HomeMy WebLinkAboutR-85-1114A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY JACQUELINE GUIGNARD, FIVE THOUSAND FIVE HUNDRED DOLLARS ($59500.00)9 WITHOUT THE ADMISSION OF LIABILITY, IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY, PERSONAL INJURY PROTECTION LIENS, WORKERS' COMPENSATION LIENS, CLAIMS AND DEMANDS AGAINST THE CITY OF M IAM I, UPON EXECUTION OF A RELEASE RELEASING THE CITY OF M IAM I FROM ALL CLAIMS AND DEMANDS. WHEREAS, Jacqueline Guignard, a single individual, filed a claim against the City of Miami, through her attorney Stephan H. Tarr for alleged bodily injury resulting from a motor vehicle accident wherein Jacqueline Guignard was a passenger in a motor vehicle involved in a collision with a City of Miami Police Department vehicle on August 25, 1983, at Northwest 2nd Avenue and Northwest 27th Street, Miami, Dade County, Florida; and t WHEREAS, the above claim has been investigated by the Risk Management Division in accordance with Ordinance No. 8417, which k created the City of Miami's Self -Insurance Program, and the said Division, together with the City Attorney, recommend that this claim be settled, without the admission of liability, for the sum of Five Thousand Five Hundred, Dollars ($5,500.00); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF M IAM I, FLORIDA; Section 1. The Director of Finance is hereby authorized to pay to Jacqueline Guignard the sum of Five Thousand Five Hundred ($5,500.00), without the admission of liability, in full and complete settlement of all bodily injury, personal injury protection liens, workers' compensation liens, claims and demands against the City of Miami, upon the execution of a release releasing the City of Miami from all bodily injury, personal injury protection liens, workers' compensation liens and claims and demands. Vance D/L: 08-25-83 REFERENCES L/L: N.W. 27 St. near N.W. 1st Ave, Miami, Florida ENCLOSURES, Jacqueline Guignard, a single individual by and through her attorney, filed a claim against the City of Miami, alleging bodily injury. The claim arose as a result of an automobile accident between a car in which Ms. Guignard w.as a passenger and a City of Miami Police vehicle. The accident occurred on August 25, 1983 on N.W. 27th Street near N.W. 1st Avenue, Miami, Florida. The police vehicle was involved in a chase eastbound on N.W. 27th Street, traveling in the 100 block. The vehicle in which Ms. Guignard was a passenger was stopped, headed west when its front end was struck by the front end of the police vehicle proceeding in the opposite direction. The injuries to the claimant have been diagnosed as occipital cephalalgia, cervical, and dorsal spine sprain, left shoulder sprain, right arm contusion, sprain of the right middle finger and a stress syndrome. It should be noted that this individual was three months pregnant at the time of this accident, however there were no complications attributable to the accident. There is a permanent partial disability of 6% to the body as whole. The total medical expenses are $2,047.00. These expenses have been verified as correct. The above claim has been investigated by the Risk Management Division in accordance with Ordinance 8417, which created the City of Miami Self -Insurance Program, and said division, together with this office recommend that this claim be settled without the admission of liability, for the sum of five thousand five hundred ($5,500).
