AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO, 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY
5600-5650 NORTHWEST 6TH STREET, MIAMIt
FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN)
FROM RG-2/4 GENERAL RESIDENTIAL TO RG--2/7
GENERAL RESIDENTIAL MAKING FINDINGS; AND BY
MAKING ALL THE NECESSARY CHANGES ON PAGE NO.
31 OF SAID ZONING ATLAS MADE A PART OF
ORDINANCE No. 9500 BY REFERENCE AND
DESCRIPTION IN ARTICLE 3, SECTION 300,
THEREOF; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of July 15,
1985, Item No. 4, following an advertised hearing, adopted
Resolution No. ZB 93-85, by a 7 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 5600-5650
Northwest 6th Street, Miami, Florida also described as Tentative
Plat #1166-A - "FABULOUS PARTNERSHIP SUB." of the Public Records
of Dade County, Florida, and more particularly described as set
forth in Exhibit "A" attached hereto, from RG-2/4 General
Residential to RG-2/7 General Residential.
Section 2. It is hereby found that this zoning classi-
fication change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the est4blished land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schoolso utilities, streets, etc.;
(f) IS necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood,,
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m') Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 31 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

area of the subject property have resulted to
justify the granting of the petitioned change of
sector number: The change would be out of scale
with the needs of the neighborhood and the City.
It would increase the intensity of development
by 251% by an increase in the floor area ratio
from .49 (sector 4) to 1.72 (sector 7), Such a
change would also, not be in accord with the
Miami Comprehensive Plan.

Letter of Intent on Zoning Application of
Fabulous Partnership
Re, Application by Fabulous Partnership, a Florida General Partnership,
for District Boundary Change from RG2.2 to RG2.7, on property
located at Northwest 57th Avenue and 6th Street.
To Whom it may concern:
This Letter of Intent is a part of and supplements the above -referenced
application by Fabulous Partnership. The subject property is a vacant parcel
of land approximately 3/4 of an acre in size which in 1983, was changed from
its then commercial designation of CG-1/7 to RG-2/4 Applicant wishes to
increase its present intensity sector from 4 to 7 to allow development of a
rental residential building containing 52 units.
The present request should be granted based on the following
justifications:
(a) The property is fronted by commercially zoned and developed
properties on three sides. To the immediate north are small buildings
apparently used for storage and minor mechanical repair activities. To the
northwest is Fabulous Diamonds, a large retail store, and io the immediate
west is a plant nursery. To the east of the property is a parcel "owned by
Florida Power and Light, and beyond that parcel is the Mount' Nebo Cemetery.
Any residential structure developed on the subject parcel will be greatly
impacted by these surrounding commercial uses, which will limit the
property's desirability in the rental market. A decrease in the size of the
rental units and consequent increase in the number of total units permitted on
the site is a justified setoff for the property's unique location.
(b) The proposed 52 unit residential building would be compatible with
the residential properties abutting the subject property to the south The
residential properties to the south consist of older rental residential buildings
four stories an hight, The proposed. 5 story residential building (which
includes parking on first floor) would therefore not be incompatible with the
surrounding residential area,
(c) The proposed 52 unit rental residential building will help alleviate
the critical need for reasonably priced residential rental units within the City
of Miami,
