A RESOLUTION APPROVING REVISIONS DATED JULY
7TH, 1985, TO THE SOUTHEAST 0VERTOWN/PARK
WEST COMMUNITY REDEVELOPMENT PLAN DATED
DECEMBER, 1982 FOR THE AREA ROUNDED BY
BISCAYNE BOULEVARD, NORTHEAST/NORTHWEST 5TH
STREET, INTERSTATE 95 A11D INTERSTATE 395.
WHEREAS, it is necessary to amend the land use and land
acquisition elements of the 1992 Southeast Overtown/Park West
Community Redevelopment Plan in order to conform to the approved
Phase I Redevelopment Program (City Commission Resolution No. 83-
972 and County Commission Resolution No. R-1006-84); and
WHEREAS, all of. the proposed changes are in general
conformance with the Miami Comprehensive Neighborhood Development
Masterplan (MCNP) 1976 through 1986; and
WHEREAS, all the proposed changes are consistent with the
goals and objectives of the Southeast Overtown/Park West
Community Redevelopment Plan; and
WHEREAS, the proposed changes are needed to accommodate
development of a sports arena/coliseum, development of pedestrian
malls, removal of interior block pedestrian malls and
simplification of commercial/residential land use mixes; and
WHEREAS, the Miami Planning Advisory Board, at its meeting
of September 4, 1985, Item No. 3, following an advertised
hearing, adopted Resolution No. PAB 51-85 by an 8 to 0 vote,
recommending approval of amending the Southeast Overtown/Park
West Community Redevelopment Plan as hereinafter set forth; and
WHEREAS, the City Commission, after consideration of this
matter, deems it advisable and in the best interest of the
general welfare of the City of Miami to amend the Southeast
Overtown/Park West Community Redevelopment Plan as set out
herein;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

The Planning Advisory Board, at its meeting of September 4, 1985, Item 3,
following an advertised hearing, adopted Resolution PAB 51-85 by an 8 to 0
vote, recommending approval of amending the Land Use and Land Acquisition
Elements of the 1982 Redevelopment Plan in order to conform to the approved
Phase I Redevelopment Program (City Commission Resolution No. 83-972 and
County Commission Resolution No. R-1006-84), in general conformance with the
Miami Comprehensive Neighborhood Development Master Plan (MCNP) 1976-1986, and
consistent with the goals and objectives of the Southeast Overtown/Park West
Community Redevelopment Plan, said amendments to include changing the area
bounded by NW 1 Avenue, North Miami Avenue, NW 8 Street and NW 6 Street, also
described as all of Blocks 44 and •57, MIAMI (8-41), from mixed
residential/commercial to public facility in order to accommodate the
development of a 16,000 seat sports. arena/colosseum; a change of the public
right-of-way along NW 9 Street from North Miami Avenue to NW 3 Avenue to Parks
Open Space and the public right-of-way along NW 7 Street from NW 1 Court to NW
3 Avenue in order to accommodate the development of a pedestrian mall;
removing interior block pedestrian malls and simplification of
commercial/residential land use mix for the area generally bounded by North
Miami Avenue, NW 2 Avenue, NW 6 Street and NW 10 Street and amending the Land
Acquisition Element to include frontage on NW 2 Avenue on Block 36 (Parcel 30)
and the block bounded by NW 7 Street, NW 8 Street, NW 1 Avenue and North Miami
Avenue (Parcel 29).
Backup information is included for your review.
A RESOLUTION to provide for the above has been prepared by the City Attorney's
Office and submitted for consideration of the City Commission.

PETITION 3. Amendment to the Southeast Overtown/Park West
Community Redevelopment Plan, area bounded by
Biscayne Boulevard, NE/NW 5th Street, I-95 and
I-395.
REQUEST To modify the Southeast Overtown/Park West
Community Redevelopment Plan adopted in 1982,
City Commission Resolution No. 82-755, to amend
the Land Acquisition and Land Use Elements of
the Redevelopment Plan.
BACKGROUND
The general redevelopment concept for the
Southeast Overtown/Park West Commpnity
Redevelopment Project area is to provide a
wide range of housing opportunities within
a downtown setting, including support uses
necessary to serve the area's future
population. During the next ten to
fifteen years, this area will be
transformed from a neighborhood of
blighted and marginal residential and
commercial land uses into an integral
component of downtown Mi anii . As Miami has
rapidly become an international center for
finance and trade, the downtown area
has experienced new growth and vitality.
Projections call for a doubling of the
employee population by the end of the
century from 72,000 employees to 155,000
employees, primarily due to a continued
strong expansion of the office market.
The new downtown that is emerging will be
a balanced community with retail, office,
cultural, recreational, and residential
activities. The Southeast Overtown/Park
West Project area will provide the
resource for residential development
within the downtown core area, an
essential ingredient for the establishment
of a viable downtown which moves beyond
the 9-to-5 routine.

