RESOLUTION NO.
A RESOLUTION ACCEPTING THE COMPLETED WORK
OF FRE CONSTRUCTION CO., INC. AT A TOTAL
COST OF $737,814.51 FOR ALLAPATTAH
INDUSTRIAL AREA HIGHWAY IMPROVEMENT -
PHASE I BIDS "A, B, C"; ASSESSING
$5,000.00 AS LIQUIDATED DAMAGES FOR 10
DAYS OVERRUN OF CONTRACT TIME; AND
AUTHORIZING A FINAL PAYMENT OF $84,699.16.
WHEREAS, there exists a contract dated December 8, 1983
between the City of Miami and FRE Construction Co., Inc.;
and
WHEREAS, the work, has been satisfactorily completed,
and FRE Construction Co., Inc., has furnished the required
documents certifying that all bills for labor and materials
have been paid in full in connection with the aforesaid
contract; and
WHEREAS, liquidated damages for overrun of contract
time of 10 days should be deducted from the final payment
due the contractor and the surety; and
WHEREAS, the,City Manager and the Department of Public
Works recommend that the completed work be accepted and
final payment made to the contractor; and
WHEREAS, after a duly advertised public hearing held on
December 19, 1985, to hear objections by persons interested
in or affected by City Commission acceptance of the
completed construction of ALLAPATTTAH INDUSTRIAL AREA
HIGHWAY IMPROVEMENT - PHASE I BIDS "A, B, C", no objections
were sustained;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The completed work performed by FRE
Construction Co., Inc. for ALLAPATTAH INDUSTRIAL AREA
HIGHWAY IMPROVEMENT - PHASE I BIDS "A, B, C", at a total
cost of $737,814.51, is hereby approved.

6 Section 2. That liquidated damages in the amount of
$5,000.00 for 10 days overrun of contract time shall be
deducted from the balance due the contractor and the surety.
Section 3. The proper officials of the City of Miami
are hereby authorized to pay $84,699.16 to FRE Construction
Co., Inc. as full and final payment for all work performed
and all materials furnished in connection with ALLAPATTAH
y INDUSTRIAL AREA HIGHWAY IMPROVEMENT - PHASE I BIDS "A, B,

It is recommended that a resolution be adopted
accepting the completed work performed by FRE
Construction Co., Inc. at a total cost of
$737,814.51; assessing $5,000.00 as liquidated
damages for overrun of contract time; and
authorizing a final payment of $84,699.16, for
ALLAPATTAH INDUSTRIAL AREA HIGHWAY
IMPROVEMENT - PHASE I BIDS "A, B, C".

ERE Construction Co., Inc. has completed the project
consisting of constructing 1.5 miles of streets, including;
clearing and grading, asphaltic paving, concrete curbs and/or
gutters, concrete sidewalk, storm sewers, sanitary sewer
modifications, and landscaping. The project is located
between N.W. 21 St. to N.W. 21 Terrace between N.W. 17 - 27
Avenues.
Poor organization and supervision by the contractor
contributed considerably to his inability to maintain good
production. This poor progress caused the contractor to
overrun the contract time by 10 calendar days. The contract
provides for the assessment of liquidated damages for failure
to complete the work on time at the rate of $500 per calendar
day. This was a unit price contract in the amount of
$737,314.51 less $5,000.00 as liquidated damages for 10 days
overrun of contract.
It is now in order for the City Commission to accept the
completed work and authorize final payment, after all
conditions are met.

notices for Public Hearings previously scheduled for December 12,
1985 at 3:30 p.m. on the following projects.

c. Allapattah Industrial Area Highway Improvement Phase

The corrective date and time of the Public Hearings is December
19, at 11:30 a.m.
Would you please make the necessary arrangements to inform the
general public.
Additionally make arrangements to issue a notice for Public
Hearing on December 19, 1985 to hear objections to an increase in
contract amount for Curtis Park Elderly Meals Facility. Attached
is a suggested text for the advertisement.

Please arrange to publish a Notice of Public Hearing
for objections to the acceptance by the City Commission
of the completed construction of ALLAPATTAH INDUSTRIAL
AREA HIGHWAY IMPROVEMENT - PHASE I H-4485 for the
Commission meeting of December 12, 1985.
The Resolution that will authorize the City Clerk to
advertise for public hearing is scheduled to be
considered at the Commission meeting of November 26,
1985.
