AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10039, ADOPTED SEPTEMBER 17,
1985, THE ANNUAL APPROPRIATIONS ORDINANCE FOR
THE FISCAL YEAR ENDING SEPTEMBER 30, 1986, BY
INCREASING THE APPROPRIATION FOR THE DEPARTMENT
OF PLANNING AND ZONING BOARDS ADMINISTRATION IN
THE AMOUNT OF $30,000 AND THE APPROPRIATION FOR
THE CIVIL SERVICE BOARD IN THE AMOUNT OF
$30,000 AND BY DECREASING THE APPROPRIATION FOR
SPECIAL PROGRAMS AND ACCOUNTS IN THE TOTAL
AMOUNT OF $60,000, FOR THE PURPOSE OF FUNDING
SPECIAL COUNSEL FOR TWO CITY BOARDS; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 10039, adopted
September 17, 1985, the Annual Appropriations Ordinance for the
fiscal year ending September 30, 1986, is hereby amended in the
following particulars:1
"Section 1. The following appropriations are made
for the municipal operations of the City of Miami,
Florida, for the fiscal year 1985-86, including
the payment of principal and interest on all
General Obligation Bonds:
Departments, Boards and Offices
General Fund
Civil Service
Planning & Zoning Boards
Administration

provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.
Section 2. The purpose of the herein increased
appropriation is to fund the expense of employing special counsel
for two City boards in the amount of $30,000 for each such
special counsel. The two boards are the Code Enforcement Board
and the Civil Service Board.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
_ clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.

On November 27, 1985, we forwarded a memorandum to you informing
you that Attorney George Knox had declined to serve as Special
Counsel to the Civil Service Board and that we were recommending
the appointment of former Assistant City Attorney Mark A.
Valentine in place of Mr. Knox. The attached ordinance was
omitted as an enclosure to that memorandum; the ordinance
appropriates a total amount of $60,000 for the funding of Mr.
Valentine's services in an amount not to exceed $30,000 and a
like amount ($30,000) for funding the services of Alan Rosenthal,
Esquire, who will serve as Special Counsel to the Code
Enforcement Board.

Subsequent to City Commission authorization through Resolution
No. 85-1082 on October 24, 1985, to hire George F. Knox, Esquire,
as Special Counsel to the Civil Service Board, Mr. Knox declined
to serve. We. are now recommending that you adopt the attached _
resolution which will authorize our employment of Mark A.
Valentine, Esquire, former Assistant City Attorney, to act as
Special Counsel. -
Also attached is an ordinance appropriating funds for the
compensation of both Mr. Valentine and Mr. Alan Rosenthal,
Esquire, the latter of whom will serve as Special Counsel to the
Code Enforcement Board. Funds in the total amount of $60,000 are
being appropriated to the appropri-,.te Boards to provide
