WHEREAS, the Miami Planni.nq Advisory Boar:1 .at its meeting of September 18, 1985, Item No. 2, following an advertised hearing, adopted Resolution No. PAB 54-85, by a 5 to 0 vote, RECOMMENDTNG APPROVAL, with modiEications, of. amending Ordinance No. 9500, as amended, as hereinafter set forth; and WHEREAS, the City Commission, after consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant these amendments, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, the Zoninq Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said ordinance as Follows -I ARTICLE 20. GENERAL AND SUPPLEMENTARY REGULATIONS. 2013.7. Definitions and Clan>,i.fi.eations Relating to windows and Walls. 2013.7.2. Primary Windows. Primary windows are principal window, and/or transparent doors in habitable rooms except bedrooms and kitchens. Where such habitable rooms involve more than one (1) exposure, the primary windows shall be construed as those in the wall containing the largest window and/or transparent door area, and the remaining windows and/or transparent doors shall be construed as secondary windows. 2013.7.4. Secondary Windows. Secondary Windows are windows and/or_ transparent doors of habitable rooms other than primary windows, as defined above. ARTICLE 36. DEFINITIONS Section 3600. General. Rescue Mission A Rescue Mission is a facility which provides overnight, dormitory -style, shelter (with or without food service provisions) to those persons lacking residences, ossessions or resources. BACKGROUND The Planning Department proposes Amendment "P" that addresses certain of sections in Zoning Ordinance 9500 that require attention and revision. These changes have been discussed with other departments for several months. PAB 9/18/85 Item #2 Page 1 ANALYSIS Amendment "P" would accomplish the following clarifications: 1. Transparent doors (or sliding glass doors) would now be considered as windows for the purposes of building spacing. 2. A definition of Rescue Mission would be provided. Rescue Missions would be permitted in CG districts with a special permit. 3. Video tape sales and rentals would be permitted in CR-1. 4. Driving School agencies would be permitted in CR -2. 5. Astrologists, fortune tellers, and phrenologists would be permitted in CG-1. 6. Design review would be required for new development in CBD-1 (downtown) through a Class C Special 7ermit and the height limit of 300 feet would be removed. 7. Car care services would no longer be prohibited in the downtown area, nor would wholesale jewelers and custom-made jewelery operations provided that they are incidental to retail activities. RECOMMENDATIONS PLANNING DEPT. APPROVAL PLANNING ADVISORY At its meeting of September 18, 1985, the Planning BOARD Advisory Board adopted Resolution PAB 54-85 by a 5 to 0 vote, recommending approval, as amended, of the above.
