S -1 30 A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT WITH THE UNITED STATES ARMY CORPS OF ENGINEERS CONVEYING A 400 FOOT BY 60 FOOT PORTION OF CITY -OWNED BAYFRONT PARK LYING BETWEEN BISCAYNE BOULEVARD AND THE PROPOSED CLAUDE AND MILDRED PEPPER FOUNTAIN, ADJACENT TO BISCAYNE BAY, TO THE UNITED STATES ARMY CORPS OF ENGINEERS FOR THE CONSTRUCTION OF A PROMENADE WITH SAID PROPERTY BEING LEASED BACK TO THE CITY OF MIAMI AT NO COST UPON COMPLETION OF THE PROJECT. WHEREAS, the redevelopment of City -owned Bayfront Park includes, a promenade extension of Flagler Street connecting from Biscayne Boulevard to Biscayne Bay at the proposed Mildred and Claude Pepper fountain, a major feature of the redevelopment; and WHEREAS, the United States Army Corps of Engineers, under its Code No. 710 Recreational Facilities Program has been authorized to construct the promenade; and WHEREAS, $952,000 has been appropriated in the U.S. Fiscal Year, 1985 Supplemental Appropriations Act for the cost of construction; and WHEREAS, the City proposes to convey the property required for the promenade to the United States Army Corps of Engineers; and WHEREAS, the property will be leased back to the City upon completion of the promenade for public use; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to negotiate an agreement with the United States Army Corps of Engineers conveying a 400 foot by 60 foot portion of City -owned Bayfront Park lying between Biscayne Boulevard and the proposed Claude and Mildred Pepper Fountain, adjacent to Biscayne Bay, to the United States Army Corps of Engineers for the construction of a promenade with said property being leased back to the City of Miami at no cost upon completion of the Project. O d i o REFERENCES: City Manager For City Commission Meeting of December 19, 1985 ENCLOSURES; It is recommended that the City Commission adopt the attached resolution, authorizing the City Manager to negotiate an agreement with the United States Army Corps of Engineers conveying a 400 foot by 60 foot portion of City —owned Bayfront Park lying between Biscayne Boulevard and the proposed Claude and Mildred Pepper fountain, adjacent to Biscayne Bay, to the United States Army Corps of Engineers for the ' construction of a promenade with said property being leased back to the City of Miami at no cost upon completion of the project. The redevelopment of Bayfront Park is being accomplished in part by a shoreline enhancement project of the U.S. Corps of Engineers. The C.O.E. project includes a 2.06 acre expansion of the park by filling a portion of Biscayne Bay and the construction of new and replacement seawall, riprap and the construction of a bay walk and a portion of a major fountain, the focal point of the redevelopment, to be named in honor of Claude and Mildred Pepper. The City has deeded the land area of the project to the C.O.E. and in turn the C.O.E. is constructing the project at a cost of $6,200,000. { The Pepper fountain is located on axis with Flagler Street at the water edge of Biscayne Bay. The C.O.E. has been authorized to expand their project to include a "promenade" connection between the Pepper fountain and Biscayne Boulevard with $952,000 additional funds in current appropriations. 4 ',1';1- N-S, 8 ;-1230 lb I* Honorable Mayor and Members of the City Commission In order to move forward with this additional work, it is necessary to enter into a similar agreement with the C.O.E. whereby the City deeds the land area to the C.O.E. upon which they will construct the project and upon completion, lease back the property to the City at no cost. It is recommended that the Commission adopt the attached resolution authorizing the City Manager to negotiate the agreement of conveyance and lease back. CHO/JEG/mim 855-1230
