A RESOLUTION AUTHORIZING AND PERMITTING BELLE

RESTRICT VEHICULAR ACCESS ON A 90-DAY

THE EASTERLY SIDE OF THEIR INTERSECTION WITH
N.E. 6 COURT, SUBJECT TO THE EXECUTION OF AN
AGREEMENT TO RE PREPARED BY THE CITY OF MIA!+I
IN CONFORMANCE WITH THE REQUIRErAENTS OF THE

not -for -profit corporation, hereinafter referred to as
ASSOCIATION, was founded to promote the welfare and safety of the
residents of the Relle Meade neighborhood; and
WHEREAS, ASSOCIATION has requested permission from the City
to restrict vehicular traffic into the Belle Meade neighborhood
by constructing and maintaining barricades across N.E. 72
Terrace, N.E. 73 Street, N.E. 74 Street, N.E. 75 Street and N.E.
77 Street at the east side of their intersection with N.E. 6
court; and
WHEREAS, the Police Department, Fire, Rescue & Inspection
Service Department and Solid Waste Department have made
recommendations on the ASSOCIATION'S request and have expressed
no objections to the concept of restricting vehicular traffic
into the Belle Meade neighborhood on a trial basis;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. BELLE MEADE HOMEOWNERS' ASSOCIATION INC. is
hereby granted permission, subject to the following provisions of
this resolution, to construct and maintain for a 90-day trial
period, temporary barricades in the Belle Meade area,
as follows:

Street and N.E. 77 Street at the east side of the intersection of
said streets with N.E. 6 Court, said barricades to prevent
vehicular access but not to restrict pedestrian access, with said
temporary barricades to be constructed accordinq to plans
prepared by a registered encainee r and subject to the approval of
the Ci ty of t1i ami Department of Publi c Works.
Section 2. Said association shall prepare and obtain
approval from Metropolitan Dade County Public 'Works Department,
Traffic Division, for a traffic signaqe and/or traffic striping
plan for the Belle t,leade area affected by the herein traffic
prohibition.
Section 3. If said association fails to properly maintain
said barricades and traffic sions or if the barricades for any
reason become a hazard to the health, welfare and safety of the
general public as determined by t;ie Director of Public Works, the

City may remove or require the ASSOCIATION to remove the
barricade and traffic signs.
Section 4. Said association shall provide the City with a
performance bond acceptable to the City in the amount of five
hundred dollars to insure that the barricades and traffic siqns
may be removed and the streets returned to the condition that
existed prior to the construction of the barricades.
Section 5. The 90-day trial period shall begin after
construction of the barricades has been accepted by the City's
Public Works Department and after all required traffic signaqe
and striping has been installed and accepted by the Made County
Public Works Department.
Section 6. After 60 days of t11e 90-day trial period
has elapsed, said association shall send certified letters to all
affected property owners soliciting their approval or disapproval
for construction of permanent barricades. Property owner shall

respond directly to the City's Public 'forks Department utilizing
postage paid nest cards included with the certified letters.
Property owner response will be evaluated by Ci tv staff and the
herein vehicular access prohibition shall only he made permanent
upon approval of the City Commission by resolution.
Section 7. All costs for construction of the temporary
barricades, signs, stripinn, and any related incidental expenses
shall be borne by said association.
PASSED AND ADOPTED this 26th day of
SEPTEMBER , 1985.

RE: Traffic Control Program - Belle Meade
Dear Commissioner Dawkins,
As per our meeting on September 6, 1985 we are requesting
you to place the Belle Meade Home Owners Association Inc. on
the agenda for the Commission Meeting September 26, 1985. Wt,
would prefer this presentation to be made after 6:00 P.M.
We would also greatly appreciate you securing the response
memos from the affected departments relating to the Petition
presently before the Dept, of Public Works for the above
mentioned Commission Meeting.
During our conversation you indicated strong support
for our Petition, requesting the City of Miami to install and
maintain a traffic control system in our neighborhood. Thus,
we are asking you to endorse this issue when it is presented
to the Commission. Your signature on the attached copy will
indicate to us your committed endorsement on this issue.
