HomeMy WebLinkAboutR-85-1113x :; as i i i J-85-1055 RESOLUTION i.._ A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY BENITO DENIS, FIVE THOUSAND DOLLARS ($5,000.00), WITHOUT THE ADMISSION OF LIABILITY, IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY, PERSONAL INJURY PROTECTION LIENS, WORKERS' COMPENSATION LIENS, CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, UPON EXECUTION OF A RELEASE RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Benito Denis, a single individual, filed a claim against the City of Miami, through his attorney Stephan H. Tarr for alleged bodily injury resulting from a motor vehicle accident wherein Benito Denis was a driver in a motor vehicle involved in a collision with a City of Miami Police Department vehicle on August 25, 1983, at Northwest 2nd Avenue and Northwest 27th Street, Miami, Dade County, Florida; and WHEREAS, the above claim has been investigated by the Risk Management Division in accordance with Ordinance No. 8417, which created the City of Miami's Self -Insurance Program, and the said Division, together with the City Attorney, recommend that this claim be settled, without the admission of liability, for the sum of Five Thousand, Dollars ($5,000.00); } NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY l OF MIAMI, FLORIDA; Section 1. S Benito Denis, a single individual, through his attorney, filed a claim against the City of Miami, alleging bodily injury and property damage. The claim arose as a result of an automobile accident between a car in which Mr. Denis was the driver and a City of Miami Police vehicle. The accident occurred on August 25, 1983 on N.W. 27th Street near N.W. 1st Avenue, Miami, Florida. The police vehicle was involved in a chase eastbound on N.W. 27th Street, traveling in the 100 block. The vehicle in which Mr. Denis was a driver was stopped, headed west when its front end was �- struck by the front end of the police vehicle proceeding in the opposite direction. The claimant vehicle, a 1978 Chervolet Impala, 4-door Sedan was repaired by State Farm Insurance Company using a collision coverage with a deductible. The injuries to the claimant have been diagnosed as post traumatic cepha1aIgia, cervical and dorsal sprain, chest trauma, left rib contusion, and stress syndrome. Permanency rating is 5 to 7 percent to the body as whole. The total medical expense is $2,541.00. All medical expenses and other items of damage have been verified as correct. The above claim has been investigated by the Risk Management Division in accordance with Ordinance 8417, which created the City of Miami Self -Insurance Program, and said division, together with this office recommend that this claim be settled without the admission of liability, for the sum of five thousand ($5,000). i LAD/PDW/vj
