A RESOLUTION APPROVING AND AUTHORIZING THE ACQUISITION BY WAY OF PURCHASE OR CONDEMNATION OF THE PARCEL OF VACANT LAND LYING BETWEEN N.E. 69TH STREET AND N.E. 71ST STREET ON BISCAYNE BAY IN THE CITY OF MIAMI, WHICH PARCEL CONTAINS APPROXIMATELY 8.541 t ACRES AND WHICH IS MORE PARTICULARLY AND LEGALLY DESCRIBED IN THE ATTACHED EXHIBIT 'A', TO BE USED FOR PARK AND/OR MARINA PURPOSES; FURTHER AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO TAKE ALL NECESSARY STEPS TO ACQUIRE SAID PROPERTY BY t CONDEMNATION PROCEEDINGS. s WHEREAS, the City is in dire need of both park lane-- and marina facilities; and WHEREAS, the City Commission, pursuant to Motion 85-347 and Resolution No. 85-919, authorized the City Manager to obtain i appraisals and pursue the purchase of the parcel of land located between N.E. 69th Street and N.E. 71st Street on Biscayne Bay (hereinafter the "Property") to use for park and/or marina purposes; and Yy WHEREAS, appraisals have been obtained and efforts to secure the property for valid public and municipal purposes by negotiation and purchase have been unsuccessfully made; WHEREAS, the City Commission finds that the herein property is needed for said purposes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: y� Section 1. The acquisition of the parcel of land located between N.E. 69th St. and N.E. 71st Street on Biscayne Bay in the City of Miami, which parcel contains approximately 8.541 acrez; and which is more particularly and legally described in the attached Exhibit 'Al is hereby approved; further, said acquisition is hereby authorized b wa of h i y y p c a e or condemnation. FLORIDA INTFR.(7F"FICE MEMOPANDUM January 21, 1986 Land Acquisition NE 69-71 Streets on Biscayne Bay ces Administration The attached resolution and memorandum to the Mayor and City Commission is for the acquisition of vacant land through condemnation for a proposed park and/or marina located on Biscayne Bay between NE 69 and 71 Streets . This matter is to come before the City Commission at its meeting of February 13, 1986. 1 E F encl. as stated 996-1 UA Honorable Mayor and Members of the City Commission Cesar Odio City Manager INTER -OFFICE MUMORANIDIJPA Land Acquisition NE 69-71 Streets on Biscayne Bay It is recommended that the City Commission authorize the City Manager to initiate condemnation proceedings for the vacant land located on Biscayne Bay between NE 69-71 Streets. Funds covering the acquisition are allocated from the Marinas Enterprise Fund. At the City Commission meeting of March 28, 1985, Motion 85-347 was passed to immediately begin the process of appraisals of a vacant parcel of property located on Biscayne Bay between NE 69 and 71 Streets. Solicitations for appraisal proposals were sent to 22 MAI Appraisers and two proposals were the most responsive in fee and time to complete. Resolution No. 85-919 passed by the City Commission approved making an offer of $725,000 to purchase this property. The offer to purchase was made to the owner. Since the owner has made no response to the offer, it would therefore, be most advantageous to the City to initiate condemnation proceedings to take the property for the proposed park and/or marina. Recommendation The Property & Lease Management Division recommends that condemnation proceedings be initiated to take the property for the proposed park and/or marina.
