Fixtures and Lamp Posts to the Department of Building and Vehicle
Maintenance; and

5. DEFAULT
The City shall be the sole judge of non-performance, which shall
include any failure on the part of the successful bidder to
accept the award, to furnish required documents, and/or to
fulfill any portion of this contract within the time ululated
or within thirty (30) days, whichever is earlier/applicable.

6. MINORITY PROCUREMENT PROGRAM
Ordinance No. 9775 entitled the Minority Procurement Program
Ordinance of the City of Miami, Florida sets forth ...a goal of
awarding 50 percent of the City's total dollar volume of all
expenditures for all goods and services, to Black and Hispanic
minority business enterprises on an equal basis." A minority
business enterprise is defined as a business firm ...in which at
least 51 percent of said enterprise is owned by either a Black
American or Hispanic American, or at least* 51 percent of stock
outstanding is owned collectively or individually by either a
Black American or a Hispanic American; and whose management and
daily business operations are controlled by one or more Black or
Hispanic Americans." Minority business firms are encouraged, but
not required, to register with the City prior to submitting bids.
The Purchasing Office will provide the necessary forms and
instructions upon request.
To achieve the goal established by Ordinance No. 9775,
participation in providing goods and services to the City by
minorities is being encouraged in a number of ways. All vendors
doing business with the City are encouraged to include the
participation of minority firms in their bids. In evaluating

ALL VENDORS ARE URGED TO SUBMIT BIDS FOR ANY GOODS OR SERVICES
THAT THEY ARE ABLE TO SUPPLY, REGARDLESS OF MINORITY
CLASSIFICATION. However, compliance with all requests for
information regarding Minority Status or Participation is
required. Vendor cooperation is greatly needed to aid the City
in achieving its goal.
7. RESOLUTION OF PROTESTS
Bidders attention is directed to the attached Section 18.56-1 of
the City Code, In the event of protests, compliance to the
procedures described therein is mandatory.
8. INQUIRIES

NO CHANGES IN THIS INVITATION TO BID SHALL BE VALID UNLESS IN
AUTHORIZED WRITTEN ADDENDUM FORM AND SENT TO ALL POTENTIAL

Opening. Bids results will not be furnished by telephone.
9. ANTI-TRUST PROVISION
At such times as may serve its best interest, the City of Miami
reserves the right to advertise for, receive and award additional
bids for these herein services, and to make use of other
competitively bid (governmental) contracts for the purchase of
these services as may be available.
10. DEBARMENT AND SUSPENSION
Bidders attention is directed to the attached Section 18-56.4 of
the City Code and certification which must be executed and
returned with the Bid Sheets.

RESOLUTION OF PROTESTS (City Code Section 18-56.1.)
(a)- Right to Protest. Any actual or prospective contractual
party who feWls aggrieved in connection with the
solicitation of award of a contract may protest to the
chief procurement officer. The protest shall be submitted
in writing within fourteen (14) days after such aggrieved
party knows or should have known the facts giving rise to
the action complained of.
(b) Authority to resolve protests. The chief procurement
officer shall have the authority, subject to the approval
of the city manager and the city attorney, to settle and
resolve a protest of an aggrieved actual or prospective
contractual party concerning the solicitation or award of
the contract in question. Provided that in cases involving
more than four thousand five hundred dollar ($4,500.00),
the decisions of the chief procurement officer must be
approved by the city commission after a recommendation by
the city attorney and city manager. The chief procurement
officer shall obtain the requisite approvals and
communicate to the protesting contractual party; or
alternatively if the amount involved is greater than four
thousand five hundred dollars ($4,500.00), submit a
decision to the city commission within thirty (30) clays
after tie receives the protest.
(c) Compliance with time requirements. Failure of an aggrieved
party to submit a protest within the time provided in
subsection (a), above, shall constitute a forfeiture of
such party's right to complain and shall bar any legal
action therefor by such party. Failure by the city
officials to comply with the time requirements provided in
subsection (b) shall entitle the aggrieved party, at its
option, to bypass the provisions of this section and to

been found to be in wed of revision and modification to facili-

procurement policy and program; and
WHEREAS, the City Commission wishes to adopt legislation
which will set forth a goal of awarding 50• of the City's total
dollar volume of all expenditures for the procurement of all
goods and services, to Black and Hispanic minority business
enterprises on an equal basis; and
WHEREAS, this action of the City Commission, in repealing
Ordinance So. 9341, as amended, and Ordinance No. 9530, as
amended, both dealing with minority procurement, and in adopting
and substituting therefor this minority procurement ordinance is
authorised pursuant to Charter Of the City, Sections 52 and 531
and the Municipal Home Rule Powers Act of 1973, Chapter 166.011
at seq., Florida Statutes, as amended] and
WHEREAS, the proposed procurement policy contains require-
ments that those who contract with the City of Miami shall not
discriminate against any employee or applicant for employment
because of age, race, creed,. color, religion, sex, national

