HomeMy WebLinkAboutO-10047ORDINANCE NO, 07 AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED., "SELECTIVE TRAFFIC ENFORCEMENT PROJECT (FY 186)"j APPROPRIATING FUNDS FOR ITS OPERATION IN THE AMOUNT OF $7840418 COMPOSED OF $392,209 FROM THE UNITED STATES DEPARTMENT OF TRANSPORTATION THROUGH THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS AND $3929209 FROM THE FY186 POLICE DEPARTMENT BUDGET; AND AUTHORIZING THE CITY MANAGER TO ACCEPT THE $392,209 GRANT AWARD FROM THE UNITED STATES DEPARTMENT OF TRANSPORTATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the United States Department of Transportation, through the Florida Department of Community Affairs, has offered the City of Miami a $392,209 grant to continue a driving - under -the -influence intervention program for the period October 1, 1985 through September 30, 1986; and WHEREAS, the City's Police Department plans to continue the program with a specially trained team of ten (10) police/motorcycle officers and a police supervisor; and WHEREAS, this team of police officers will utilize state of the art technology and equipment, including a custom designed BAT (Blood Alcohol Test Unit) mobile, specially designed police motorcycles, state of the art alcohol testing equipment and sophisticated video technology, to conduct a highly visible enforcement effort against those high risk driver groups who are particularly responsible for serious accidents on the roadways; and WHEREAS, a sum of $392,209 is available in the FY186 Police Department Budget to cover the matching requirements of the Selective Traffic Enforcement Project (FY 186) grant; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1 The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Selective Traffic Enforcement Project (FY 186) RESOURCES: United States Department of Trans- portation through the Florida Department of Community Affairs: Bureau of Highway Safety $392,209 FY186 Police Department Budget $392,209 APPROPRIATIONS: Selective Traffic Enforcement Project (FY 186) $784,418 Section, 2. The City Manager is hereby authorized to accept the grant as set forth in the preamble to this ordinance and to enter into the necessary contract(s) and/or agreement(s) to accept the grant. Section 3. All ordinances or parts of ordinances, insofar as they are inconsistant or in conflict with the provisions of this ordinance, are hereby repealed. Section 4. If any section, part of section, paragraph, clauses phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs, 8edti6h 6.
