A RESOLUTION REVERSING THE DECISION OF THE
ZONING BOARD AND THEREBY GRANTING THE SPECIAL
EXCEPTION, AS LISTED IN ORDINANCE 9500, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, ARTICLE 20, SECTION 2031,
SUBSECTION 2031.2, TO PERMIT A REDUCTION OF
THE NUMBER OF RESERVOIR SPACES FROM A
REQUIRED MINIMUM OF 'PEN TO NINE RESERVOIR
SPACES ON LANE ONE AND FROM A REQUIRED
MINIMUM OF 'PEN TO ONE RESERVOIR SPACE ON LANE
TWO FOR THE PROPOSED DRIVE-IN FACILITY FOR
THE REPUBLIC NATIONAL BANK LOCATED AT 2800
NORTHWEST 7TH STREET, MIAMI, FLORIDA, MORE
PARTICULARLY DESCRIBED HEREIN, AS PER PLANS
ON FILE; ZONED CR-2/7 COMMERCIAL -RESIDENTIAL
(COMMUNITY), SAID SPECIAL EXCEPTION PETITION
HAVING BEEN FILED IN CONJUNCTION WITH SPECIAL
EXCEPTIONS TO PERMIT A DRIVE-IN FACILITY AND
A REDUCTION IN WIDTH OF THE TRANSITIONAL AREA
WHERE A CR LOT ADJOINS A RS-2 DISTRICT;
FURTHER PROVIDING AN ANNUAL REVIEW OF THE
HEREIN GRANT OF PERMISSION WITH THE INITIAL
REVIEW TAKING PLACE ONE. YEAR AFTER THE
ISSUANCE OF THE CERTIFICATE OF OCCUPANCY FOR
SAID FACILITY.
WHEREAS, the Miami Zoning Board at its meeting of
January 27, 1986, Item 3, following an advertised hearing, made a
motion to grant the Special Exception, with approval by the City
Commission, as listed in Ordinance 9500, as amended, the Zoning
Ordinance of the City of Miami, Article 20, Section 2031,
Subsection 2031.2, to permit a reduction of the number of
reservoir spaces from a required minimum of ten to nine reservoir
spaces on Lane One and from a required minimum of ten to one
reservoir space on Lane Two for the proposed drive-in teller
facility for the Republic National Bank located at 2800 Northwest
7th Street, Miami, Florida, also described as Lots 1, 2 and the E
35.75' of Lot 3, Block 1, "PALBICKE AND GARRISON ADDITION TO
GROSSE POINT HIGHLANDS" (40-56), Public Records of Dade County,
as per plans on file. The motion failed by a two to five (2-5)
vote, thereby constituting a denial of the Special Exception; and
WHEREAS, the City Commission after careful consideration of
this matter and notwithstanding the recommendation of denial by
the Planning Department and the denial of the Special Exception

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The decision of the Zoning Board in denying
the Special Exception as listed in Ordinance 9500, as amended,
the Zoning Ordinance of the City of Miami, Article 20,
Section 2031, Subsection 2031.2, to Permit a reduction of the
number of reservoir spaces from a required minimum of ten to nine
reservoir spaces on Lane One and from a required minimum of ten
to one reservoir space on Lane Two for the proposed drive-in
teller facility for the Republic National Bank located at 2800
Northwest 7th Street, Miami, Florida, also described as Lots 1, 2
and the E 35.75' of Lot 3, Block 1, "PALBICKE AND GARRISON
ADDITION TO GROSSE POINT HIGHLANDS" (40-56), Public Records of
Dade County, as per plans on file, is hereby reversed and the
Special Exception as per plans on file, is hereby granted, based
on reduction of width of transitional area where a C R lot adjoins
a RS-2 Disrict; provided that an annual review of the herein
grant of permission be held by the City Commission with the
initial review to take place one year after the issuance of the
Certificate of Occupancy for said facility.

It is required that a review be made of
the Special Exception denied by the

Special Exception is filed in conjunction with Special Exceptions to permit a
drive-in facility and a reduction in width of the transitional area where a CR
lot adjoins an RS-2 district.
One objection received in the mail; one opponent present at the meeting. Six
replies in favor received in the mail; two proponents present at the meeting.
Backup information is included for your review.
A RESOLUTION to provide for the above has been prepared by the City Attorney's
Office and submitted for consideration by the City Commission.

RECOMMENDATIONS
PLANNING DEPARTMENT APPROVAL OF THE SPECIAL EXCEPTION TO PERMIT A
DRIVE-IN FACILITY SUa3ECT TO A 20' LANDSCAPED
AREA AND NO REDUCTION ALLOWED TO THE REQUIRED
NUMBER OF RESERVOIR SPACES. e Special
Exception to permit a rive -in facility for the
Republic National Bank at the subject property
meets the intent and spirit of Zoning Ordinance
9500. The use is harmonious and compatible with
the adjacent area and will be beneficial to the
community. The project as presented, however,
shall be modified to include a twenty (20) foot
landscaped strip on the south property line. In
addition, each queuing lane shall include the
required number of reservoir spaces.

