RESOLUTION NO.
A RESOLUTION ALLOCATING $5500 FROM SPECIAL
PROGRAMS AND ACCOUNT, CONTINGENT FUND, SAID
SUM BEING IN ADDITION TO $4,5000 ALSO BEING
ALLOCATED FROM SAID FUND IN SUPPORT OF THE
HAITIAN REFUGEE CENTER/SANT REFIJIE AYISYIN, _
INC. FOR THE PERIOD FROM AUGUST 1, 1985
THROUGH SEPTEMBER 30, 1985 TO MAINTAIN
SERVICES PROVIDED BY THE AGENCY TO THE
HAITIAN COMMUNITY; FURTHER AUTHORIZING THIS
CITY MANAGER TO ENTER INTO AN AGREEMENT, TN A }
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
SAID AGENCY; SAID AGREEMENT TO PROVIDE, THAT
NO MONIES ALLOCATED HEREUNDER ARE TO RE USED
FOR INSTITUTION OF OF ANY LEGAL PROCEEDINGS
AGAINST ANY GOVERNMENTAL AGENCY OR
INSTRUMENTALITY.
WHEREAS, the City Commission adopted Motion No. 85-794 on —
July 25, 1985 which referred a funding request of S10,000 from
the Haitian Refugee Center,/Sant Ref ijie Avisvin, Inc. to the City
Manager for review; and
WHEREAS, Motion No. 85-794 also authorized the Citv Manaqer
to disburse $4,500 of the said agency's funding request upon his
approval; and
WHEREAS, the proposal was reviewed and the City Manager has
approved the disbursement of $4,500 of the agency's $10,000
request and now recommends approval of the entire requested
amount;
NOW, THEREFORE, RE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The amount of $5,500 is hereby allocated from
Special Programs and Accounts, Continqent Fund, said sum beinq in
addition to $4,500 which is also hereby allocated from said fund
in support of the Haitian Refuqee Center/Sant Refijie Ayisyin,
Inc. for the period from August 1, 1985 through September 30,
1985 to maintain services provided by the agency to the Haitian
community.

Section 2. The City Manager is hereby authorized to
enter into an agreement, in a form acceptable to the City
Attorney, with said agency; said agreement to provide that no
monies allocated hereunder are to be used for institution of any
legal proceedings against any governmental agency or
instrumentality.

It is recommended that the City
Commission adopt a resolution which
increases the allocation to the
Haitian Refugee Center/Sant Refijie
Ayisyin., Inc. from $4,500 to $10,000
for the purpose of maintaining legal
services to the Haitian community
for the period August 1, 1985-
September 30, 1985.
It is recommended that the City Commission adopt the attached
resolution which increases the allocation to the Haitian Refugee
Center/Sant Refijie Ayisyin from $4,500 to $10,000. City funds will be
used to cover the personnel costs of one attorney and three paralegals
to maintain legal services to the Haitian community for the period
August 1-September 30, 1985.
At its meeting of July 25, 1985, the City Commission adopted Motion 85-
794 which referred the agency's $10,000 funding request to the City
Manager for review. The motion also directed the City Manager to
authorize the allocation of $4,500 to the agency pending review and
approval of the agency's proposal. The proposal has been reviewed and
authorization has been given to enter into contract with the agency for
$4,500.
The attached resolution effectuates the full intent of Motion 85-794 by
increasing the existing allocation of $4,500 to the Haitian Refugee
Center/Sant Refijie Ayisyin, Inc. by $5,500 to the requested level of
$10,000.
