HomeMy WebLinkAboutR-86-0130RESOLUTION NO. R h- 1 30 A RESOLUTION DESIGNATING THE MIAMI GRAND PRIX RACING EVENTS IN ACCORDANCE WITH SEC. 549.08 F.S. (1985) AS BEING FOR A PUBLIC PURPOSE AND SHALL NOT BE CONSIDERED OR FOUND TO BE A PUBLIC OR PRIVATE NUISANCE. F WHEREAS, under an agreement between the City of Miami and Miami Motorsports, Inc. dated June 14, 1982, the Miami Grand Prix Racing Events were staged for three years in Bayfront Park, around Miamarina and along Biscayne Boulevard south of Port Boulevard; and k WHEREAS, the staging of Miami Grand Prix Racing Events in ? Bayfront Park and along Biscayne Boulevard has provided the City with r' nationwide and worldwide television coverage throughout the entire Y Western Hemisphere; and �j WHEREAS, the upcoming 1986 Miami Grand Prix will begin annual prime television coverage by NBC furthering the positive image of our community by showcasing Biscayne Bay, the waterfront and Downtown — Miami; and WHEREAS, during the first three annual Miami Grand Prix Racing s Events the City was moving forward the development of the Bayside Specialty Center at Miamarina and the redevelopment of Bayfront Park; and WHEREAS, the start of construction of the Bayside Specialty Center and Parking Garage in October, 1985 modified the Miami Grand Prix premier downtown event at its established location; and WHEREAS, after study of all alternative sites for the staging of Grand Prix Racing Events, and recognizing the further impact of the scheduled construction of the new Port of Miami access bridge and the need to ensure access to the Port during racing events, the City and Miami Motorsports, Inc. renegotiated and entered into an agreement o;1 October 16, 1985, relocating and creating a new race circuit through Bicentennial Park, the FEC Tract and along Biscayne Boulevard north of Port Boulevard; and CITY COMMMION MEETING OF FEB 13 1986 RA-1 `30 &FMAHMti 1 WHEREAS, since the opening of Bicentennial Park in 1976, the park has remained underutilized due to poor access and a high incidence of petty and major crime; and WHEREAS, the construction of a new race circuit in Bicentennial Park, a new configuration and landscaping of the park, may provide the City with a quality facility enabling the programming of year—round major sporting events including motor vehicle racing, cycling, and track and field events as exemplified by the staging of Miami's first annual Winter Games held during January and February, 1986; and WHEREAS, the Florida State Legislature enacted the "Municipal Vehicle Racing Act of 1984" establishing motor vehicle racing events to be conducted on highways, streets, or in parks within a municipality to be a public purpose and further permitting a municipality to permit limiting access, to charge admission, to allow temporary closing of highways, streets, sidewalks and parks, to allow rerouting of vehicular and pedestrian traffic and finding a race event so permitted not to be considered a public or private nuisance; and WHEREAS, the Bicentennial Park and the F.E.C. Tract properties were acquired and developed by the City with Public Works and Recreational Facilities Bonds for public purpose parks and recreational use; and WHEREAS, it is the understanding of the City that the provision of park amenities and public access does not require an environmental impact assessment; and WHEREAS, the City Commission's use of these properties for any purpose that the Commission deems necessary and desirable will not effect the above mentioned Bonds; and WHEREAS, the construction of racing facilities in Bicentennial Park and the F.E.C. property provides new and desirable recreational opportunities for the community and will favorably contribute to overcoming crime and misuse of the park; and WHEREAS, the City has issued a permit according to Sec.549.08 F.S.0 985) granting permission to Miami Motorsports, Inc. to operate the Miami Grand Prix in and upon City streets, City parks, and other 2 14 4 property pursuant to the Restated License Agreement- dated October 16, 1985; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby designates the Miami Grand Prix Racing Events in accordance with Sec. 549.08 F.S. (1985) as being for a public purpose and shall not be considered or found to be a public or private nuisance. PASSED AND ADOPTED this 13th day of FEBRUARY , 1986.
