WHEREAS, the Miami Zoning Board at its meeting of January 27, 1986, Item 2, following an advertised hearing, adopted Resolution ZB 15-86 by a f ive to two (5-2) vote granting the Special Exception as listed in Zoning Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, Schedule of District Regulations, Page 4 of 6, CR Commercial -Residential, Transitional Uses, Structures and Requirements to permit, construction of a proposed drive-in teller facility for the Republic National Bank located at 2800 Northwest 7th Street, Miami, Florida, also described as Lots 1, 2 and the E 35.75' of Lot 3, Block 1, "PALBICKE AND GARRISON ADDITION TO GROSSE POINT HIGHLANDS" (40-56), Public Records of Dade County, as per plans on file, with a reduction of the 50' transitional area to a 10' landscaped area; and WHEREAS, the Planning Department has taken an appeal to the City Commission from the granting of the Special Exception; and WHEREAS, the City Commission after careful consideration of this matter finds that the proposed reduction of the 50' transitional area to a 10' landscaped area, as approved by _thy f crrir COMMSSION MEETING. Per City Code, Chapter 62, Section 62-621 the Planning Department requests a review by the City Commission of a Special Exception granted by the Zoning Board on January 27, 1986 for the property located at approximately 2800 N.W. 7th Street. t There were three decisions made by the Zoning Board in relation to this project. Two are subject to approval by the City Commission and one is only subject to Zoning Board decision. Of the first two, one, the use of a drive-in facility in connection with a financial institution, was recommended for approval by the Zoning Board; the second, the reduction of stacking spaces from 10 to 9 and from 10 to 1; was recommended for denial by the same Board. The third special exception, granted by the Board, and the subject of this -appeal reduces the transitional area from 50' to 101. The subject property is zoned CR-2/7 Commercial Residential (Community) and adjoins a RS-2/2 One Family Detached Residential district. The Planning Department considers that the review by the City Commission is necessary for the following reasons: 1. In order for the City Commission to review the case in a holistic manner, all three special exceptions should be considered. 2. The Planning Department has recommended the reduction of the transitional strip to 20' with adequate landscaoing and a wall in order to provide for an appropriate reduction of the impact on the residential side. This 20' distance enables the applicant to retain the same building as projected with an adjustment of the orientation and, maintaining, also, the parking area as required. The proposed 20 parking spaces is excessive, there are only 8 spaces required according to the size and use of the building. It is requested that this item be heard on the City Commission meeting of February 27th, 1986. Mr. Shockett: Mr. Chairman, members of the Board, my name is William Shockett, I'm attorney for the applicant. I'm also a commissioner in the City of Miami Beach. I'm not used to standing on this side of the podium. I would like to submit to you letters of approval from adjoining property owners particularly two of the three lots here, the third one is out of town and we couldn't contact her. Also, you'll see ( looking at the transparency map on the wall) with the application when the notices went out, there were, not at our request, just in response voluntarily to the notices, six letters came in in favor of the application and only one opposed it and that person who filed a notice in opposition is a doctor, not a resident, who maintains an office in a nearby small center. This property was previously used as a 24-hour service station. The neighbors in the area, needless to say, are very happy to see this kind of use... the property put to this kind of use particularly the people who are most impacted by this which are the people that reside in the area where the recommendation is that we go to 20' instead of our plan which shows 10' and I'll explain to you the reasons for this. First, this second teller is an automatic teller. The first teller in the building here is a live teller. We put the automatic teller there for a reason, to avoid the very thing that you are concerned with and that is the backup of traffic. Republic felt that a automatic teller here will alleviate that problem for the obvious reasons. That is why we ask for this exception so that we don't have to have two lines of traffic all the way through the property which the recommendation of the Planning Department was to do this, but we would lose valuable parking spaces inside since we would have to run the whole length of the property here. So this is something that we just ... we've tried to work with the City. We've agreed to raise the wall, and keep in mind in this landscaped area, there will be a 6' cement wall blocking the residential property from this and we intend to landscape that whole area around the property. The bank facility closes at 5 o'clock. You are not going to have any congestion in the evening, and we feel that this layout is suitable for this neighborhood and it will not result, we don't feel it will result in the backing... backing up of traffic in the area. We looked at the drive-in tellers for branch banks and in practically all the branch banking, if you'll notice yourself when you go by, there is very little traffic with the drive-in tellers. It's a service ... it actually operates at a loss but it's a service that the bank must