IN CON14ECTION WITH THE BIG ORANGE FESTIVAL SCHEDULED FOR FEBRUARY 2, 1986, s SUBJECT TO THE ISSUANCE OF ALL STATE PERMITS; AND THE CLOSING OF CERTAIN STREET 'TO THROUGH VEHICULAR TRAFFIC DURING SPECIFIED DATES AND HOURS SAID STREET CLOSING SUBJECT TO ISSUANCE OF l PERMITS BY THE DEPARTMENT OF POLICE AND It THE DEPARTMENT OF FIRE, RESCUE, AND INSPECTION SERVICES AND ASSURANCES THAT THE CITY WILL BE INSURED AGAINST A14Y POTENTIAL LIABILITY; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A ONE -DAY NONEXCLUSIVE CONCESSION AGREEMENT WITH THE ORGANIZATION I14 A FORM ACCEPTABLE TO i i THE CITY ATTORNEY. l ' WHEREAS, Performing Arts for Community and Education., Inc. (P.A.C.E.) has requested authorization to sell beer and wine during the 1986 Big Orange Festival, the granting of temporary nonexclusive one -day concession privileges, and the closing certain streets during specified dates and hours; and WHEREAS, Ordinance No. 9818 of April 5, 1985, authorized the City Commission, to permit the dispensing, of beer cr wine in soft containers in any City Park upon such conditions and limitations 4 as the City Commission, shall prescribe; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: K Section. 1. Upon, the issuances of a temporary permit by the Florida State Department by Business Regulation, Division of _ Alcoholic Beverages and Tobacco to sell beer and wines, and pursuant to the City Code, the request of Performing Arts for Community and Education, Ir.c. (P.A.C.E.) to sell beer and wire for a one -day period in connection with the 1986 Big Orange J;i Festival to be held at Peacock and Myers Parks on February 2, r ' =± 1986, is hereby granted in compliance with Ordinance No. 9818, L' further subject to the issuance of all permits required by law. j Section 2. In order to effectuate safe passage during the 1986 Big Orange Festival, the following streets are hereby closed CITY COMMISSION 1OF { DEC 19 1905 to through vehicular traffic or, the date and during the hours specified below: a) South Bayshore Drive frnm SW 27th Avenue to MacFarlard Road McFarland Road from South Bayshore Drive to Mai* Highway Sunday, February 2, 1986 - 6 AM to 9 PM b) All streets and avenues intersecting the areas listed above. Section, 3. Such closirg of streets is subject to the issuance of permits by the Departments of Police and Fire, Rescue, and Inspection Services. Such permit from the Department of Police is to be issued upon the full approval of the Chief of Police after giving all due cor.sideratior to t}le safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon, all factors set forth herein. Section 4. Such closing of streets is subject to the organizers of the 1986 Big Orange Festival obtaining insurance requirements as mandated by the City of Miami, Department of Finance, Risk Management Division. Section, 5. The City Manager is hereby authorized to execute a one -day nonexclusive concession agreement with P.A.C.E., in form acceptable to the City Attorney. Odio REFERENCES (to take place 2/2/86) I City Manager ENCLOSURES: i It is recommended that certain, streets be closed during the 1986 Big Orange Festival to through vehicular traffic subject to the issuance of permits by the Departments of Police and Fire, Rescue, and Inspection Services and assurances against potential liabilities; further authorizing the sale of beer and wine and temporary one -day concession, privileges during the event, subject to the issuance of all permits, as per the attached resolution. Background The Performing Arts for Community and Education (P.A.C.E.) has requested approval for the following in connection with the 1986 Big Orange Festival, a contemporary pop and jazz festival: 1) the closure of certain streets during the festival, 2) authorization for one -day concession privileges for February 2, 1986, and 3) allowing the sale of beer and wine during the event. The Parks and Recreation Department has reviewed these requests and recommends approval as follows: o That authorization for the sale of beer and wine during the event be granted pursuant to the issuance of a temporary permit by the Florida Department of Business Regulation Division of Alcohol Beverages and Tobacco, and any other permit required by law. The City Commission has granted this permission for the events of the past three years. o That the City Manager be authorized to execute an agreement for one -day concession 85--1193 �1 privileges, in a form acceptable to the City Attorney. o In order to provide safe passage during the event, the following streets be closed to through vehicular traffic during specified dates and hours: a) South Bayshore Drive from SW 27th Avenue to Mac arlard Road Mc arlard Road from South Bayshore Drive to Main i hway Sunday, February 2, 1986 - 6 AM to 9 PM b) All streets and avenues intersecting the areas listed above.
