HomeMy WebLinkAboutO-100432 J-85-955 ORDINANCE NOS. 0048 Amendment No. 14 to Ordinance Nn. 9901 AN EMERGENCY ORDINANCE AMENDING SECTIONS 1,215 AND 6 OF ORDINANCE NO, 9901, ADOPTED SEPTEMBER 21,1984, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1985, AS AMENDED BY INCREASING THE APPROPRIATIONS FOR THE GENERAL OBLIGATION BOND FUND IN THE AMOUNT OF $561,500 AND BY INCREASING REVENUES IN THE SAME AMOUNT FROM FY'84 DEBT SERVICE FUND BALANCE TO PAY FOR $561,500 OF ADDITIONAL INTEREST PAYMENTS DURING FY'85 AS A RESULT OF THE RECENT SALE OF $12,000,000 IN GENERAL OBLIGATION BOND ANTICIPA- TION NOTES, BY INCREASING ENTERPRISE FUND REVENUES IN THE AMOUNT OF $508,400, $238,400 FOR THE CONFERENCE CENTER, AND $270,000 FOR THE MUNICIPAL AUDITORIUM BY INCREASING FY'85 APPROPRIATIONS IN A LIKE AMOUNT, FOR THE PURPOSE OF APPROPRIATING $238,400 OF ADDITIONAL REVENUE, FOR THE CONFERENCE CENTER AND FUNDING DEFICITS ACCUMLATED IN PRIOR YEARS FOR THE MUNICIPAL AUDITORIUM TO BE FUNDED FROM A CONTRIBUTION FROM THE GENERAL FUND BY INCREASING THE SPECIAL REVENUE FUND, RESCUE SERVICES, IN THE AMOUNT OF $50,072 FROM FUND BALANCE, BY INCREASING THE FY-85 APPROPRIATIONS FOR RESCUE SERVICES IN A LIKE AMOUNT FOR THE PURPOSE OF PURCHASING TWO (2) BASIC LIFE SUPPORT VANS, BY INCREASING TRUST AND AGENCY REVENUE PENSION, IN THE AMOUNT OF $1,120,000, BY INCREAS- ING THE APPROPRIATION FOR PENSION IN A LIKE AMOUNT FOR THE PURPOSE OF MEETING THE ACTURIAL REQUIREMENTS FOR THE SETTLEMENT OF THE PENSION LITIGATIONS AND TO ADEQUATELY PROVIDE FOR THE PAYMENT TO POLICE AND FIRE SUPPLEMENTAL PENSION FUNDS, ALSO AUTHORIZING THE FINANCE DIRECTOR TO APPROVE AND RECORD IN THE POOLED CASH AND INVEST- MENTS GROUP OF ACCOUNTS THE CITY'S PAYMENT OF BANK AND INVESTMENT MANAGEMENT CHARGES IN THE AMOUNT OF $62,000, RETAIN AND RECORD AS COMMUNITY DEVELOP- MENT PROGRAM REVENUE THE INTEREST EARNED ON H.U.D. FUNDS IN THE AMOUNT OF $224,650 AND ESTABLISH A RESERVE FOR POSSIBLE LOSSES ON INVESTMENTS IN THE AMOUNT OF $300,000; CONTAINING A REPEALER PROVISION AND A _sEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9901 the Annual appropriations ordinance on September 21, 1984, establishing revenues and appropriations for the City of Miami, Florida for the fiscal year ending September 30, 1985; and WHEREAS, funds are required to pay $561,500 for additional interest expenditures in the General obligation Bond Fund as a result of the recent sale of $12,000,000 in General obligation Bond anticipation notes; and WHEREAS, $561,500 is available from FY'84 Debt Service Fund Balance to pay said interest expenditures; and WHEREAS, additional Enterprise Fund Revenues in the amount of $238,400 are available from a net increase in parking fees, rents and interest income at the Conference Center; and WHEREAS, $270,000 is available from a contribution from the General Fund for the municipal Auditorium; and WHEREAS, these additional monies are required to offset increased operational costs of said Conference Center and to fund accumlated deficits in prior years at the Municipal Auditorium; and WHEREAS, $50sO72 is available from prior year fund balance in the Rescue Services Department to purchase two (2) Basic Life Support Vans; and WHEREAS, 1,120,000 is needed to meet the acturial and Self Insurance requirements of the Pension Litigation Settlement and payment to the Police and Fire supplemental pension fund; and WHEREAS, Revenues are available in the amount of $300,000 from the State of Florida, Police and Fire Insurance Premium payments (Florida Statue 175 and 185), and $820j000 from the Pension Trust and Agency Fund Balance to meet this obligation; and WHEREAS, the City uses a Pooled Cash and Investments Group of Accounts to record and maintain substantially all cash, investments, and accrued interest; and WHEREAS, interest income is allocated based upon the approximate proportionate balance of each fund's positive equity in pooled cash and investments; and WHEREAS, interest earned by the Pooled Cash and Investments Fund in fiscal year 1984-85 will exceed $12,000,000; and WHERERAS, it is to the City's advantage to compensate its bank for service by payment of approximately $62,000 rather than by maintaining full compensation balances; and WHEREAS, interest earnings of $224,650 on Community Development funds have been approved by H.U.D. for retention and recordation as Community, Development Program Revenues; and WHEREAS, the establishment of a reserve for possible loss on investments in the amount of $300,000, is deemed necessary in order to absorb possible investment losses; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1,2,5 and 6 of Ordinance No, 9901 adopted September 21, 1984, The Annual Appropriations Ordinance for fiscal year ending September 30, 1985, is hereby amended in the following particulars: 1/ "Section 1, The following appropriations are made for the municipal operations of the City of Miami, Florida, for the Fiscal Year 1984-85, including the payment of principal and interest on all general obligations bonds and interest on all general obligation bond anticipation no es: -'r r Total enterprise Funds $�3992 $ 22,2.17,�Z1 Special Revenue Funds Revenues Rescue Services-1363;834 $ 1,313,9Q Total Special Revenue