BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 2-266, 2-267, 2-268, 2-269, 2-282 and 2-2R3 of Division 20, entitled "Human Resources Department," of Chapter 2, entitled "Administration," of the Code of the City of Miami, Florida, as amended, are hereby further amended in the following particulars:1 "DIVISION 2.0. HUMAW RESOURCES PERSONNEL MANAGEMENT DEPARTMENT Subdivision 1. Generally Sec. 2-266. Created. There is hereby created a department to be known as the human fesouree-s- personnel management department. (Ord. No. 8526, S. 1, 2-26-76) Sec. 2-267. Appointment, duties of director. The city manager is authorized to appoint a director of the human regaltrags. personnel management department. The director shall administer the affairs o e department subject to the supervision and control of the city manager in all matters. (Ord. No. 8526, S. 2, 2-26-76) Sec. 2-268. Functions and duties of department. The functions and duties of the personnel management department are to: Sec. 2-269. Department not to abridge civil service board author- ity or interfere with civil service policies in speci- fied areas. It is declared to be the legislative intent of this body that implementation of the personnel management depart- ment shall not abridge the policy -making au on y o e civil service board and shall not impede, deter or interfere with civil service policies in the areas of establishing, maintaining and enforcing in -hiring standards and qualifications; preparation, ad- ministration, certification, and superviison of all in -hiring and promotional examinations; judicial review of all disciplinary ac- tions and procedures; approval of employee performance evaluation standards, and review of all personnel actions pursuant to civil service board rules. Duties generally. The board shall provide advice and recommendations to the human resetrree-s- personnel management departi,,Pnt and its affirmative action division:—Tfie—director of personnel management or his or her designee shall represent the city manager iin TTmatters of affirmative action and shall provide all staff support to the board, including the affirmative action supervisor. With the assistance of the personnel management department and its affirmative action supervise— r, —th oar s a perform the following duties and functions: (2) Review employment policies and practices of the city and make recommendations to the human rasourcos personnel management department through the affirmative action supervisor. (5) Serve with the affirmative action division and the human` resources personnel management department as an instrument for informing the city commission, city departments and agencies and the public of the continuing affirmative action program and its purposes. Sec. 2-283. Formulation, adoption of affirmative action plan. (b) Review, submission by board for commission approval. The board shall review any plan relating to the city's affirmative action program as prepared and submitted by the affirmative action supervisor. This review shall be conducted in meetings open to the public and in full compliance with chapter 286, Florida Statutes, the government -in -the -sunshine law. Upon completion of public hearings and review by the board, the board shall submit to the commission through the yeses- personnel management director and the city manager its comments and recommendations concerning the plan or modifications to the plan. The civil service board of the city shall receive a copy of the plan and the board's recom- mendations at the same time they are submitted to the city manager. z Section 2. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance i. declared invalid, the remaining provisions of this ordinance shall not be affected. SUBJECT Ordinance to Change the Name of the Department of Human Resources REFERENCES (M.18) ENCLOSURES. Ordinance It is recommended that the City Commission adopt an Ordinance chang- ing the name of the of the Human Resources Department to the Person- nel Management Department. My overall organization plan which is focused at streamlining City government includes the implementation of titles that more accurately describe the functions, services and departments to the citizenry of Miami. The Human Resources Department, for example, is often confused with Metro- Dade's Department of Human Resources which is responsible for social services instead of personnel -related matters. To this end, it is recommended that the title of the Human Resources Department be changed to the Personnel Management Department. I feel that this measure will result in a more responsive and informative government for the citizens of Miami. Also, in accordance with and reorganization plan, the functions of the Affirmative Action office will be transferred to the Department of Internal Audits and Reviews and the title of "Affirmative Action Supervisor" will be changed to the more appropriate title of "Affirmative Action Officer." These changes are also reflected in the attached ordinance, in accordance with the provisions of a separate ordinance which is being submitted for your consideration at this same meeting. Dougherty M City Attorney ENCLOSURES (2) Upon further review and analysis of all of the emergency reorganizational ordinances which were considered by the City Commission yesterday (Items #16-20), we have been unable to find the degree of cost -savings in two of the ordinances that would support the finding of an emergency: the establishment of a Department of Internal Audits (Item #19) and the name change of the Human Resources Department (Item #20). Accordingly, we are receding from our earlier position that approved all five ordinances for adoption on the basis of an emergency. We have informed the City Manager of the above by phone and are furnishing the Mayor and City Commission with a copy hereof. The action of the City Commission in approving these two items is to be considered as a first reading only and the final reading will take place on January 23, 1986. The advertisement for the second reading will appear in THE MIAMI REVIEW on Monday, January 13, 1986, in compliance with State Law.
