WHEREAS, the Miami Zoning Board at its meeting of November 4, 1985, Item No. 1, following an advertised hearing, adopted Resolution ZB-152-85 by a 8 to 0 vote RECOMMENDING official vacation and closure of a portion of public utility easement hereinafter set forth; and WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to grant the vacation and closure of the public utility easement in question and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY_ OF MIAMI, FLORIDA: Section 1. That portion of the public utility easement, as indicated on the recorded plat titled "GROVE MOUNTAIN" recorded in Plat Book 118, Page 16 of the Public Records of. Dade County, Florida, as a condition for approval of Tentative Plat #1261 - "GROVE MOUNTAIN REPLAT" is hereby closed, vacated, abandoned and discontinued for public use.. Dear Walter: You may recall the Miami Dade Water & Sewer easement problem on the Grove Mountain plat that we briefly discussed in Don Cather's office. Upon reviewing the easement situation, the Public Work's Department formulated an opinion that the Grove Mountain plat needed to be replatted in order to vacate the water and sewer easement. This easement was just needed on a temporary basis to serve two houses,' and always intended to be vacated when the property was developed. It is unfortunate that the owners of the property did not utilize an easement agreement instead of putting r (temporary) easement on the record plat, but this inappro- fir priate action is now history. We are operating under a very difficult and critical time period with the replat process, and I would like to request that the r City Commission at the November 26th meeting act on both the removal of the easement and approve the Grove Mountain Replat. _ The vacation of easement/replat matter will go before the Plan- ning and zoning Hoard at the November 4th meeting. Since there r, are no controversial issues involved in this replat and only the f vacation of the (temporary) water and sewer easement, I would hope the two matters could be acted upon at the November 26th City Commission meeting.
