorized the acquisition of the
privately owned portion of the site: and
WHEREAS, Metropolitan trade County acting on behalf of the
City has not to date, acquired the privately owned portion of the
site; and
WHEREAS, the lack of rental housing in the City affordable
to families and individuals of low and moderate income, including
the elderly, must be addressed through the development of
additional rental housing resources; and
WHEREAS, the Highland Park Site, by virtue of its
geographical location, access to public transportation, health
care facilities, and educational facilities, is deemed to be
appropriate for the development of such housing;
NOW, THEREFORE, BE IT RESOLVFD BY THE COMMTSSION OF THE CITY
OF MIAMI FLORIDA;
Section 1. The matters set out in the foregoing recitals
are hereby found to be true and correct and said recitals are
hereby adopted as if fully set forth in this section.

Section 2. The existence <)f nPed in the City of Miami
for the development of rental housinq affor.dahle to families and
individuals of low and moderate income, including the elderly, is
hereby reaffirmed and the previous designation for acquisition of
the 3.7 acre Hiqhland Park Site located in the Dvertown Communitv
Development Area for the development of such housinq is also
hereby reaffirmed.
Section 3. The City Manaqer is herebv directed to
request Metropolitan Dade County to take all necessar"v legal.
action for the acquisition through eminent domain of the
privately owned portion of the Hiqhland Park Site.

It is recommended that the City
Commission approve the attached
Resolution reaffirming the ex-
istence of the need for the
development of rental housing in
the Citv of Miami affordable to
families and individuals of low
and moderate income, including_
the elderly, reaffirming the
previous designation for acquis-
ition of a 3.7 acre site located
in the Overtown Community Devel-
opment Target Area for the devel-
opment of such housing, and reques-
ting that Metropolitan Dade County
proceed with the acquisition of the
privately owned portion of the site
through eminent domain.
On October 7, 1981, through Resolution No. 81-848, the City Commission
approved implementation of a program to increase the supply of rental
housing in the City affordable to families of low and moderate income,
including the elderly, called the Affordable Rental Housing Development
Program.
on July 22, 1982, through Resolution No. 82-678, the City Commission
designated a 3.7 acre site for the development of such housing and
authorized the acquisition of the privately owned portion of the site.
Dade Countv, serving as acquisition agent for the City, attempted to
acquire the privately owned portion of the site through a negotiated
settlement without success. In May of 1984, Dade County unsuccessfully
attempted to secure the property through eminent domain.

On May 9, 1985 through Motion 85-490 the Citv Commission requested
that Dade County renew its efforts to acquire the property throuc_h
eminent domain.
The Count_; attorney has requested approval of the attached resolution
reaff'_rminq the need for rental housing_ affordable to families and
individuals of low and moderate income and reaffirming the desig-
nation of the Highland Park Site for the development of such housing
prior to reinstituting eminent domain proceedings.
City Commission approval of the attached resolution is recommended.
