AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO,
99390 ADOPTED DECEMBER 20, 1984, THE CAPITAL
IMPROVEMENT APPROPRIATIONS ORDINANCE, BY
INCREASING APPROPRIATIONS FOR THE BAYSIDE
SPECIALTY CENTER PROJECT IN THE TOTAL AMOUNT
OF $2,002,000 AND INCREASING APPROPRIATIONS
BY AN AMOUNT OF $149,000 FROM 1984 STORM
SEWER GENERAL OBLIGATION BONDS, AN AMOUNT OF
$30,000 FROM 1980 SANITARY SEWER GENERAL
OBLIGATION BONDS, AN AMOUNT OF $1,823000,
FROM 1980 HIGHWAY GENERAL OBLIGATION BONDS
FOR A TOTAL APPROPRIATION TO SAID PROJECT IN
THE AMOUNT OF $4,0001000; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9939 on
December 20, 1984, establishing resources and appropriations
for implementation of Capital Improvements in the City of
Miami, and
WHEREAS, by Resolution No. 84-1341.3 on December 7, 1984,
the City Commission authorized the City Manager to execute a
lease agreement between the City of Miami and Bayside Center
Limited Partnership (Developer) on behalf of Rouse Miami, Inc.
an affiliate of the Rouse Company of Columbia, Maryland for the
planning and design, construction., leasing and management of a
waterfront specialty center known as "Bayside Specialty
Center;" and
WHEREAS, the executed lease agreement between the City and
Developer includes a provision that the City pay a total of
$4,000,000 to the Developer for site improvements to be
constructed by the Developer at Bayside Specialty Center,
located on a City -owned land parcel adjacent to Biscayne
Boulevard and Miamarina and a portion of Bayfront Park; and
WHEREAS, storm sewer, sanitary sewer, highway and related
improvements to be constructed by the Developer at a value of
$4,000,000 have been identified to be funded by the City in
fulfillment of the City's obligation under the executed base
agreement; and

WHEREAS) the City COtMis8i6h adopted Resolution N6*599� on
May 91 1985, establishing the Bayside Specialty Center as a
capital project and appropriating an amount of $1i998t00o to
said project; and
WHEREAS) it is now necessary to appropriate an additional
$2)002)000 to Bayside Specialty Center in fulfillment of the
City's $4)000)000 obligation; and
WHEREAS, an amount of $149,000 is available from 1584
Storm Sewer General Obligation Bonds and can be appropriated to
Bayside Specialty Center to increase appropriations for storm
sewer improvements; and
WHEREAS, an amount of $30,000 is available from 1980
Sanitary Sewer General Obligation Bonds and can be appropriated
to Bayside Specialty Center to increase appropriations for
sanitary sewer improvements; and
WHEREAS, an amount of $1,823,000 is available from 1980
Highway General Obligation Bonds and can be appropriated to
Bayside Specialty Center to increase appropriations for highway
and related improvements; and
WHEREAS, the total amount of $2,002,000 is hereby
appropriated to increase appropriations for the Bayside
Specialty Center capital project to the total amount of
$4,0002000.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 9939, adopted
December 20, 1984, is hereby amended in the following
particulars: 1/

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with provisions of this
ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be
affected.
Section 4. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officer, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry out the functions
and duties of municipal affairs.
Section 5. The requirements of reading this ordinance on
two separate days is hereby dispensed with by a vote of not
less than four -fifths of the members of the Commission.

On December 7, 1984, by Resolution No. 84-1341.3 the City Commission
authorized the City Manager to execute a lease agreement between the
City of Miami and Bayside Center Limited Partnership (Developer) for
the planning and design, construction, leasing and management of a
waterfront specialty center known as "Bayside Specialty Center."
The executed lease agreement includes a provision that the City fund a
total of $4,000,000 worth of site improvements to be constructed by
the Developer. A total of $4,000,000 in site improvements have been
identified to be funded by the City to fulfill its obligation under
the lease agreement.
On May 91 1985, by Resolution No. 9992, the City Commission
appropriated a.total of $1,998,000 for Bayside Specialty Center during
FY 185. It is now necessary to increase appropriations by $2,002,000
for FY 186 for a total project appropriation of $4,000,000 to fulfill
the City's obligation under the Bayside lease agreement.
