HomeMy WebLinkAboutR-85-1189J-85-1127 RESOLUTION SSJ1.89 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY LU IS CALAMA AND DEL IA CALAMA, HIS WIFE, SIXTY THOUSAND DOLLARS ($60,000.00), WITHOUT THE ADMISSION OF LIABILITY, IN FULL AND COMPLETE SETTLE11ENT OF ALL BODILY INJURY, PERSONAL INJURY PROTECTION LIENS, WORKERS' COMPENSATION LIENS, CLAIMS AND DEMANDS AGAINST THE CITY OF M IAM I UPON EXECUTION OF A RELEASE RELEASING THE CATTY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Luis Calama and Delia Calama, his wife, filed a claim against the City of Miami through their attornery, for alleged bodily injury resulting from a motor vehicle accident wherein Luis Calama was the driver of a motor vehicle involved in ' a collision with a City of Miami Police Department vehicle on May 3, 1984, at Northeast 16 Street and Biscayne Boulevard Miami, Florida; and WHEREAS, the above claim has been investigated by the Risk Management Division in accordance with Ordinance No. 8417, which { created the City of Miami's Self -Insurance Program, and the said Division, together with the City Attorney, recommend that this claim be settled, without the admission of liability, for the sum of sixty thousand dollars ($60,000.00); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY ` OF M IAM I, FLORIDA; Section 1. The Director of Finance is hereby authorized to pay to Luis Calama and Delia Calama, his wife, the sum of sixty thousand dollars ($60,000.00), without the admission of liability, in full and complete settlement of all bodily injury, personal injury protection liens, workers' compensation liens, claims and demands against the City of Miami, upon the execution # of a release, releasing the City of Miami from all bodily injury, personal injury protection liens, workers' compensation liens and s: claims and demands. The claim arose as a result of an automobile accident between a car driven by Luis Calama and a City Police Department vehicle. The accident occurred on May 3, 1984 at 12:38 p.m. at Biscayne Boulevard and N.E. 16th Street, Miami, Florida. The police vehicle, northbound on Biscayne Boulevard, failed to stop for slowing traffic and rear -ended Luis Cala.ma's vehicle. The injuries to Mr. Calama have been diagnosed as multiple contusions, cervical sprain, right epicondylitis (elbow), internal derangement of the right knee, and Baker's cyst. He has been assigned a permanent disability rating of 6 to 8 per cent to the body as a whole. The total medical expenses are $10;120.50. The projected medicals are $5,750.00. The lost time and wages were $1,470.00. The total verified specials are $18,740.00. Mr. Calama has been paid $786.30 for his property damages. The above claim has been investigated by the Risk Management Division in accordance with Ordinance No. 8417, which created the City of Miami's Self Insurance Program, and said Division, together with this office recommend that this claim be settled, without the admission of liability, for the sum of $60,000.00.
