RESOLUTION NO.
A RESOLUTION OFFICIALLY ACCEPTING THE
ATTACHED CITY CLERK'S CERTIFICATION AND
DECLARATION OF THE RESULTS OF THE SPECIAL
MUNICIPAL ELECTION HELD AUGUST 13, 1985 IN
WHICH 'PHE EXTENSION, COMBINATION AND
MODIFICATION OF TWO EXISTING LEASE AGREEMENTS
RELATED TO THE OPERATION OF MONTY TRAINER'S
RESTAURANT, MARINA, AND ROATSHED FACILITY
LOCATED ON CITY -OWNED WATERFRONT PROPERTY IN
THE COCONUT GROVE AREA OF THE CITY OF MIAMI,
FLORIDA, WAS APPROVED BY THE ELECTORATE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The City Commission hereby officially accepts
the attached City Clerk's Certification and Declaration of the
results of the Special Municipal Election held on Auqust 13, 1985
in which the extension, combination and modification of two
existinq Lease Aqreements related to the operation of Monty
Trainer's Restaurant, Marina, and Boatshed Facility located on
City -owned waterfront property in the Coconut Grove Area of the
Citv of Miami, Florida, was approved by the electorate.
Section 2. The City Commission hereby declares:
(a) with respect to said extension,
combination and modification of two existinq Lease Aqreements
related to the operation of Monty Trainer's Restaurant, Marina,
and Boatshed Facility, said election was duly called and properly
held and notice thereof was duly qiven in accordance with law and
Resolution No. 85-642, adopted June 13, 1985, entitled:
"A RESOLUTION CALLING AND PROVIDING FOR A
SPECIAL MUNICIPAL ELECTION TO BE HELD ON
AUGUST 13, 1985, FOR THE PURPOSE OF
SUBMITTING TO THE QUALIFIED ELECTORS OF
THE CITY OF MIAMI FOR THEIR APPROVAL OR
DISAPPROVAL, A PROPOSED EXTENSION,
COMBINATION AND MODIFICATION OF TWO
EXISTING LEASE -AGREEMENTS RELATED TO THE
OPERATION OF MONTY TRAINER'S RESTAURANT,
MARINA, AND BOATSHED FACILITY LOCATED ON
CITY -OWNED WATERFRONT PROPERTY IN THE
COCONUT GROVE AREA OF THE CITY OF MIAMI,
FLORIDA; FURTHER DIRECTING THE CITY CLERK
TO CAUSE A CERTIFIED COPY OF THE HEREIN
RESOLUTION BE DELIVERED TO THE SUPERVISOR
OF ELECTIONS OF METROPOLITAN DADE COUNTY,

FLORIDA, NOT LESS THAN 45 DAYS PRIOR TO
THE DATE OF SUCH SPECIAL MUNICIPAL
ELECTION,";
(b) all steps in connection with said bond
election were duly, regularly and lawfullv taken and had; and all
applicable provisions of the Constitution and Statutes of the
State of Florida and of said Resolution have been fully complied
with;
(c) the inspectors and clerks of each
election precinct in the City have duly made returns of the
results of the election in each such precinct on the question
submitted at said election;
(d) at said election there was submitted to
the qualified electors of the City of Miami, Florida, the
following question:
"Shall the City of Miami's two lease
agreements with Monty Trainer's
Restaurant, Marina and Roatshed in
Coconut Grove be combined into one lease
agreement and extended 25 years, provided
that Montv Trainer acar_ees to invest an
additional $600,000 in improvements for a
minimum investment of $3-Million and to
increase his minimum rent payment to the
City by $5,000 per month for an increased
minimum rent payment of $3-Million over
the lease term?";
(e) the attached schedule correctly shows
the number of each of the election precincts in the Citv of
Miami, the number of electors entering the voting machine booths
for the purpose of voting, the number of votes cast by qualified
electors on the question for the extension, combination and
modification of the two said existing Monty Trainer Lease
Agreements and the number of votes cast by qualified electors on
the question against extension, combination and modification of
the two said existing Monty Trainer Lease Agreements;
(f) each qualified elector of the City of
Miami was given the opportunity of voting for or against the
extension, combination and modification of the two said existing
Monty Trainer Lease Agreements;

Section 3. With respect to the question set forth above
concerning the two said Monty Tr.alner Lease Agreements, it is
hereby found and determined that 10,730 votes were cast by
qualified electors in favor of the extension, combination and
modification of the two said existing Monty Trainer Lease
Agreements; that 8,241 votes were cast by
qualified electors
against the extension, combination and modification of the two
said existing Monty Trainer_ Lease Agreements and the Commission
hereby declares and certifies that the extension, combination
and modification of the two said existinq Montv Trainer Lease

Agreements was approved by the qualified electors of the City of
Miami at such election and that the total number of votes on the
question in said election in said voting precincts
was 18►971 and that a majority of the votes on the question
in said election in said voting precincts was in favor of
approving the extension, combination and modification of the two
said existing Monty Trainer Lease Agreements.
Section 4. The proper officers of the City of Miami are
herebv authorized and directed to perform any and all incidental
duties and to take appropriate proceedings in connection herewith
as required by law for the extension, combination and
modification of the two said existing Monty Trainer Lease
Agreements.

In the past, the City Clerk has requested that we prepare
resolutions reflecting City Commission acceptance of the City
Clerk's canvassing of election results in connection with Special
Municipal Elections. Accordingly, the attached resolutions have
been prepared which will reflect the electorate's action with
respect to two ballot questions at the August 13, 1985 Election.
The City Clerk is receiving original approved resolutions even
though the City Clerk's Certifications and Declarations are not
attached thereto. Presumably, after the elections, Mr. Ongie can
prepare and deliver to you the Certifications and Declarations
together with and attached to a copy of the appropriate
resolutions before you distribute the Commission packet.
