Rri-64 A RESOLUTION MAKING FINDINGS; ADOPTING THE EVALUATION AND APPRAISAL REPORT AND DIRECTING THE CITY CLERK TO TRANSMIT THE PROPOSED MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN (SEPTEMBER, 1985), THE EVALUATION AND APPRAISAL REPORT AND CURRENT CAPITAL IMPROVEMENT PROGRAM TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS FOR COMMENT AND TO OTHER AFFECTED AGENCIES PER SECTION 163.3161 F.S. "LOCAL GOVERNMENT PLANNING AND LAND DEVELOPMENT REGULATION ACT FURTHER ESTABLISHING FUTURE PUBLIC HEARING DATES ON THURSDAY, APRIL 24, 1986, AFTER 5:00 PM, FOR FIRST READING AND ON THURSDAY MAY 8, 1986, AFTER 5:00 PM, FOR SECOND READING, CONSIDERING AN ORDINANCE ADOPTING THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN (SEPTEMBER, 1985). WHEREAS, the Miami Comprehensive Neighborhood Plan 1976-1986 was approved by Resolution 77-430; May 12, 1977, as the comprehensive plan of the City of Miami; and WHEREAS, the City of Miami Planning Advisory Board, the local planning agency, recommended approval of an amended plan - Miami Comprehensive Neighborhood Plan (September, 1985) - and the Evaluation and Appraisal Report and recommended transmittal of the Plan, Report and current Capital Improvement Program by Resolution PAB 4-86 by a 7 to 0 vote on January 15, 1986, following an advertised public hearing; and WHEREAS, Section 163.3191 F.S. "Local Government Planning and Land Development Regulation Act" provides requirements and procedures whereby municipalities may amend their comprehensive plans; and WHEREAS, Section 163.3161 F.S. requires that local governments periodically submit a report evaluating and appraising their comprehensive plan to the State of Florida, the regional planning council and the county; and WHEREAS, Section 163.3184(1) F.S. requires that, prior to adoption, the proposed amended plan is to be forwarded to the State and any other unit of local government or government agency that has filed a request; and WHEREAS, Zoning Ordinance 9500 contains certain time limits; and WHEREAS, the Planning Advisory Board, on January 15, 1986 by an 7 to 0 vote approved Resolution PAB 5-86 which requested the Commission to waive the time limits in Subsection 3508.2 of Zoning Ordinance 9500 and to establish future hearing dates for consideration of an ordinance adopting the Miami Comprehensive Neighborhood Plan (September, 1985). WHEREAS, Subsection 3513 of Zoning Ordinance 9500 allows the Commission to establish dates certain for future public hearings without tilling the time CITY COMMISSION limits between Board actions and City Commission actions; MEETING OF 8G-64 JAN 23 1988 k NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Commission finds that on January 15, 1986, the Planning Advisory Baord - the local planning agency - held a properly advertised public hearing pertaining to the proposed amended plan - Miami Comprehensive Neighborhood Plan (September, 1985). Section 2. The Evaluation and Appraisal Report of the Miami Comprehensive Neighborhood Plan 1976-1986 is hereby adopted. Section 3. The City Clerk is directed to transmit five (5) copies of the proposed amended plan - the Miami Comprehensive Neighborhood Plan (September 1985), together with the Evaluation and Appraisal Report and the current Capital Improvement Program to the State of Florida Department of Community Affairs for comment; per Section 163.3161 F.S. "Local Government Planning and Land Development Regulation Act". Section 4. The City Clerk is directed to transmit copies of the Evaluation and Appraisal Report to the South Florida Regional Planning Council and Metropolitan Dade County. Section 5. Copies of the proposed amended plan, the Miami Comprehensive Neighborhood Plan (September 1985) are to be made available to any other unit of local government or governmental agency that had filed a request for such copies. Section 6. Public hearing dates are hereby established on Thursday, April 24, 1986, after 5:00 PM, for first reading and on Thursday, May 8, 1986, after 5:00 PM, for second reading, considering an ordinance adopting the Miami Comprehensive Neighborhood Plan (September, 1985). It is now in order for the Commission to transmit the amended plan to the Florida Department of Community Affairs and to establish dates certain to consider adopting the Plan. Backup information is attached. A RESOLUTION to provide for the above has been prepared by the City Attorney's Office and submitted for consideration of the City Commission.
