RESOLUTION
A RESOLUTION AUTHORIZING AN INCREASE IN
THE CONTRACT AMOUNT OF $11,481.42 IN THE
CONTRACT BETWEEN THE CITY OF MIAMI,
FLORIDA AND F & L CONSTRUCTION, INC.
DATED MARCH 15, 1985 FOR THE CONSTRUCTION
OF CURTIS PARK ELDERLY MEALS FACILITY,
SAID FUNDS TO BE PROVIDED FROM FEDERAL
JOBS BILL FUNDS AND COMMUNITY DEVELOPMENT
BLOCK GRANT 8TH YEAR CONTINGENCY FUNDS
ALREADY ALLOCATED TO THE PROJECT; FURTHER
RATIFYING THE CITY MANAGER'S WRITTEN
r. FINDING THAT THE HEREIN INCREASE RESULTED
FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF TWO-THIRDS OF THE
MEMBERS OF THE CITY COMMISSION, AND
ADOPTING THE FINDINGS AND CONCLUSIONS SET

t FURTHER ACCEPTING THE COMPLETED WORK OF F
& L CONSTRUCTION, INC. AT A TOTAL COST OF
$477,806.42; AND AUTHORIZING A FINAL
PAYMENT OF $23,139.54.
WHEREAS, the exist a contract dated March 15, 1985
between the City of Miami, Florida and F & L Construction, Inc.
for the construction of Curtis Park Elderly Meals Facility; and
WHEREAS, an increase in contract of $11,481.42 is
required to cover the cost of additional landscaping and art work
ordered during the final phase of construction of the project;
and
WHEREAS, the City Manager has made a written finding
that a valid emergency existed for the work to be done; and
WHEREAS, the Directors of the Departments of Community
Development and Public Works recommend the increase in contract
to cover the additional costs, and
WHEREAS, funds to cover the increase are available from
money already allocated to the project; and
WHEREAS, all of the work included in the contract and
the proposed increase in contract has been satisfactorily
completed by F & L Construction, Inc. and they have furnished the
required documents certifying that all bills for labor and
materials have been paid in full in connection with the aforesaid

WHEREAS, the City Manager and the Directors of the
Department of Community Development and Public Works recommend
acceptance of the completed work and authorization of final
payment to the contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. After a properly advertised public hearing,
the finding of the City Manager set forth in the preamble to this
resolution is hereby ratified by an affirmative vote of two-
thirds of the City Commission, and adopted as if fully set forth
in this section.
Section 2. The contract between the City of Miami,
Florida and F & L Construction, Inc. for the construction of
Curtis Park Elderly Meals Facility dated March 15, 1985 is hereby
increased by $11,481.42, with funds for the increase to be
provided from monies already allocated to the project.
Section 3. The completed work performed by F & L
Construction, Inc. for Curtis Park Elderly Meals Facility is
hereby accepted at a total cost of $477,806.42.
Section 4. The proper officials of the City of Miami are
hereby authorized to pay F & L Construction, Inc. a balance of
$23,139.54 as full and final payment for all work performed and
all materials furnished in connection with the aforesaid
contract.

It is recommended that a resolution be adopted
authorizing an increase in contract amount of
$11,481.42 in the contract between the City of
Miami, Florida and F & L Construction Company,
Inc. for the construction of Curtis Park Elderly
Meals Facility; said funds to be provided from
Federal Jobs Bill Funds and Community
Development Block Grant 8th Year Contingency
Funds already allocated to the project; further
ratifying the City Manager's written finding
that the herein increase resulted from emergency
circumstances by an affirmative vote of two-
thirds of the members of the City Commission and
adopting the finding and conclusions set forth
in the preamble of this resolution; further
accepting the completed work of F b L
Construction Company, Inc., at a total cost of
$477,806.42; and authorizing a final payment of
$23,139.54.
During the final stages of construction of the Curtis Park
Elderly Meals Facility by F & L Construction Company, Inc.,
under a contract dated March 15, 1985, the Department of
Public Works determined that funds were available within the
original allocation for the project of Federal Jobs Bill
Funds and Community Development Block Grant 8th Year
Contingency Funds, to add back into the project landscaping
that had been deleted for economic reasons before bids were
received; and to cover the additional expense of the
placement of art work. In order not to delay the completion
of the critically needed building, the contractor was
authorized to proceed with the additional work. It will be
necessary to authorize an increase in contract of $11,481.42
to cover the work mentioned above.

As required by City ordinances, an increase of $10,000 or
more in a City contract must be accompanied by a finding by
the City Manager that the increase resulted from emergency
circumstances, and such a finding has been prepared and
signed. It is further required that a Public Hearing be
held, and the Public Hearing has been scheduled.
The contractor on the project has satisfactorily completed
all of the work included in the original contract, and the
work covered by the proposed increase in contract, at a
total cost of $477,806.42, which includes the requested
$11,481.42 increase in contract.

Based on information supplied to me by the Director of the
Public Works Department-, I have found there exists an
emergency need for an increase in contract amount of
$11,481.42 in the contract between the City of Miami,
Florida and F b L Construction, Inc., for the construction
of Curtis Park Elderly Meals Facility.
The reason for the emergency need is as follows:
During the final.stages of construction we became aware that
funds remained in the original allocation Federal Jobs Bill
Funds and Community Development Block Grant 8th Year
Contingency Funds for the project to add back into the
project landscaping that had previously taken out for
economy reasons. Additionally, funds were available for
additional desired art work. If these funds had not been
expended on the project they would have been lost to the
City.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the
City of Miami, Florida on Thursday, December 19, 1985, at
11:30 A.M. in the City Commission Chambers at City Hall,
3500 Pan American Drive, Miami, Florida, for the purpose of
considering the ratification by the City Commission of the
waiver of the requirement of obtaining sealed competitive bids
for increases in the contract cost for the following designated
public works or improvements:
CURTIS PARK ELDERLY MEALS FACILITY
An increase of $11,481.42 in the contract with
F & L Construction, Inc. to cover the cost of
the additional landscaping and art work.
All interested persons are invited to appear and may be
heard concerning such proposed waivers and increases.
Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this
hearing, that person shall ensure that a verbatim record of
the proceedings is made, including all testimony and evidence
upon which any appeal may be based.