REDUCTION TO A ZU FOOT LANDSCAPED AREA. e

Planning Department is requesting that the
applicant provides a twenty (20) foot fully
landscaped area at the south property line for
the protection of the adjacent low -density
residential area. In addition, the existing

six (6) foot high minimum wall on the property
line.

DENIAL OF SPECIAL EXCEPTION TO REDUCE THE NUMBER
OF RESERVOIR SPACES. The reduction on the
number of reservoir spaces from a required
minimum of ten (10) to nine(9) in lane 1 and
only one in lane 2 is not adequate as additional
back-up would occur on NW 7th Street and
therefore would be detrimental to the area.
PUBLIC WORKS Recommend against reduction of reservoir spaces
for drive-in teller.
DADE COUNTY TRAFFIC
b TRANSPORTATION Recommend against the reduction of reservoir
spaces for drive-in tellers.
ZONING BOARD At its meeting of January 27, 1986, the Zoning
Board adopted Resolutions ZB 14-86 by a 7 to 0
vote, granting the Special Exception with approval
by the City Commission, permitting a drive-in
teller facility; ZB 15-85 by a 5 to 2 vote, granting
the Special Exception permitting the reduction of
the transitional area; and a motion to grant the
Special Exception with approval by the City Commission
.or the reduction of the number of reservoir spaces
failed by a 2 to 5 vote, therefore, denying the
Special Exception.

Miami. Zoning Board made on January 27, 1986, denying the following request of
Real Estate Partners, Inc.:
A special exception to permit reduction on the number of reservoir parking
spaces from a required minimum of ten to nine reservoir spaces on Lane 1,
and from ten to one on Lane 2, for the proposed drive-in facility for
Republic National Bank pursuant to plans on file.
The subject property is located at 2800 N. W. 7th Street, Miami, Florida.
The requested review mates to Item No. 3 of the Miami Zoning Board agenda
for January 27, 1986. ,

Within the City generally, or within certain zoning districts, certain structures, uses,
and/or occupancies specified in this ordinance are of a nature requiring special and
intensive review to determine whether or not they should be permitted in specific
locations, and if so, the special limitations, conditions, and safeguards which should
be applied as reasonably necessary to promote the general purposes of this Zoning
Ordinance, and, in particular, to protect adjoining properties and the neighborhood
i from avoidable potentially adverse effects. It is further intended that the expertise
and judgement of the Zoning Board be exercised in making such determinations, in
accordance with the rules, considerations and limitations relating to Class D Special
Permits and Special Exceptions. (See Article 26.)

Formal public notice and hearing is not mandatory for Class D Special Permits, but is
mandatory for Special Exceptions. In other respects, these classes of special permits
are the same.
The Zoning Board shall be solely responsible for determinations on applications for
Class D Special Permits and Special Exceptions. All applications in these classes of
special psrmits shall be referred to the director of the Department of Planning for his
recommendations and the director shall make any further referrals required by these
regulations.

of the Board, for the record Guillermo Olmedillo, Planning
Department. The Planning Department recommends approval of the
activity itself, that is, the activity for the drive-in which is
compatible with the district; however, the reduction of the
transitional area from 50' to 10' is not recommended for
approval. The Planning Department feels that the transitional
area must have a minimum of 20' of a landscaped area with a wall,
a 6' wall, along the property line. Also, the Planning
Department recommends denial of the special exception to reduce
the number of reservoir space. As you can see in the drawing,
the bank facility has two windows, two window tellers, and they
are parallel to each other which means that one window will have
9 stacking spaces and the second window will have 1 stacking
space; the required spaces stand per window, therefore, the
Planning Department is recommending denial of this second special
exception, also.
Mr. Gort: How about on the 50' setback?
Mr. Olmedillo: The 50' setback, the Planning
Department recommends to reduce it to 20 with a landscaped area
to be approved by the Planning Department and a 6' wall at the

landscaped area between the residential district and the
commercial district in which the property is located.

Mr. Shockett: Mr. Chairman, members of the
Board, my name is William Shockett, I'm attorney for the
applicant. I'm also a commissioner in the City of Miami Beach.
I'm not used to standing on this side of the podium. I would
like to submit to you letters of approval from adjoining property
owners particularly two of the three lots here, the third one is
out of town and we couldn't contact her. Also, you'll see
(looking at the transparency map on the wall) with the
application when the notices went out, there were, not at our
request, just in response voluntarily to the notices, six letters
came in in favor of the application and only one opposed it and
that person who filed a notice in opposition is a doctor, not a
resident, who maintains an office in a nearby small center.
This property was previously used as a 24-hour service
station. The neighbors in the area, needless to say, are very
happy to see this kind of use... the property put to this kind of
use particularly the people who are most impacted by this which
are the people that reside in the area where the recommendation
is that we go to 20' instead of our plan which shows 10' and I'll
explain to you the reasons for this.
First, this second teller is an automatic teller. The
first teller in the building here is a live teller. We put the
automatic teller there for a reason, to avoid the very thing that
you are concerned with and that is the backup of traffic. If

