HomeMy WebLinkAboutO-10030J-89-178 Amendment No. 13 to Ordinance No. 9901 Ordinance No. 1 0 0 3 0 AN EMERGENCY ORDINANCE AMENDING SECTIONS 5 AND 6 OF ORDINANCE NO. 9901 ADOPTED SEPTEMBER 21, 1984 THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1985, BY INCREASING THE APPROPRIATION FOR THE PENSION TRUST FUND IN THE AMOUNT OF $876,000 AND BY INCREASING REVENUES IN THE SAME ACCOUNT FROM FY'84 PENSION FUND BALANCE FOR THE PURPOSE OF PROVIDING FUNDING TO PAY $876,000 FOR THE PAYMENT OF PENDING CLAIMS FOR REASONABLE PLAINTIFFS' ATTORNEYS FEES ARISING FROM CITY PENSION LITIGATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 5 and 6 of ordinance No. 9901 adopted September 21, 1984, the Annual Appropriations ordinance for the fund year ending September 30, 1985 as amended, is hereby further amended in the following particular 1/ "Section 5. The following appropriations are made in Trust and Agency Fund: Trust and Agency Funds Appropriations Pension $243913;931 $24,889,031 Total Trust and Agency Fund $4236123347 $43,488,347 Section 6. The above appropriations are made based on the following sources of revenues for the 1984-85 Fiscal Year: Trust and Agency Funds Revenues Pension $24;8133831 $24,889,031 Total Trust and Agency Funds $423612,347 $43,488,347 Section 2. The herein appropriation of $876,000 to the Pension Trust Fund from FY'84 Pension Trust Fund Balance is for the purpose of paying reasonable plaintiffs' attorneys fees arising from City Pension litigation. Section 3. Section 5, This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment or its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
