ORDINANCE NO, 9500► THE ZONING ORDINANCE OF
THE CITY OF NIAMI, PLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY
7951-8099 NORTHEAST BAYSHORE; COURT MIAMI,
PLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN)
PROM RG-2/5 GENERAL RESIDENTIAL TO RO-2/5
RESIDENTIAL -OFFICE BY MAKING FINDINGS; AND BY
MAKING ALL THE NECESSARY CHANGES ON PAGE NO,
8 OF SAID ZONING ATLAS MADE A PART OF
ORDINANCE NO. 9500 BY REFERENCE AND DESCRIP-
TION IN ARTICLE 3, SECTION 300, THEREOF;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its n►eeting of May 6,
1985, Item No. 2, following an advertised hearing, adopted
Resolution No. ZB 69-85, by a 6 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 7951-8099
Northeast Bayshore Court, Miami, Florida, more particularly
described as Lots 3, 4, 5 and 6, Block 1, CAUSEWAY BAYFRONT
(44-60) of the Public Records of Dade County, Florida, from
RG-2/5.General Residential to RO-2/5 Residential -Office.
Section 2. It is hereby found that this zoning classi-
fication change;
(a) Is in conformity with the adopted Miami comprehensive
Neighborhood Plan;
(d) is not out of scare with the needs of the neighborhood
or the city;
(e) will not Materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 8 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

use characteristics of the area. No significant
changes in the immediate area of the subject
property have resulted to justify the granting -
of the petitioned Change of Zoning. There is no
need for additional office zoning in the
subject area. The immediate area is
predominantly residential with single family to
the north and multiple family usage to the west.
A significant amount of commercial :zoning exists
along NE 79th Street. The granting of the
petitioned Change of Zoning would unnecessarily
bring office zoning into a viable residential
area and would therefore constitute an isolated
zoning district.
No dedication is requested.
No comment.

for an amendment to the City of Miami Zoning Atlas from RG-2/5
(General -Residential) to RO-2/5 (Residential -Office) on lots
legally described as follows:
Lots 3, 4, 5 and 6, Block 1 of Causeway
Bayfrontsr according to the Plat thereof as
recorded in Plat Book 44, Page 60 in the
Public Records of Dade County, Florida.
The present residential zoning designation is inappropriate
for a variety of reasons. Most significantly,, the proximity of
the property to a main commercial artery, 79th Street, with its
associated noise, traffic, air pollution, as well 44 to other
commercial uses to the south and southeast, has Made the property

unattractive for residential habitation. As a consequence, the
market for townhouse -condominiums in the area has collapsed.
This is evidenced by the fact that Mr. Gordon has failed to sell
any of his townhouse -condominium units constructed in 1980.
The only appropriate use for the property is as Residential -
Office. According to the legislative intent of the RO classifi-
cation as stated in the City of Miami's Schedule of District
Regulations:
This district designation is intended to apply
in areas that are primarily residential in
character but within which offices would also
_ be appropriate at compatible scale and inten-
sity, either in separate buildings or in com-
bination with residences.
The subject property is certainly "primarily residential" in that
it abuts both single-family and multi -family zones. In addition,
the townhouses on the property are clearly "on a compatible
scale" with the neighboring residential areas. Next, the anti-
cipated use of the townhouses as offices for professionals such
as for architects, lawyers or accountants, would not be of an
incompatible "intensity". Professional offices are generally
open between 9:00 a.m. and 6:00 p.m. This is precisely the time
homeowners are at work and their children are at school. The two
uses do not overlap but rather they blend well.
Finally, the subject property has remained vacant for more
than five years. It is certainly within the interest of the City
of Miami to permit the owner of such choice bayfront property to
put his property to some reasonable use. Unless the City
approves this zone change, the property may remain vacant
indefinitely. in light of the foregoing we urge your favorable
recommendation of the above request.

WHEREAS, the Miami Zoning Board, at its meeting of May 6,
1985, Item No. 2, following an advertised hearing, adopted
Resolution No. ZB 69-85, by a 6 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 7951-8099
Northeast Bayshore Court, Miami, Florida, more particularly
described as Lots 3, 4, 5 and 6, Block 1, CAUSEWAY BAYFRONT
(44-60) of the Public Records of Dade County, Florida, from
RG-2/5 General Residential to RO-2/5 Residential -Office.
Section 2. It is hereby found that this zoning classi-
fication change;
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighbothood
or the City:
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.)
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safet�
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 8 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.
