RESOLUTION NO. - i i'VI&
A RESOLUTION CLOSING, VACATING, ABANDONING
AND DISCONTINUING THE USE OF THAT PORTION OF
THE PUBLIC UTILITY EASEMENT, AS INDICATED ON
THE RECORDED PLAT TITLED "GROVE MOUNTAIN"
RECORDED IN PLAT BOOK 118, PAGE 16 OF THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA, ALL
AS A CONDITION OF APPROVAL OF TENATIVE PLAT
#1261 "GROVE MOUNTAIN REPLAT".
WHEREAS, the Miami Zoning Board at its meeting of
November 4, 1985, Item No. 1, following an advertised hearing,
adopted Resolution ZB-152-85 by a 8 to 0 vote RECOMMENDING
official vacation and closure of a portion of public utility
easement hereinafter set forth; and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of the public
utility easement in question and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY_
OF MIAMI, FLORIDA:
Section 1. That portion of the public utility easement,
as indicated on the recorded plat titled "GROVE MOUNTAIN"
recorded in Plat Book 118, Page 16 of the Public Records of. Dade
County, Florida, as a condition for approval of Tentative Plat
#1261 - "GROVE MOUNTAIN REPLAT" is hereby closed, vacated,
abandoned and discontinued for public use..

The Zoning Board, at its meeting of November 4, 1985, Item 1, following an
advertised hearing, adopted Resolution ZB 152-85 by an 8 to 0 vote,
recommending approval of the Official Vacation and Closure of that public
utility easement as indicated on the recorded plat titled "GROVE MOUNTAIN"
recorded in Plat Book 118, page 16 of the Public Records of Dade County,
Florida; as a condition for approval of Tentative Plat #1261 - "GROVE MOUNTAIN
REPLAT".
One objection received in the mail. One reply in favor received; - eight
proponents present at the meeting.
Backup information is included for your review.

City Manager
The City of Miami Plat and Street Committee, at its meeting of
September 4, 1985, approved the above tentative plat subject
to the following revisions being made to the tentative plat,
additional information being provided and/or variances being
granted. Please be advised that the processing of your
tentative plat cannot proceed until these conditions have been
satisfied.
-Public hearing for approval to close easement.
-Identify Greenwood Drive A show R/W.
In addition to the above requirements, you should be aware of
the following:
I. State and local laws require the installation of various
physical improvements in the public rights -of -way when
property is platted. These subdivision improvements
include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial investment on
your part.

The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3.
A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.
4.
Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5.
Additional items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be -
notified in writing as to what these items are after the
amount of the bond has been determined for the necessary
subdivision improvements.
6.
Tentative plat approval is only valid for one (1) year from

Dear Walter:
You may recall the Miami Dade Water & Sewer easement problem on
the Grove Mountain plat that we briefly discussed in Don Cather's
office. Upon reviewing the easement situation, the Public Work's
Department formulated an opinion that the Grove Mountain plat
needed to be replatted in order to vacate the water and sewer
easement. This easement was just needed on a temporary basis to
serve two houses,' and always intended to be vacated when the
property was developed. It is unfortunate that the owners of the
property did not utilize an easement agreement instead of putting

(temporary) easement on the record plat, but this inappro-
fir
priate action is now history.
We are operating under a very difficult and critical time period
with the replat process, and I would like to request that the
r
City Commission at the November 26th meeting act on both the
removal of the easement and approve the Grove Mountain Replat.

The vacation of easement/replat matter will go before the Plan-
ning and zoning Hoard at the November 4th meeting. Since there

are no controversial issues involved in this replat and only the
f
vacation of the (temporary) water and sewer easement, I would
hope the two matters could be acted upon at the November 26th
City Commission meeting.

Dear Ms. Fox:
Ms. Betty Malver, of your department, notified me last week that
the City Attorney had questioned our inclusion of Mr. Charbon-
net's name on the ownership disclosure form for the application
for public hearing relative to the subject replat. You may
recall that we did include the notation that he has a
"Contract to Purchase".
Please find enclosed a sworn affidavit by Bobbette B. Kolisch,
one of the applicants for the replat and the public hearing,
stating that there is currently in force an agreement for the
sale of the subject property to Mr. Charbonnet. It is our intent
that this affidavit satisfy the City Attorney as to Mr. Charbon-
net's interest in this application and his authority to partici-
pate in the public hearing in his capacity as Purchaser under the
contract. Bobbette Kolisch will, of course, alsolbe in attendance
at the public hearing and the City Commission meeting.

BEFORE ME, the undersigned authority, personally ap-
peared before me, BOBETTE B. KOLISCH, who, after being duly sworn
deposes and says:
1. That she has joined in an application for public
hearing before the Zoning Board of the City of Miami, which mat-
ter will subsequently be heard by the City Commission, for the
vacation of a certain easement by a replat of Plat No. 1261,
Grove Mountain Replat.
2. That she has entered into and there is currently in
force an agreement for the sale of the subject property to Loys
Charbonnet III. In connection with•'that agreement she has
authorized Loys Charbonnet III to process the above referenced
application.
