HomeMy WebLinkAboutR-23-0161City of Miami Resolution R-23-0161 alldl 11 li.Rl I + Legislation File Number: 13603 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 4/13/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE PARTICIPATING MEMBER AGENCIES OF THE CHILD ABDUCTION RESPONSE TEAM AND THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT FOR AN ADDITIONAL PERIOD THROUGH DECEMBER 31, 2025, TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ADEQUATELY RESPOND TO CONTINUING MULTI -JURISDICTIONAL INVESTIGATIONS OF INCIDENTS INVOLVING CHILD ENDANGERMENT AND MISSING OR ABDUCTED CHILDREN, TO PROTECT THE PUBLIC PEACE AND SAFETY, AND TO PRESERVE THE LIVES AND PROPERTY OF THE CITY OF MIAMI'S RESIDENTS PURSUANT TO PART 1, CHAPTER 23, FLORIDA STATUTES. WHEREAS, the subscribed law enforcement agencies ("Member Agencies") including the Miami Police Department ("MPD") have joined together in a multi -jurisdictional effort to rescue abducted children and, under certain circumstances, allocate resources to support investigations of missing and endangered children cases; and WHEREAS, the Member Agencies are all participants in a multi -agency effort known collectively as the Children Abduction Response Team ("CART"); and WHEREAS, the Member Agencies of the CART agree to utilize applicable state and federal laws to prosecute criminal, civil, and forfeiture actions against identified violators, as appropriate; and WHEREAS, the Member Agencies have the authority under Part 1, Chapter 23, Florida Statutes, titled the "Florida Mutual Aid Act," to enter into a voluntary agreement for cooperation and assistance of a routine law enforcement nature that crosses jurisdictional lines; and WHEREAS, the Member Agencies are located in relation to each other that it is to the advantage of each to receive and extend mutual aid in the form of law enforcement services and resources to adequately respond to continuing multi -jurisdictional criminal activities so as to protect the public peace and safety, and to preserve the lives and property of each Member Agencies' residents; and WHEREAS, additional parties, at the request and with the approval of the Florida Department of Law Enforcement ("FDLE") and other CART members, may enter into this Agreement at a later date as evidenced by their signing of the subject mutual aid agreement; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 13603 (Revision:) Printed On: 4/19/2023 File ID: 13603 Enactment Number: R-23-0161 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to execute a Mutual Aid Agreement, in substantially the attached form, between the participating Member Agencies of the CART and FDLE for an additional period through December 31, 2025, to receive and extend mutual aid in the form of law enforcement services and resources to adequately respond to continuing multi - jurisdictional efforts to investigate incidents involving child abduction and missing or endangered children pursuant to Part 1, Chapter 23, Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption.