provide but it's not one that's really used in branch banks. If you look at a main office, if you look at Republic's main office and their drive- ins, their backed up to the street but look at any branch office, look at Capital Bank is in the neighborhood, look at any of the other branch banks and you'll see that these drive-in facilities are rarely used. The reason is when you have a branch, you want to open it to the local people in the community, you want to make contact with the locals, you want to talk to them, they want to come in and see the branch manager and almost all the banking is done inside. So experience shows that you really don't need this two lanes of traffic and all the reservoir spaces that the City has requested. So we respectfully ask you to grant our application on those basis, and in particular, I emphasize that the people in the neighborhood are all in favor of this to a person, at least the ones that reside there. We've been at that location since 1951 and I did send a card in. Anyone familiar with this area... there is a traffic problem right now and I'd like to point out, if I could, on there. Mr. Borden: In the area right here on 7th Street is...the intersection is not like this. Okay? There's a shopping center across the street Also, you're only two blocks from 27th Avenue. In the mornings from 7:30 until approximately 9: 30 getting across ... (word unintelligible) 7th Street is almost impossible. In fact, we have accidents there all the time with people trying to either turn down 28 th Avenue or trying to get out 28th Avenue and head west on 7th Street. As a result, we have a continuing problem...and we take up the next piece of property adjacent to these driveways ... we can not even get into our own parking spaces in the front of our building during those hours. If you cut that reservoir down, there will be no space in there to back these cars up because you'd only have 11 spaces coming off 7th Street. If this traffic backs west, we will have no way to get into our own parking spaces which border right on 7th Street and that's why we don' t feel that... not the fact that you're putting a branch bank there, it's a fact that the location of this piece of property, the way it physically sits in relationship to east -west traffic on 7th Street, which is a main east -west artery, presents a very difficult problem to get in and out of these lanes without backing up traffic any more than it is right now. You have the same condition in the afternoon coming west from the City, from like 3 o'clock until, like he says, when the bank closes, up until about 6: 30 and what we would ... what we would like to see happen is that that traffic exposure be studied because the intersection does not warn itself to signalization. You're too close to 27th Avenue and you don't have a through intersection here. It goes like this and the next street is over here, almost like this. Also, you have the same problem with people trying to get around the 27th Avenue light. They're continually making left hand turns at this intersection and this intersection which is on the other side of the shopping center at the La Hacienda restaurant. As a result, that's continually blocked off and I just don't see how you can put a facility like that in there without creating more of a havoc with the traffic than we have right now and we have approximately 14 parking spaces that go... start right at this property line and run directly west, that border right on 7th Street. Mr. Gort: Thank you, sir. Mr. Moran-Ribeaux: Mr. Chairman, just a comment from out of my head and excuse me, before you start. Can that... Mr. Perez-Lugones: Could you turn in the micro... turn on the microphone please. Mr. Moran-Ribeaux: Okay. I was wondering has any study been done and I imagine it has and for some reason it's not presented here, to have the traffic flow the opposite way, people coming in through the avenue and exiting through the street with a right only turn sign at the opposite end? The entry should be on the avenue and then going exactly the opposite way and then going out that way with a right turn only sign. Would that solve any kind of problem? Mr. Gort: I don't think so. If we didn't have the automatic teller then we would have sufficient reservoirs. All we did was add an automatic teller and that's created the reason for us coming to you and asking for the waiver. We did this to avoid the problems that he's talking about. As I said, our experience in banking... we are not going to create a problem for him. We have more than enough, and they'll tell you, that we have more than enough parking on the property. So I don't think that that concer... we addressed the identical concern that the doctor had and this was the solution for it because as the Planning Department stated the use is harmonious and compatible with the adjacent area and will be beneficial to the community. The people that live there agree with that. So this is how we address the doctor's concern. I think if he understood that, he would realize that if we took the automatic teller out, we wouldn't need the second lane and we'd have a bigger problem than we have. Mr. Gort: Okay, thank you, sir. The request for a change on their part really will try to solve a problem which they may otherwise have with what they are allowed to do. The way I look at it, is with two it's better, with three like Hemisphere National Bank would still be even much better. So why not let it go faster and that the way the need for those nine spaces will be more reduced. People are not