By way of background, there is a prohibition upon possession or consumption of alcoholic beverages in all city parks except that with certain limitations, sale and consumption of beer and wine may take place in Bicentennial and Bayfront Parks Mode Section 38-49). purther, in April, 1984, the City Commission adopted Ordinance No. 9818 (see attached pertinent provisions) which authorizes the Commission to permit the dispensing of beer and wine in any city park. It is this latter authority which is sought to be delegated to you and we will need guidelines, standards or criteria in any ordinance which delegates this authority. In order to provide timely information for the City Commission should the subject be discussed at the December 19, 1985 Commission meeting, we are also furnishing a copy hereof to each Commissioner. PRESCRIBE6 WHEREAS; the City of Miami encourages and supports the A use of City Parke for recreational events by the convention Industry as well as eivie-minded organizational and WHEREAS, it is appropriate on special occasions and in conjunction with special events or programs that the dispensing of win* or beer be authorized in City Parks; NOWT THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDAt Section 1. Notwithstanding any provision in the City Code of the City of Miami, Florida, to the contrary, the City Commission, on special occasions and for special events or programs, may permit by resolution the dispensing of wine or beer in -soft containers in any City Park. Such resolution shall establish any special conditions which shall apply to said dispensing which shall be cumulative and in addition to all other conditions imposed by state and local laws and regulations. Section 2.
