FURTHER, FINDING THAT THE CITY Nn LONGER NEEDS SAID LAND FOR RIGHT-OF-WAY PURPOSES INVOLVING THE EXTENSION OF SOUTHEAST MIAMI AVENUE ROAD (8RICKELL, PLAZA) FROM SOUTHEAST 8TH STREET TO SOUTHEAST 6TH STREET. WHEREAS, The City of Miami is empowered by the Charter to acquire in fee simple, by condemnation or. otherwise. property, real or personal. or any estate or interest therein, for any of the purposes of the City: and WHEREAS, it is no longer the desire of the City Commission to exercise such authority for purposes of acquiring property from Southeast 8th Street to Southeast 6th Street for additional street right. -of -way; and WHEREAS, it is in the best interest of the general welfare of the City of Miami that Resolution No. 83-054 be rescinded. NOW, THEREFORE, RE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA7 Section 1. The City Commission hereby finds that acquisition of the right-of-way for the extension of. Southeast Miami Avenue Road (Brickell Plaza) from Southeast 8th Street to Southeast 6th Street is hereby no lonqer necessary to fulfill the public need for additional street right-of-way. Section 2. The City Commission hereby further finds that changing conditions since the passage of. Resolution No. 83-1054 on November 16, 1983, mitigate the immediate necessity for acquiring the properties described in Resolution No. 83-1054. Section 3. As a consequence of the foregoing, the City Commission hereby cancels and rescinds in its entirety Miami City Commission Resolution No. 83-1054. Patterson and J.F. and B.T. Olive subdivisions, as recorded in Plat Book B at page 77 of the Public Records of Dade County, Florida. Section 2. The City Manager is hereby authorized to execute all agreements relative to said acquisition should the City's offer be accepted, with said documents being subject to review and approval by the City Attorney. Section 3. Those portions of Resolution No. 83-1054, passed and adopted by the City Commission on November 16, 1983, which pertain to Lots 15 and 7 of Block 107 South, S.L. and J.B. The acquisition of this property was approved and directed by Resolution No. 83-1054 and is needed for the extension of Brickell Plaza (a/k/a S.E. Miami Avenue Road). The total dollar value of the offer is $764,100, and will be paid from Highway General Obligation Bond Funds; it is further recommended that Resolution No. 83-1054, as it applies to Lots 15 and 7 of the aforementioned subdivision, be rescinded. The City Commission on November 16, 1983, passed Resolution 83- 1054 finding and determining the public need and necessity for acquiring the fee simple title to certain properties for the e extension of Brickell Plaza from S.E. 6 to S.E. 8 Streets. The resolution directed the Law Department to institute and prosecute to a conclusion the necessary legal actions to accomplish the acquisition of this property. This acquisition was first proposed in 1978 as a means of relieving- the congestion on Brickell Avenue in the intersection _ of S.E. 7 and S.E. 8 Streets. In 1980 the Brickell Station Area Design and Development plan stressed the importance of this proposed street acquisition again to relieve the congestion of the traffic south of the Miami River. On March 2, 1983, Mr. William Powell, the Director of Dade County Public Works wrote to Mr. James R. Reid, Assistant City Manager, stating that he believed that the construction of this street is very desirable and should be accomplished as soon as possible. — A •al b1 7{ �Ak (1 .1 40 i a k Honorable Mayor and Members of the City Commission Recommendations The $764,100 offer is comparable to the present market value of real property in the area of acquisition. It is further recommended that the City Commission rescind Resolution No. 83-1054 as it pertains to Lots 15 and 7, Block 107S9 Patterson and Oliver Subdivision, according to the plat thereof as recorded in Plat Book B at page 77 of the Public Records of Dade County, Florida. These two lots were originally included in the proposed acquisition to serve as right-of-way for the proposed Brickell leg of the Downtown Component of Metrorail (DCM). At the present time the proposed alignment is only tentative, could change and will not be firmly established until the end of Calendar Year 1986. Should the alignment change, the City would be in possession of two parcels of land for which little if any need could be justified. The complete report is available under separate cover, entitled BAM 32 A Plan for Transportation Improvements, Brickell Station Area. The traffic projections in this report, in part, relied -on year 2000 traffic assignment projections developed for Dade County by the Metropol- itan Planning Organization (MPO). The reliability of the MPO assignment for several Brickell station area roadways has come under question by SADD highway and traffic planners. As a result, the capacity analysis element of this report and the attendant roadway improvements should be treated as an interim analysis. A downtown area origin -and -destination study (which will include the Brickell station area) will be undertaken by Dade County shortly and those results, expected within a year, will provide a revised set of traffic