HomeMy WebLinkAboutR-85-1083J-85-938 RESOLUTION A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY MARIA MEDINA LLORENTE, SEVEN THOUSAND DOLLARS ($7,000), WITHOUT THE ADMISSION OF LIABILITY, IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY, PERSONAL INJURY PROTECTION LIENS, WORKERS' COMPENSATION LIENS, CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI AND WILLIE CULPEPPER UPON EXECUTION OF A RELEASE RELEASING THE CITY OF MIAMI AND WILLIE CULPEPPER FROM ALL CLAIMS AND DEMANDS. WHEREAS, Maria Medina Llorente, through her attorney, filed a claim against the City of Miami, for alleged bodily injury resulting from a motor vehicle accident wherein Maria Medina Llorente was a driver in a motor vehicle involved ir a collision, with a City of Miami Public Works Department vehicle on September 141 1984, at Northwest 16th Avenue and Northwest 2r.d Street Miami, Dade County, Florida; and WHEREAS, the above claim has been investigated by the Risk Management Division in accordance with Ordinance No. 8417, which created the City of Miami's Self -Insurance Program, and the said Division, together with the City Attorney, recommend that this claim be settled, without the admission of liability, for the sum of seven thousand dollars ($7,000); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section The Director of Finance is hereby authorized to pay to Maria ;edina Llorente the sum of seven thousand dollars ($7,000), without the admission of liability, in full and complete settlement of all bodily injury, personal injury protection liens, workers' compensation liens, claims and demands against the City of Miami and Willie Culpepper, upon the execution of a release releasing the City of Miami and Willie Culpepper from all bodily injury, personal injury protection liens, workers' compensation liens and claims and demands. October 8, 1985 FILEY84-172 SUBJECT Maria Medina Llorente vs City of Miami & Willie Culpepper D/A: 09-14-84 L/A: N.W. 16 Ave. & N.W. 2 St. REFERENCES: Miami, Florida ENCLOSURES: Agenda of 10/24/85 (1) Maria Medina Llorente, by and through her attorney, filed a claim against the City of Miami alleging bodily injury. The claim arose as a result of an automobile accident between a car driven by Maria Medina Llorente and a City Public Works Department truck. The accident occurred on September 14, 1984 at 3:00 p.m. at N.W. 16 Avenue and N.W. 2 Street, Miami, Florida. The Public Works truck was westbound on N.W. 2 Street at N.W. 16 Avenue, and failed to stop at a stop sign. The claimant vehicle was southbound on N.W. 16 Avenue, a through street when its left front end was struck by the front of the fully loaded Public Works truck. This resulted in the claimant's vehicle, a 1980 Oldsmobile, being declared a total loss with the City already having paid the property damage claim. The injuries to the claimant have been diagnosed as cervical strain, and a thoracic -lumbar strain. A permanent disability rating has been given at 5 to 7 per cent of the body as a whole. The total medical expense is $3,169.00 and all medical expenses and other items of damage have been verified as correct. The above claim has been investigated by the Risk Management Division in accordance with Ordinance No. 8417, which create the City of Miami's Self Insurance Program, and said Division, together with this office recommend that this claim be settled, without the admission of liability, for the sum of $7,000. r LAD/PDW/vj cc: City Manager 8" u-1083