Section 1. Short Title. ?big ordinance shall be known
and may be cited as 'The Minority procurement program ordinance
of the City of Missi•.
Section 2. Definitions$ for the purpose of this
Ordinance, the following terser pbrases, wOrdar and their

C. Contracts, mean contracts for the procurement of
goods or services by the City of Miami.
u. Pacilities means all publicly financed projects
including, but without limitation, unified development projects,
municipal public works, and municipal improvements to the extent
they are financed through public money, property# or services.
E. Goods and services includes, without limitation,
public works, improvements, facilities, professional services,
commodities, supplies, materials and equipment. All purchases of
supplies, materials, equipment, and contractual services,
including professional services, needed by the City shall be made
in accordance with the goal not forth herein.
Section 9. A minority procurement program is hereby
established setting forth a goal of warding 50% of the City#s
total dollar volume of all expenditures for all goods and
services to Black and Hispanic minority business enterprises to
be apportioned as follows twenty-five (25) percent to blacks and
twenty-five (25) percent to Hispanics.
Section 4. Until changed by ordinance# the objective of
the City is to achieve a goal of warding 500 of the total dollar
volume of all expenditures for all goods and services to black
and Hispanic minority business enterprises.
Section 5. (a) The City Manager shall have responsibility
for the implementation of the minority procurement program. For
the purpose of assisting the City Manager in the implementation
of said program, a minority procurement compliance board is
hereby established, consisting of five members appointed by the
City Commission. The members of said board shall serve for a
term of four years; the City Commission shall appoint the chair-
person; the board shall establish written rules of procedure
which rules shall be subject to approval of the City Commission;
one member of the board shall be a City Commissioner. Said board
shall certify yearly to the City Commission the observance of the
requirements of this ordinance.

(b) All requests tot proposals, offers, bid Opacities-

20, above, shall contain the followings
(1) A specific reference to the applicability of
the minority procurement program established by this ordinancet
(2) A provision setting forth the right of the
city to terminate any contract or contractual arrangement entered
into on the basis of false or mislesding information as to the
status as a minority business •nterprisei'
(3) A requirement that ON* successful bidder or
offeror agree to provide a sworn statemant of cm liance with the
provisions of this ordinancOI
(4) A statement of the extent to which local
chronically unOmployed Blacks and Bispanics will be utilised to
fill unskilled labor positions, and the extant to which the
potential business enterprise will establish skilled -labor
training programs for said unskilled blacks and Biapanicst and
(5) A statement of the extent to which the
business enterprise has as one oe more of its partners or
principals natural persons who are Blacks or Hispanics.
(a) Emcept as prohibited by law, after the payment of
all operating expenses and debts, and after the funding of a
maintenance refucbisbing account for the facilities defined in
Section 20 above, and after consideration of the total
fiscal -year budget, a portion of all net profits from the
operation of said facilities is to be placed in a special account
which is to be used to funds
(1) a program to assist Black and Hispanic
minority business enterprises in securing bonding for City
procurements
(2) programs designed to render financial
assistance to Black and Biapanle minority business enterprises.

(d) Notwithstanding the provisions of subsections 5(a)
through S(c), no business enterprise that submits a qualified bid
or propoaai, or who is otherwise qualified to contract for
providing goods and services, shall be etcluded from con&idera-
tion based solely on race or national origin.
Section 6. (a) Black and Hispanic minority business
enterprises desiring to participate in the minority procurement
Program must register with the City of Ni&mi. The City's
Purchasing agent shall maintain a list of Black and Hispanic
minority business enterprises with the following minimum
information and material,

Section 7. (a) The City Nanager shall establish a system to
record and measure program progress. This system should maintain

participation, awards, dollar volume and goals, and other
appropriate type of information to analyse the program's success
and progress.
(b) The purchasing agent shall report quarterly to
user agencies of the City, to the City Manager, and to the City
Commission on the program's progress.

establish, in concert with the purchasing agent, the necessary
monitoring procedures to provide continuous review of the program

prepare a plan on program goals, activities, and timefraaes.
This plan shall be adjusted periodically to reflect program
performance progress.

ELECTRICAL SUPPLY COMPANY FOR THE PRO—
VIDING OF STREET LIGHT FIXTURES AND
LAMP POSTS AT A TOTAL COST OF $21,320.
Pursuant to the issuance of City of Miami Bid #85-86-1, a total of
six (6) bids were received for the providing of street light fix-
tures and lamp posts. The bid received from Miramar Electrical
Supply Company, which is Hispanic owned, is the lowest responsible
and responsive bid for these materials.
These street lights will be installed in the communities of Coconut
Grove and Little Havana. They will be attractive in appearance and
will provide the required illumination for security and positive
visibility.
The recommended firm will be required to provide approximately 20
fixtures and lamp posts for each community in designated locations.
This award will continue the community improvement efforts for these
neighborhoods. It is therefore recommended that this award be mate
to the Hispanic owned firm of Miramar Electrical Supply Company
the total cost of $21,320.
Funds for this award are available in the Fiscal Year 185-86 budget
of the Department of Building and Vehicle Maintenance.