projections. Existing Circulation System Roads within Dade County and other urban areas are classified according to the functions they serve. The functional classification of the Brick - ell station area's roadway network includes a number of arterial and col- lector facilities in both north -south and east -west orientations. Three of these roadways, Brickell Avenue, SE/SW 7th Street and SE/SW 8th Street are major arterials while SE/SW 13th Street (Coral Way) is classified as a minor arterial. The two collectors which serve the station area are S. Miami Avenue and SW 2nd Avenue south to SW 13th Street. Traffic flows on station area arterials and collectors consist of a com- bination of through and local access traffic. Much of the through traf- fic is generated by downtown commercial activity situated immediately north of the station area. By far, Brickell Avenue's 2,200 to 2,500 existing t•!o-way P.M. peak -hour volumes are the station area's highest. Traffic volumes in the P.M. peak -hour on S.W. 7th Street (one-way) and SE/SW 13th Street (two-way) are in the 1,000 to 1,200 vehicle range;while those on SE/SW 8th Street and S. Miami Avenue range from 300 to 700 vehi- cles. This street extension is necessary to accomplish certain objectives for facilitating traffic circulation in the area. This proposed street alignment coincides with the Phase II alignment of the Brickell DCM leg, and would in our estimate accommodate both the guideway and station platforms. Although the City of Miami would propose to use street improvement bond funds to finance this acquisi- tion, the City believes that the land acquisition costs are creditable as a portion of the Miami share of the DCM funding commitments. We would welcome the opportunity to discuss this further with the expectation of receiving a letter of agreement from the County that will enable us to expedite the bond authorization and land acquisition process. Cather ENCLOSURES. 1 Sketch Director of Public Works The City Manager has requested the Department to proceed with the Brickell Plaza Improvement, which is included in the present Capital Improvement Program. S.E. Miami Avenue Road (Brickell Plaza) will be extended from S.E. 8 Street to S.E. 6 Street. Right-of-way must be acquired before this highway improvement can be accomplished. Phase II of the Downtown Component of Metrorail (DCM) is programmed to be constructed immediately adjacent to the Brickell Plaza Improve- ment. The proposed location of the DCM and the Brickell Plaza High- way Improvement are shown on the attached plan. If the following commitments are made by the Dade County Transportation Administration (DCTA), it would be cost effective for the City to acquire the right-of-way needed for the DCM between S.E. 6 and 8 Streets in conjunction with the right-of-way acquisition for the Brickell Plaza Highway Improvement. The DCTA has been requested to provide the following: 1. A firm commitment that Phase II of the DCM will be constructed in the right-of-way corridors indicated on the attached plan. 2. A firm commitment that the full cost of acquiring the right-of-way will be part of the City's required contribution for the cost of constructing Phase II of the DCM. I will inform you as soon as a firm commitment is received from DCTA. Please prepare the necessary resolutions for the November 10, 1983 City Commission Meeting for authorization to acquire, by condemnation if necessary, the right-of-way for both the DCM and Brickell Plaza between S.E. 6 and 8 Streets as shown on the attached plan. Six Hundred Thousand Dollars in Highway G.O.B. funds were appropriated for the Brickell Plaza Improvement in the Capital Improvement Appropriation Ordinance (No. 9534). Additional Highway G.O.B. funds are available and the Capital Improvement Appropriation Ordinance can be amended to provide the needed funds for right-of-way acquisition. The transfer of development rights should be taken into consideration when appraisal of property values are determined. The property owners on the west side of Brickell Plaza will have the DCM located between their property and the street improvement. Pedestrian walkways and vehicular driveways could be con- structed beneath the DCM allowing these property owners direct use of Brickell Plaza. Can these property owners on the west side of Brickell Plaza be assessed a portion of the cost of the highway Improvement? Please provide this department with a legal opinion on these two questions. E. 6 and 8 Streets REFERENCES ENCLOSURES The City Commission, on November 16, 1983, passed Resolution 83-1054 finding and determining the public need and necessity for acquiring the fee simple title to certain properties for the extension of Brickeli Plaza from S. E. 6 to 8 Streets. The resolution directed the Law Department to institute and prosecute to a conclusion the necessary legal actions to accomplish the acquisition of this property. On August 1, 1985 a meeting was held in the Department concerning the acquisition of property for the extension of Brickell Plaza between S. E. 6 and 7 Streets. The meeting was attended by Messrs. Joel Maxwell, Law Department, Albert Armado, Property and Lease Manager, George Campbell, Public Works Department and Bill Mackey, Public Works department. The Department is in agreement with the following conclusions reached at this meeting: 1. The Ci ty should proceed, as directed by the Ci ty Commission, to acquire the needed property as soon as legally permissible. 