RESOLUTION NO. 8&S-4 —1048
A RESOLUTION APPROVING AND AUTHORIZING THE
ACQUISITION BY WAY OF PURCHASE OR
CONDEMNATION OF THE PARCEL OF LAND LOCATED IN
THE IMMEDIATE VICINITY OF THE INTERSECTION OF
N.E. 36TH STREET AND 2ND AVENUE, THE ENTRANCE
TO THE MIAMI DESIGN PLAZA AREA OF THE CITY,
WHICH PARCEL CONTAINS APPROXIMATELY 5,000
SQUARE FEET AND WHICH IS MORE PARTICULARLY
AND LEGALLY DESCRIBED IN THE ATTACHED
_ EXHIBIT A; FURTHER AUTHORIZING AND DIRECTING
THE CITY ATTORNEY TO TAKE ALL NECESSARY STEPS
TO ACQUIRE SAID PROPERTY BY CONDEMNATION
PROCEEDINGS.
WHEREAS, the Miami Design Plaza area of the City is in dire
need of both improved park and parking facilities; and
WHEREAS, the herein described parcel of privately -owned
property is an integral and essential part of the City's ongoing
necessary revitalization project in this area of the City; and
WHEREAS, prior efforts have been unsuccessfully made to
secure the herein parcel for valid public and municipal purposes
by negotiation and purchase;
NOW, THEREFORE, RE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The acquisition of the parcel of land located
in the immediate vicinity of the intersection of N.E. 36th Street
and 2nd Avenue, the entrance to the Miami Design Plaza area of
the City, which parcel contains approximately 5,000 square feet
and which is more particularly and legally described in the
attached Exhibit A, is hereby approved; further, said acquisition
is hereby authorized by way of purchase or condemnation.
Section 2. The City Attorney is hereby authorized to
take all necessary steps to acquire said property by condemnation
proceedings.
Section 3. All recitals and findings contained in the
Preamble of this Resolution are hereby incorporated by reference
thereto and are hereby adopted as if fully set forth in this
section.

In the past, the City Commission has expressed its intent to
support and enhance the development of the Miami Design Plaza
area. In addition to commitments from other City departments, the
Department of Off -Street Parking has agreed to develop a parking
lot and beautify the entrance to the Miami Design Plaza at the
intersection of N.F. 36th Street and N.E. 2nd Avenue.
The Department of Off -Street Parking recently completed a parking
lot under I-95. A small parcel of land containing- approximately
5,000 square feet is located south of the Department's parking lot
and north of the existing parking entrance area. This parcel has
been appraised and the Off -Street Parking Board has expressed its
intent to purchase the parcel which will link the parking lot and
the entrance into a single beautified entrance to the Miami Design
Plaza. The property owner has not responded to the Department's
offer and the Off -Street Parking Board has reached the conclusion
that condemnation is appropriate and necessary.
Our office has been requested to implement the condemnation
process. The Off -Street Parking Board has agreed to compensate
the City for the cost of condemning the parcel. Your
authorization is needed to commence condemnation proceedings for
the parcel and is contained in the attached proposed resolution.

LEGAL DESCRIPTION
That portion of Lot 44, BUENA VISTA VISCAYNE BADGER CLUB
COMPANY, according to the Plat thereof recorded in Plat Book 1
at Page 115 of the Public Records of Dade County, Florida, lying
south of State Road Number 25, Section Number 87090-2405; and
that portion of the SW 1/4 of Section 19, Township 53 South,
Range 42 East, Dade County, Florida, lying south of the south
line of said Lot 44 and lying west of the west right-of-way line
of the Florida East Coast Rail Road right-of-way and lying north
of the north line of the public park as described in official
records book 8988 at page 1514, less those portions dedicated
for N.E 2nd Avenue