By the end of this century the project
area is envisioned to have the capability
of supporting over 9,000 new residential
j units, and over 1,000,000 sq.ft. of
commercial development. The area will
have an estimated population of 22,000
people according to a recently completed
' market analysis by the nationally renowned
firm of Hammer, Si 1 er, .George Associates.
The project, particularly the initial
phase, will be coordinated and built in
such a manner as to create sufficient
critical mass to change perceptions about
j the project area and to support the
significant public investment program
required.
There are certain activities occurring
within and directly adjacent to, the
1 project which further reinforce its
development potential, including:
--the ongoing expansion of the Downtown
Government Center which will have an
employee population of over 15,000 when
completed;
i --the construction of the Overtown Transit
Station within the project area, which
will be one of only three serving the
Downtown/Brickell area;
--the construction of the Downtown
Component of Metrorail (Metromover) which
will link major portions of the project
area directly to the rest of the downtown

core;
--the continued expansion of the Port of
Miami, which ranks as the world's largest
cruise port, serving in excess of
2,000,000 passengers annually;
--the scheduled and proposed redevelopment
of the adjacent bayfront park system which
provides a regional amenity;

--the proposed construction of the Bayside
Speciality Center at Mi amari na, to, be
developed by the Rouse Company, which will
generate over 6,000,000 visitors annually;
and
--the proposed expansion of the Omni -
Midtown commercial and residential node
located directly to the north and Fl agl er
Street core area located directly to the
south.
Government participation during Phase I of
this project will focus on public
investment adjacent to the Overtown
transit Station and along the 9th Street
Pedestrian Walkway. A nine -block Transit
Station Impact Area has been identified as
the location where public investment will
be concentrated. This area was selgcted
due to its strategic location adjacent to
the Overtown Transit Station and the
Downtown Government Center. Rede-
velopment within this area will maximize
benefits to both the Park West and
Overtown portions of the project area and
leverage previous capital improvement
expenditures plus committed public funds
(Urban Initiatives Project).
Proposed development for Phase I will be
geared for families with annual incomes
ranging from $15,000 to $50,000. A
mixture of homeownership and rental
housing is proposed to attract an ex-
panding downtown employee population.
Funding for Phase 1 redevelopment is
provided through a number of sources
including a grant from the Urban Mass
Transit Admi ni strati on, City of Mi ami
General Obligation Housing and Highway Im-
provement Bonds, and an anticipated loan
from the federal government through the
HUD Section 108 Loan Program.

Since 1982 when the Plan was approved by
the Ci ty of Mi ami and Dade County,
implementation of this project has moved
forth; the City in conjunction with Dade
County is completing the acquisition of
the remaining parcels in the Phase I
redevelopment area; residential relocation
is near completion and developers have
been selected for 9 parcels. Phase I
redevelopment will occur on a 28 acre
tract bounded irregularly by N.W. 3rd Ave,
N.W. loth Street, N.W. 6t Street, N.W. 7th
Street, N.W. 2nd Ave, and Worth Miami Ave.
Proposed redevelopment will include the
construction of 1900 residential units,
250,000 sq.ft. of commercial space and a
16,000 seat Arena. It is anticipated that
construction will begin early in 1986.
ANALYSIS It is necessary to amend the Land use,and
Land Acquisition Elements of the 1982
Redevelopment Plan in order to conform to
the approved Phase I Redevelopment Program
(City Commission Resolution No. 83-972 and
County Commission Resolution No. R-1006-
84). All of the proposed changes are in
general conformance with the Miami
Comprehensive Neighborhood Development
Master Plan (MCNP). 1976-1986 and
consistent with the goals and objectives
of the Southeast Overtown/Park West
Commun*i ty Redevelopment Plan.
Proposed Land use Element changes include:
I. The area bounded by N.W. 1st Ave., N.
Mi ami Ave. , N. W. 8th. St. , N. W. 6th Ste
from mixed residential/commercial to
public facility in order to accommodate
the development of a 16,000 seat Sports
Arena/Colosseum.'
2. The public right-of-way along N.W. 9th
St. from North Miami Ave to N.W. 3rd to
Parks Open space to accomodate the devel-
opment of a pedestrian mall.

St, from N.W. 1st Ct. to N.W. 3rd Ave. in
order to accommodate the development of a
pedestrian mall.

amended to include frontage on NW 2 Avenue

(Parcel 29). The intended reuse of parcel
12 and 29 will be for the Arena/Colosseum
(Public Facility). Parcel 29 is currently
occupied by 7 warehouse structures, the
majority of which are vacant. The overall

On behalf of our clients, BASHIR PANIRY and HELEN PANIRY, his
wife, who own property located at 666 North Miami Avenue, 668
North Miami Avenue, and 670 North Miami Avenue in the Southeast
Overtown/Park West Community Redevelopment Plan area, we object to
the zoning and plan amendment described above.
The proposed zoning and plan amendment constitutes an
exercise of control and dominion that denies to Bashir Paniry and
Helen Paniry, his wife, the use and enjoyment of their property
and property rights.
The use and permitting requirements of the Ordinance prohibit
and will prevent repair, improvement, or expansion of the property
of Bashir Paniry and Helen Paniry, his wife, located at 666 North
Miami Avenue, 668 North Miami Avenue, and 670 North Miami Avenue
consistent with such properties' present use and purposes. As
such, the Ordinance proposed is unreasonable and confiscatory
amounting to a taking of private property without due process of
law and payment of full compensation.
