THURSDAY, FEBRUARY 27, 1986, AS THE DATE FOR A PUBLIC HEARING CONCERNING AMENDMENTS TO AN EXISTING DEVELOPMENT ORDER FOR THE MIAMI CENTER I PROJECT; A DEVELOPMENT OF REGIONAL IMPACT LOCATED AT 100 CHOPIN PLAZA, AND DIRECTING THE CITY CLERK TO NOTIFY APPROPRIATE AGENCIES. WHEREAS, the Commission issued a Development Order for the Miami Center I project by Resolution 79- 396, May 24, 1979; and WHEREAS, the Commission approved an Amendment to the Development Order which requires agreement on interim traffic improvements prior to the issuance of a certificate of occupancy and found that such amendment did not constitute a substantial deviation, by Resolution 80-707, September 25, 1980; and WHEREAS, Chapter 380.06 (19), Florida Statutes, provides that any proposed change to a previously approved development which creates a reasonable likehood of additional regional impact not previously reviewed by the regional planning agency does constitute a substantial deviation and is subject to further Development of Regional Impact review; and WHEREAS, Chapter 380.06, Florida Statutes, requires local government to establish a date certain, and give public notice for a local public hearing for an amendment to a Development of Regional Imapact; and WHEREAS, by letter, the South Florida Regional Planning Council has notified the City of Miami that the amended Application for Development Approval contains sufficient information for their review and that a local public hearing could be scheduled for proposed amendments to the Miami Center I project, a Development of Regional Impact, to be located at 100 Chopin Plaza; and WHEREAS, Chapter 380.06 Florida Statutes requires local government to set a public hearing date at Its next scheduled meeting after the receipt of such a letter and to give at least sixty (60) days notice of the hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A public hearing shall be held at 3:30 PM, Thursday, February 27, 1986, or at a reconvened meeting, in City Commission Chambers, 3500 Pan American Drive, Miami, Florida, 33133, concerning issuance of an amended Development Order for the Miami Center I project, a Development of Regional Impact, to be located at 100 Chopin Plaza. The City Clerk is hereby authorized and directed to immediately send certified copies of this Resolution to the Florida Department of Community Affairs, Division of Resource Planning and Management, 2571 Executive Center Circle East, Tallahassee, Florida, 32301; and to the South Florida Regional Planning Council, 3440 Hollywood Boulevard, Suite 140, Hollywood, Florida 33021; and to Ethan Minsky, Shea and Gould, 1401 Brickell Avenue, Miami, Florida 33131. Per Chapter 380.06 F.S., local government is required to set a date certain and to give public notice 60 days in advance of a required public hearing on an Application for Development Approval for a Development of Regional Impact, prior to issuing a Development Order. By letter (attached) the South Florida Regional Planning Council stated that Application for Development Approval for amendments to the Miami Center I Development Order contained sufficient information for their review and would be tentatively scheduled on the Council agenda of February 3, 1986. Further, the letter stated that the Development of Regional Impact public hearing must be set at the next scheduled meeting of the Commission and advertised at least 60 days in advance of the hearing, per Chapter 380.06 F.S. It is requested that the Commission establish February 27, 1986, as the Development of Regional Impact public hearing date for consideration of amendments to the Miami Center I Development Order, which would allow for the required 60 day public notice.
