The City Clerk is receiving a copy so that she will be aware of what has occurred since the Packet was distributed. ITEM 'C' (Manager's authority to approve beer and wine in city parks) A memorandum is forthcoming from the Police Department with respect to its concern that there be consideration given to a requirement that adequate .security measures be included in the conditions precedent to the City Manager's proposed exercise of authority to grant permission to sell and /or dispense beer and wine in city parks. Chief Dickson has indicated that he would prefer that the City Commission continue, at least temporarily, to monitor the grant of permission in this area of regulated activity until his department has conducted an in -depth study of the matter. The subject of appropriate indemnity provisions and/or liability insurance protection also has been discussed with that department. I have been informed by the Division of Risk Management that the City presently requires that users of city facilities (other than parks) must provide liability insurance coverage protecting the city in the amount of $300,000. At the December 15th City Manager's Staff Meeting, Carl Kern, Parks Director, was also asked to provide input from his department on this item; he has indicated that such input will be presented at tomorrow's meeting. ITEM 'E' (Publication of city advertisements in newspapers) A resolution has been prepared, if needed, in connection with discussion of newspapers in which city advertisements have appeared. Names of newspapers have not been listed since this selection will be made by the City Commission. Lucia A :ghefty, City Attorney CeceThb r 19, 1999 Page 2 Rea December 19 Commission Agenda t' NI 'M' (Mousing units off -site selection and approval /Ciaughton is RFC:bss:293:P038 A resolution has been prepared, if needed, in connection with this item approving trio of throe housing sites that have been submitted by the developers. ,ITEM_t30, (Minority Procurement Ordinance) This item has been adopted on first reading and has been distributed in a form which mandates creation of an "Office of Minority and Women Business Affairs and Procurement ". Specific City Commission aopr-oval should be obtained for this title and text language (as distributed) which conditions the mandatory creation upon the City Manager's utilization of existing resources. We have also added a provision that existing procurement code provisions shall e superseded by the provisions of this Item to the extent of its conflict with existing procurement code provisions. This additional provision language should be placed on record before roll call vote. ITEM #35 (.False Fire Alarms) The proposed ordinance which was distributed in the Agenda Packet is being Modified by the Fire Marshall using a different fee schedule and the modified version will be presented at tomorrow's meeting. The definition of "false alarm" has also been changed. ITEM #39 (WASA Agreement) The proposed agreement which was distributed in the Agenda Packet has been modified and the final draft (as modified) will be distributed at the Commission Meeting tomorrow. cc: City Clerk K
