SILP-1160 RESOLUTION AUTHORIZING THE USE OF $568,000 FROM THE CAPITAL IMPROVEMENT FUND FOR THE PURPOSE OF CONTINUING A SEAT MODERNIZATION PROGRAM AT A COST OF $568,000 FOR INSTALLATION OF ADDITIONAL SEATS AT THE ORANGE BOWL STADIUM PRIOR TO THE END OF THE 1985 FOOTBALL SEASON; SAID $568,000 HAVING BEEN THE SUBJECT OF AN ALLOCATION FROM RESORT TAX REVENUES BY THE DADE COUNTY BOARD OF COMMISSIONERS TO BE RESTORED IN FISCAL YEAR 1965-86 TO SAID FUND. WHEREAS, a Seat Modernization Program at the Orange Bowl Stadium has been initiated; and WHEREAS, the Tourist Development Council approved $568,000 for continuing this seat modernization project and the Dade County Board of Commissioners passed a resolution on April 2, 1985 to allocate $568,000 from Resort Tax Revenues for Orange Bowl Stadium improvements subject to the City returning the money z if the Orange Bowl were ever sold and the City allowing the Miami Dolphins to continue using the Orange Bowl if the new Dolphin stadium was not completed; and WHEREAS, the conditions placed by the Board of County Commissioners on the release of these funds are unacceptable to the City Commission; and WHEREAS, the seats need to be replaced for safety reasons and City cannot afford to wait for the resolution of various City/County issues; and WHEREAS, monies can be made available from the Capital Improvement Fund for the herein purpose to be replaced in Fiscal Year 1985-86 from Resort Tax Revenues; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution authorizing use of Capital Improve- ment Fund for seat REFERENCES. replacement at Orange Bowl ENCLOSURES. Resolution The Office of Stadiums recommends the adoption of a resolution authorizing the use of $568,000 from the Capital Improvement Fund for the purpose of continuing a seat modernization program at a cost of $568,000 for installation of replacement_ seats at the Orange Bowl Stadium prior to the end of the 1985 football season; said $568,000 having been allocated from Resort_ Tax Revenues by the Dade County Board of Commissioners. The Tourist Development Council approved $568,000 for the continuation of an Orange Bowl seat replacement project. On April 2, 1985, the Dade County Board of Commissioners passed a resolution to allocate $568,000 from Resort Tax Revenues for these seats; however, this allocation was made subject to the City returning the funds granted if the Orange Bowl were ever sold and the City allowing the Miami Dolphins to continue using the Orange Bowl if the new Dolphins stadium was not completed on time. Negotiations between the City and the County for release of these funds are continuing. As has happened with past Orange Bowl Resort Tax projects, the City has advanced the funds for these projects and later submitted documentation on project costs to Dade County for reimbursement_ from the Resort Honorable Mayor and Members of the City Commission Page 2 of 2 Tax revenues. Said use of $568,000 is needed to continue a seat modernization program in the Orange Bowl. This will permit the replacement of 19,500 deteriorated and unsa a seats. The funds advanced from the Capital Improvement Fund will be restored upon receipt_ of said funds from Dade County. 85-ii%O
