HomeMy WebLinkAboutO-10036Amendment No' /$ to Ordinance No. 9539 ORDINANCE NO-1 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 9989, ADOPTED DECEMBER 20, 19840 THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY APPROPRIATING AN AMOUNT OF $600,000 FROM 1980 HIGHWAY GENERAL OBLIGATION BONDS TO ESTABLISH THE GRAND PRIX RACE CIRCUIT PAVING PROJECT AS A CAPITAL PROJECT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9939 on December 20, 1984, establishing resources and appropriations for implementation of Capital Improvements in the City of Miami; and WHEREAS, the City of Miami and Miami Motorsports, Inc. entered into an agreement dated June 14, 1982, granting a license to use a portion of Bayfront Park and adjacent roadways and land owned by the City for the staging of Grand Prix race events; and, WHEREAS, the agreement between the City and Miami Motorsports, Inc. was amended on December 31, 1984, and January 14, 1985, to set forth the understanding, rights and obligations with respect to staging of the Grand Prix racing events within Bayfront Park adjacent to and within the premises leased for the Bayside Specialty Center and the Parking Garage; and WHEREAS, the City has commenced construction of certain improvements to a portion of Bayfront Park pursuant to, the Bayfront Park Redevelopment Project; and WHEREAS, it is recognized that the construction and operation of the Bayside Specialty Center and Parking Garage and the construction of the Bayfront Park Redevelopment Project will have a definite impact on the staging of the Grand Prix raoe events by Miami. Motorsports, Inc.; and WHEREAS, purauant to a request from Miami Motor.3porta, Inc., the city Commission adopted Resolution .No. 85 8Q1 on July i 1 A J 251 19851 001-6ving the relodation of the Mace circuit ff'6m Bayfront Park to Bicentennial Park and authorizing the City Manager to advance funds for the design and construction of the Grand Prix Race Circuit Paving Project in Bicentennial Park; and WHEREAS, the amount of funds advanced for the design and construction of said race circuit shall not exceed an amount of $600i000; and WHEREAS, an amount of $600,000 is available from 1980 Highway General Obligation Bonds and can be appropriated to establish the Grand Prix Race Circuit Paving Project as a capital project in the Capital Improvement Fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 9939, adopted December 20, 1984, is hereby amended in the following particulars: 1/ "Section 1. The following appropriations hereby made by fund and project title include previously authorized projects and fund appropriations for implementation of all municipal capital improvements of the City of Miami, Florida. The sources of revenues to support the herein appropriations are hereby identified by fund and project. Appropriations ($000) 4. Transportation A. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to its employees; and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry out the functions and duties of municipal affairs. Section 5. The requirements of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. City commission Meeting City Manager September 12, 1985 ENCLOSURES ( Companion to Item # 4 Ordinance (Emergency) It is recommended that the City Commission adopt the attached emergency Ordinance amending Capital Improvement Ordinance No. 9939 to appropriate an amount of $600,000 from 1980 Highway General Obligation Bonds to establish the Grand Prix Race Circuit Paving Project as a capital project. The City Commission adopted Resolution No. 85-801 on July 25, 1985, approving the relocation of the Grand Prix Race Circuit from Bayfront Park to Bicentennial Park. Resolution No. 85-801 further provided for the City of Miami to advance funds for the construction of the race course through Bicentennial Park and be reimbursed by Miami Motorsports, Inc. The amount of funds advanced to Miami Motorsports, Inc. for the design and construction of the race circuit shall not exceed an amount of $600)000. The amount of $600,000 is available for this purpose from 1980 Highway General Obligation Bonds. It is recommended that the attached Ordinance be adopted to appropriate an amount of $600,000 from 1980 Highway General Obligation Bond Funds to establish the Grand Prix Race Circuit Paving Project as a capital project in the Capital Improvement Fund. It is requested that the attached Ordinance be scheduled on the City Commission meeting of September 12, 1985, as an emergency measure.