2. The Fair Market Value of the property to be acquired is $60.00 per square foot as indicated in the appraisal prepared for the City by Property Consultant Inc. 3. The City should acquire Lots 8 and 16, Block 1075, S.L. At J.B. Patterson and J.F. & B.T. olive Sub. (B-77). 4. The Ci ty should not purchase Lot 15 and the east one- half of Lot 7 of this subdivision, even though they are also owned by Mrs. Wickenheiser, and adjoin Lots 8 and 16. The City originally anticipated purchasing Lots 15 and the East 1/2 of Lot 7 as part of the Ci ty's required contribution for the cost of Stage II of the OCM. Page 1 of 2 V rf. However, the County has not been able to provide a firm commitment as to the route of the DCM or that right of way acquisition at this time would be eligible for a matching federal grant. S. The City should demolish the old deteriorating buildings on Lot 8. City Commission approval should be requested in September to enter into an agreement to purchase the property in accordance with the previously stated conditions. Your letter dated August 2, 1985, indicates that "firm commitments" from Dade County are necessary if the City is to be able to proceed with the acquisition of certain right-of-way needed for the planned southern ex- tension of the Metromover system in conjunction with the purchase of property needed by the City for the extension of Brickell Plaza. Based on my review of the particulars involved, MDTA's position on the specific issues you have brought to my attention is as follows: 1) To the extent that the footprint of the adopted Metromover alignment generally falls within the right-of-way proposed to be acquired by the City, I do not have any problems with giving you my commitment that the portion of the Metromover extension between SE 6th and 7th Streets will be constructed in the right-of-way acquired by the City provided that the alignment is not changed by factors outside my control such as, for example: a) Findings of significant adverse effects which may be identified during development of the federally required Environmental Impact Statement which would dictate a change to the previously adopted alignment. b) Changes to the alignment dictated by joint action of the County and City Commissions. Although not likely, these are conditions outside of my con- trol which could potentially arise and have an impact on the alignment. It should also be noted that a number of groups/ individuals including, I believe, the City of Miami's Plan- ning Department, have suggested revisions to the alignment of the Metromover's Brickell extension. To my knowledge, none of the suggested changes affects this portion of the alignment. Before proceeding to final design and construc- tion of the project, however, we will need to revisit the adopted alignment (adopted on June 15, 1979 at a joint public hearing of the City and County Commissions) and if 5�. This is absolutely nec- essary particularly in the Brickell area where so much development has taken place since 1981. Again, let me assure you that I am not aware of any suggested changes in the area in question and, given the fact that the point at which the alignment will cross the Miami River and tie into the Stage I loop is already fixed, I do not see any realistically feasible alternative alignments in this particular section. 2) In previous correspondence with the City (see attached letter from W. Higgins to J. Reid, dated March 1983), MDTA has already indicated its willingness to consider the City's acquisition costs for the portion of the right-of-way ultimately used to accommodate the pro- posed Metromover southern extension as a credit against the City's obligation for funding the extensions. It is my intention to live up to this prior MDTA commitment; however, in all fairness, it is also my expectation that the City will review its overall funding commitment to the Metromover extensions. The currently committed funds were based on a $201.0 million project which due to delays in implementation has now escalated to $240.0 million. Needless to say, this represents a significant increase in the local share which must be put together to match the 75% federal money we are seeking. Quite obviously, if collectively we (State, County, City and private sector) are not successful in solving the local funding share problem, the Metromover extensions will remain on the drafting table and these issues we are discussing today will be purely academic. 2 Should the City decide to proceed with the acquisition of this right-of-way, we would appreciate your written confirmation so that we may advise UMTA of our actions and thus maximize our chances of having the cost of that por- tion of the right-of-way needed for the Metromover considered an eligible project cost. I sincerely hope the above information is of use to you in deciding a course _ of action on the purchase of the right-of-way in question.
