ORDINANCE N0. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY 267

FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN)
FROM RS-2/2 ONO, FAMILY DETACHED RESIDENTIAL
TO CR-2/7 COMMERCIAL RESIDENTIAL (COMMUNITY)
MAKING FINDINGS; AND BY MAKING ALL THE
NECESSARY CHANGES ON PAGE NO. 37 OF SAID
ZONING ATLAS MADE A PART OF ORDINANCE NO.
9500 BY REFERENCE AND DESCRIPTION IN ARTICLE
3, SECTION 300, THEREOF; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of July 15,
1985, Item No. ll, following an advertised hearing, adopted.
Resolution No. ZB 100-85, by a 7 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 267
Southwest 18th Road and approximately 1768-1776 Southwest 2nd
Court, Miami, Florida, also referred to as UNPLATTED, and Lot 13
less right-of-way for Interstate 95, Block 17, HOLLEMAN PARK
(8-23) of the Public Records of Dade County, Florida, for which
area a complete legal description is attached hereto as Exhibit
"A," from RS-2/2 One —Family Detached Residential to CR-2/7
Commercial -Residential (Community).
Section 2. it is hereby found that this zoning classifi-
cation change.
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) 15 not out of scale with the needs of the neighborhood
or the City;
(e') Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schoolsi utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 37 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 31
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

RECOMMENDATIONS
PLANNING DEPARTMENT DENIAL. The proposed change is not in accord
with he Miami Comprehensive Plan and the ,land
use characteristics of the area. The granting
of the petitioned change of zoning would
unnecessarily extend commercial zoning into a
relatively viable residential area. A
commercial classification for the subject
property is inappropriate due to 'potential
traffic interference of in and out activity
associated with general commercial zoning. An
increase in intensity would likewise impact the
adjacent residential neighborhood.
The subject property with its present zoning
district designation has transitional rights
that are responsive to the low density character
of the adjacent residential area,
PUBLIC 'WORKS The rezoning of this property will not cause a
sanitary sewer overload, but if this rezoning
,continues along the Coral Way corridor, the
sanitary sewer system will not have sufficient

Dear Mr. Perez-Lugones:
REPLY TO: MIAMI OFFICE
This Letter of Intent accompanies the enclosed application
for an amendment to the City of Miami Zoning Atlas from RS-2/2 to
CR-2/7. The property that is the subject of this application
consists of approximately .4462 acres and is located on the
northeasterly corner of S.W. 2nd Court and 18th Road. Abutting
the property to the north is a parcel of land zoned CR-2/7; to
the east and southeast is the North -South Expressway; to the west
and southwest are S.W. 18th Road and S.W. 2nd Court; further west
is property zoned RS-2/2.
The present zoning classification of RS-2/2 is inappropriate
because the property is not suitable for residential habitation
primarily because of its proximity to the North -South Expressway
with its accompanying noise and air pollution, in addition,
other factors associated with the commerical uses to the north
including pedestrian and automobile traffic and automobile
parking have made residential use of the property unattractive.
In short, the property has lost its residential nature,

The proposed zone change is•appropriate for a variety of
reasons. Most importantly, the surrounding right-of-ways provide
a natural buffer which will protect the nearby residential areas
from the commercial uses on the property. in addition, the sub-
ject property has a number of characteristics which make it suit-
able for commercial use including: direct access to the main
thoroughfare of Southwest Third Avenue; sufficient size to accom-
modate on -site parking; close proximity to commercial property.
Finally, this request for a zone change does not represent the
beginning of an invasion into an established residential area.
As this Letter points out, the subject property is unique. No
other expansion into the neighboring residential area would be
justifiable.
Over time, the property has evolved into a commercial
parcel. This requested zone change will merely be the realiza-
tion of this established fact. We therefore urge your favorable
recommendation.