Funds $-16;314:976 $ 16_,365,048 Trust and Agency _Funds Revenue Pension $=24-;889;831 $ 26,009,031 Total Trust and Agency Funds $-43;4881347 $ 44,608,347° Section 2. The herein appropriation for the General Obligation Bond Fund in the amount of $561,500 is to pay for $561,500 of additional interest payments during FY185 as a result of the recent sale of $12,000,000 in General Obligation Bond anticipation notes. Revenue in a like amount is available from FY'84 Debt Service Fund balance. The herein appropriation in the Enterprise Fund, Conference Center in the amount of $238,400 is for the purpose of appropriating $238,400 of additional revenue earned during FY'85 (i.e. rent, parking fees interest income) which will offset increased operational costs. The herein appropriation of $270,000 is for the purpose of funding accumulated deficits in prior years for the Municipal Auditorium. Revenue in a like amount is available from a contribution from the General Fund. The herein appropria- tion of $50,072 for Rescue Services is for the purpose of purchasing two (2) Basic Life Support Vans. Revenue in a like amount is available from fund balance. The herein appropriation for the Trust and Agency Fund, Pension in the amount of $820,000 is for the purpose of meeting actuarial requirements for the settlement of the Gates Case and $300,000 for additional payments to State of Florida Police and Fire Insurance premium pension fund. Revenue in a like amount is available from the State of Florida, Police and Fire Insurance premium payments of '$300,00 and $820,000 from the Pension Fund Balance. The herein ordinance also authorizes the Finance Director to approve and record in the pooled cash and investments group of accounts the City's payment of Bank and investment management charges in the amount of $62,000, retain and record as Community Development Program Revenues the interest earned on H,U,p, funds in the amount of $224,650 and establish a reserve for possible losses on i.nvest� ments in the amount of $300,000, Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby a repealed. If any section, part of section, paragraph, clause, phrases or' word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected, Section 5, This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment or its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote not less than four -fifths of the members of the Commission. This facility and the fund will cease to exist during the current fiscal year as the 9ayside Project becomes a reality. During its many years of operation, the Municipal Auditorium fund accumulated a deficit fund balance of approximately $270,000, This appropriation ordinance will 'fund this deficit and allow the Finance Department to close the financial accounts on the Auditorium as of the end of this fiscal year. The conference Center has received S238,400 of additional revenue from a net increase in parking fees, rents and interest income. This additional revenue will fund increased operational costs for said Conference Center. The Special Revenue Fund Rescue Services has committed S50,072 from prior year reserves to purchase two (2) Basic Life Support Vans. This purchase was awarded during 1983-84 Bid Plo. 83-84-119 to EVF Inc. for delivery in FY'85. The Pension Fund requires an additional appropriation of $1,120,000 to provide sufficient funding to: $820,000 to meet the increased actuarial requirements that was necessitated by the settlement of the Gates case. $300,000 to bring the appropriation for the transfer of the State of Florida, Chapters 175 and 185, funds up to amount actually received. The City of Miami maintains a Pooled Cashed and Investments Group of Accounts for all of its cash investments, except those with fiscal agents. Interest earnings for the Pooled Cash and Investments Group of Accounts during the current fiscal year are estimated to exceed $12,000,000, and are prorated among funds with positive cash balances. The herein appropriation for the General Obligation Bond Fund in the amount of $561,500 is to pay for $561,500 of additional interest payments during FY'85 as a result of the recent sale of $12,000,000 in General Obligation Bond anticipation notes. Revenue in a like amount is available from FY'84 Debt Service Fund balance. The herein appropriation in the Enterprise Fund, Conference Center in the amount of $238,400 is for the purpose of appropriating $238,400 of additional revenue earned during FY'85 (i.e. rent, parking fees interest income) which will offset increased operational costs. The herein appropriation of $270,000 is for the purpose of funding accumulated deficits in prior years for the Municipal Auditorium. Revenue in a like amount is available from a contribution from the General Fund. The herein appropria- tion of $50,072 for Rescue Services is for the purpose of purchasing two (2) Basic Life Support Vans. Revenue in a like amount is available from fund balance. The herein appropriation for the Trust and Agency Fund, Pension in the amount of $820,000 is for the purpose of meeting acturial requirements for the settlement of the Gates Case and $300,000 for additional payments to State of Florida Police and Fire Insurance premium pension fund.
