HomeMy WebLinkAboutR-85-1222i f J-85-1203 12/06/85 RESOLUTION NO. 85*-1222 A RESOLUTION AUTHORIZING AN INCREASE IN CONTRACT AMOUNT OF $40,000 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND FRE CONSTRUCTION COMPANY DATED DECEMBER 18, 1984, FOR THE CONSTRUCTION OF EAST LITTLE HAVANA HIGHWAY IMPROVEMENT - PHASE I, SECOND BIDDING, BIDS C AND D, SAID FUNDS TO BE PROVIDED FROM MONEY ALREADY ALLOCATED TO THE EAST LITTLE HAVANA HIGHWAY IMPROVEMENT PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated December 18, 1984, between the City of Miami, Florida and FRE Construction Company for the construction of East Little Havana Highway Improvement - Phase I, Second Bidding, Bids C and D; and WHEREAS, an increase in contract of $40,000 is required to cover the additional cost of extra work caused by unforeseen conditions encountered during construction; and WHEREAS, the City Manager has made a written finding that a valid emergency exists for the work to be done; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional cost; and WHEREAS, funds to cover the increase are available from money already allocated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the preamble of this Resolution are hereby adopted and ratified by an affirmative vote of four -fifths (4/5's) of the members of this Commission. Odlo REFERENCES: City Manager ENCLOSURES: Resolution (For Commission Meeting of December 19, 1985) It is recommended that a resolution be adopted authorizing an increase in contract amount of $40,000 in the contract between the City of Miami, Florida and FRE Construction Company for the construction of East Little Havana Highway Improvement - Phase I, 2nd Bidding, s Bids C and D; said funds to be provided from monies already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of two-thirds of the members of the City Commission, and adopting the findings and f conclusions set forth in the preamble of this a resolution. j When the Public Works Department initiated the East Little Havana Highway Improvement project, the decision was made to split the work into six separate bids in an attempt to attract small minor- ity contractors as bidders. When the work was split into the separate bids, the cash allowance that the Public Works Department anticipated would be necessary to cover unforeseen conditions was also split to correspond to the six separate bids. The six separate bids were ultimately awarded to four separate contractors. The work covered by four of the bids and three of the contractors has been completed. The only work remaining under construction presently is that covered by Bids C and D being done by FRE Construction Company. During the construction of their work, particularly on S.W. 4 Avenue and on S.W. South River Drive, they have encountered many unforeseen underground obstructions such as sanitary and storm sewer manholes, and junction boxes that needed to be removed to update both the storm sewer and sanitary sewer systems. Additionally, FRE Construction Company will be required to make more adjustments on private property than any of the other contractors had to make on their portions of the work. It is our estimate that this additional work will require an increase in contract amount of $40,000 in the contract with FRE Construction Company. SS-1222 1, Honorable Mayor and - 2 - Members of the City Commission Funds to cover the requested increase are available from unused cash allowances from the other previously mentioned contracts, and thus no increase in appropriation for the project will be necessary, merely a transfer of funds internally. Odio Vv�, OATS: December 12, 1985 PlLt: B-4487 CAD SUsJECT: EAST LITTLE HAVANA HIGHWAY IMP. - PH I (Bid CAD) Emergency Need for Increase REFERENCES: in Contract Amount City Manager ENCLOSURES: (For Commission Meeting of December 19, 1985) Based on information supplied to me by the Director of the Public Works Department, I have found there exists an emergency need for an increase in contract amount of $40,000.00 in the contract between the City of Miami, Florida and FRE Construction Company, for the construction of East Little Havana Highway Improvement - Phase I (Bids C A 0). The reason for the emergency need is as follows: The contractor on the work covered by Bids "C" and "D" encountered many underground obstructions to his work in the vicinity of S. W. 4th Avenue and S. W. South River Drive and an inordinate amount of extra work was required. The cost of the extra work has exceeded the cash allowance for Bids "C" A "D" but it is necessary to proceed with the work for the safety and welfare of the citizens in the area and the general public.
