RESOLUTION NO.
A RESOLUTION INSTRUCTING THE CITY ATTORNEY TO
FILE INJUNCTIVE OR OTHER JUDICIAL RELIEF IN THE CIRCUIT COURT FOR THE ENFORCEMENT OF
ZONING AND OTHER CODES RELATING TO THE USE OF
PROPERTY OWNED BY NORTHWESTERN MEATS, INC., -
LOCATED AT 2147 NORTHWEST 23RD STREET, MIAMI,
FLORIDA.
WHEREAS, the property located at 2147 Northwest 23rd Street,
Miami, Dade County, Florida, is being used in violation of the
R-3 Residential zoning classification currently in effect on the
said property; and
WHEREAS, the property is currently owned by Northwestern
Meats, Incorporated, and has been cited by the City of. Miami for
improper commercial use of the Residential zoning; and
WHEREAS, said matter has been the subject of investigation
by the State Attorney For the Dade County Grand Jury; and
WHEREAS, it appears that injunctive relief will be the most
expeditious method to eliminate all violations of City Codes
existing at said location;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
1. The City Attorney is hereby instructed to take appropri-
ate steps in filing suit in Circuit Court for the enforcement of
City zoning and other Codes through injunctive or other judicial
relief against Northwestern Meats, Inc., the owner of property
located at 2147 Northwest 23rd Street, Miami, Florida, after said
property owner has been given sixty (60) days notice in which to
cease violations of said Codes in its use of said property.
2. In the event that it becomes necessary to institute
legal proceedings, the City Attorney is hereby authorized to do
so without further action by this Commission, with costs for said
litigation to be paid from Special Programs and Accounts,
Contingent Fund.

The proposed legislation (J-85-1133) is a resolution instructing
the City Attorney to file injunctive relief or other judicial
relief from the Circuit Code for the enforcement of zoning and
other codes relating to the use of property owned by Northwestern
Meats, Inc. The property is located in the City of Miami at 2147
NW 23 Street, Miami, Florida, and has been cited by the City of
Miami for improper commercial use of residential zoning.
A case was filed by the City in front of the Code Enforcement
Hoard in 1982 and has been pending before the City of Miami Code
Enforcement Board. The Board has stayed consideration until a
general study concerning the industrial needs of the City of Miami
is completed. This violation of the zoning classification has
been the subject of an investigation by the State Attorney of the
Eleventh Judicial Circuit of the State of Florida and it appears
that injunctive relief will be the most expeditious method to
eliminate all violations of City Codes existing at said location.
The attached resolution will instruct this office to take
appropriate steps in filing suit in Circuit Court after having
given said property owner 30 days notice in which to cease
violations of said codes in its use of said property. The
resolution further authorizes the cost for said litigation to be
paid from Special Programs and Accounts, Contingent Fund.