going to go more or less because there are two, three or four. I mean, if you divide the traffic in between two tellers, the movement of a car that comes in is cut right in half for both of them. So if a car is going to stay ten minutes in the line, if you have two ... with only one teller, if you have two tellers that car will stay there only five minutes. So it actually will ease the backup situation. Look at it from that point of view. Mr. Gort: What he's saying makes sense but let me tell you what my problem is. I know that corner very well. There used to be a small gas station in there and that corner is one of the worst corners there is on 7th Street, the reason being, as it was stated before, it's not one that goes right across. It's a dead end in 7 th Street. You've got St. Michael School down the street, three blocks down. In the morning you've got very heavy traffic with people going to school. You've got the heavy traffic of the people at the shopping center right across the street. Then you've got the people going to work that utilize the main artery to go to downtown Miami. There's always a backup in that corner. The backup goes all the way to half of that property in the morning. I, myself, find the property...I think the use is fine and they're complying with... almost they're complying with the minimum of standard required by the City zoning code. But that corner itself has got a lot of problems. Traffic is a big problem in there. I think the Republic Bank... it wants to do a service and we appreciate that but at the same time, they will find, business wise, the feasibility of it is going to be worse for them because people are going to have trouble getting to that facility, getting out, in and out of that facility. I think what they're trying to do is utilize a small space and maximize too much. That's one of the reasons why I would like to see the setback the 20'...and I agree, I don't think a 20' is necessary, I think with 20' they can do it and I can see the stack up of 20 cars instead of 10•because there's always going to problems. Let me tell you, they say drive-in facilities don't create problems, in certain areas they don't create problems but in that area, I can guarantee you, they're going to provide a lot of problems because you've got a lot of small stores around there, you've got a lot of the shopping potentials and one reason they're going to put that it in there is because they've done their surveys and how many customers they've got in there and how many people want to utilize the drive -up windows and you're gonna always have cars outside if you only have nine spaces. I'd rather have 20 spaces than 9 spaces... Mr. Moran-Ribeaux: Willy, but you can not have... Mr. Gor t ...or none at all... Mr. Moran-R ibeaux: Okay. Mr. Gort ... that's how I feel about it... So we try to provide this with less backup, less traffic and it's just being made appear like it's a big bank trying to overuse a piece of property and it really isn't. Mr. Cruz: The set... the 20' we can not because of the size of the building that the bank requires and the requirement that they are asking of us of two tellers to minimize traffic, we can not come up with the square footage and the number of parking that they want. Mr. Gort Let me ask you a question. What's in front of us...it's very simple. The minimum parking requirement by the City code is 8, my understanding is you're providing 20. I think what's in front of us is are we willing to sacrifice 12 parking spaces with a 10' setback or are we willing to give the 20' setback and give less parking spaces. Mr. Moran-Ribeaux: I'd rather see more parking spaces, I'll be honest with you. Mr. Gort Well, that's really what the question in front of us is right now, because yes, they could turn their building around, they could put it in some other position but then they would... So I'm, you know, to me it doesn't bother me that much as long as we alleviate the problem of traffic and so much as we alleviate the problem of parking and that's the major concern here and I think their solution...I mean, their proposal kind of works it out. Mr. Milian: I think...I think you've hit it right on the head. I think my concern is more of the location where this is going to be built. I even questioned about the fact that if they would only... if they would eliminate the automatic teller whether it's really, in fact, a good place to have this drive-in teller with only nine or ten, even in accordance with the zoning code without having some kind of a traffic study being done or what kind of traffic they're going to be generating into that automatic... or those tellers. That's my concern. 1 mean, if it were located in another.. -in another street where traffic is not as heavy as it is on 7 th Street, then I wouldn't have any.. . So that's why ...we're not taking a hard line with you. This is the bank's requirements and if they're not met then we'll have to put that property to another use, it will not be a bank. When I first looked at this and looked at the presentation and looked at the two drive -up windows and I agree with the doctor that the problem with traffic there, it's bad. At the same time you've got to look at it. That corner is going to be utilized for something. Something is going to be created in there. Whatever is created there, one of the biggest problems we have through 7th Street, we've got all these pockets of small shopping centers taking place and that they don't provide enough parking spaces and offices and so on and we do have a problem with parking in the area.
