AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF THE FUNDS FOR SAID PURPOSE. Background of Item: American Rescue Plan Act establishes four categories of eligible uses and further restrictions on the use of COVID 19 State & Local Fiscal Recovery Funds (SLFRF) to ensure that funding is utilized within the four eligible use categories. Revenue Replacement is one category. Revenue Replacement is the replacement of lost public sector revenue, using this funding to provide government services up to the amount of revenue lost due to the pandemic. The US Treasury Final Rule (31 CFR Part 35 RI 1505-AC77) offers a standard allowance for revenue loss of up to $10 million, not to exceed a recipient's SLFRF award amount, allowing recipients to select between a standard amount of revenue loss or complete a full revenue loss calculation. Recipients that select the standard allowance may use that amount for government services. The City previously elected to use the full revenue loss formula. The resulting calculations were $69,659,199 for fiscal 2020, and $93,989,727 for fiscal year 2021. The ARPA SLFRF program awarded the City of Miami with $137,639,417 to respond to the economic and public health impacts of COVID-19. As of today's date, the City's Recovery Plan categorized only $26,714,000 as Revenue Replacement.