there is just one teller here, then in all probability since you
are dealing with them and people are conversing you will have
backups to the street. Republic felt that a automatic teller
here will alleviate that problem for the obvious reasons. That
is why we ask for this exception so that we don' t have to have
two lines of traffic all the way through the property which the
recommendation of the Planning Department was to do this, but we
would lose valuable parking spaces inside since we would have to
run the whole length of the property here. So this is something
that we just...we've tried to work with the City. We've agreed
to raise the wall, and keep in mind in this landscaped area,
there will be a 6' cement wall blocking the residential property
from this and we intend to landscape that whole area around the
property.
The bank facility closes at 5 o'clock. You are not
going to have any congestion in the evening, and we feel that
this layout is suitable for this neighborhood and it will not
result, we don't feel it will result in the backing ... backing up
of traffic in the area. We looked at the drive-in tellers for
branch banks and in practically all the branch banking, if you'll
notice yourself when you go by, there is very little traffic with
the drive-in tellers. It's a service ... it actually operates at a
loss but it's a service that the bank must provide but it's not
one that's really used in branch banks. If you look at a main
office, if you look at Republic's main office and their drive-
ins, their backed up to the street but look at any branch office,
look at Capital Bank is in the neighborhood, look at any of the
other branch banks and you'll see that these drive-in facilities
are rarely used. The reason is when you have a branch, you want
to open it to the local people in the community, you want to make
contact with the locals, you want to talk to them, they want to
come in and see the branch manager and almost all the banking is
done inside. So experience shows that you really don't need this
two lanes of traffic and all the reservoir spaces that the City
has requested. So we respectfully ask you to grant our
application on those basis, and in particular, I emphasize that
the people in the neighborhood are all in favor of this to a
person, at least the ones that reside there. If there's any

that location since 1951 and I did send a card in. Anyone
familiar with this area... there is a traffic problem right now
and I'd like to point out, if I could, on there.

Mr. Borden: In the area right here on 7th
Street is...the intersection is not like this. okay? There's a
shopping center across the street Also, you're only two blocks
from 27th Avenue. in the mornings from 7:30 until approximately
9: 30 getting across ... (word unintelligible) 7th Street is almost
impossible. In fact, we have accidents there all the time with
people trying to either turn down 28th Avenue or trying to get
out 28th Avenue and head west on 7th Street. As a result, we
have a continuing problem ... and we take up the next piece of
property adjacent to these driveways ... we can not even get into
our own parking spaces in the front of our building during those
hours.
If you cut that reservoir down, there will be no space
in there to back these cars up because you'd only have 11 spaces
coming off 7th Street. If this traffic backs west, we will have
no way to get into our own parking spaces which border right on
7th Street and that's why we don't feel that... not the fact that
you're putting a branch bank there, it's a fact that the location
of this piece of property, the way it physically sits in
relationship to east -west traffic on 7th Street, which is a main
east -west artery, presents a very difficult problem to get in and
out of these lanes without backing up traffic any more than it is
right now. You have the same condition in the afternoon coming
west from the City, from like 3 o'clock until, like he says, when
the bank closes, up until about 6:30 and what we would —what we
would like to see happen is that that traffic exposure be studied
because the intersection does not warn itself to signalization.
You're too close to 27th Avenue and you don't have a through
intersection here. It goes like this and the next street is over
here, almost like this.
Also, you have the same problem with people trying to
get around the 27th Avenue light. They're continually making
left hand turns at this intersection and this intersection which
is on the other side of the shopping center at the La Hacienda
restaurant. As a result, that's continually blocked off and I
just don't see how you can put a facility like that in there
without creating more of a havoc with the traffic than we have
right now and we have approximately 14 parking spaces that
go... start right at this property line and run directly west,
that border right on 7th Street.

Mr. Moran-Ribeaux: Mr. Chairman, just a comment from
out of my head and excuse me, before you start. Can that...
Mr. Perez-Lugones: Could you turn in the micro...turn

study been done and I imagine it has and for some reason it's not
presented here, to have the traffic flow the opposite way, people
coming in through the avenue and exiting through the street with
a right only turn sign at the opposite end? The entry should be
on the avenue and then going exactly the opposite way and then
going out that way with a right turn only sign. Would that solve
any kind of problem?

expert but to my knowledge that's...

then we would have sufficient reservoirs. All we did was add an
automatic teller and that's created the reason for us coming to

that he's talking about. As I said, our experience in banking...
we are not going to create a problem for him. We have more than
enough, and they'll tell you, that we have more than enough
parking on the property. So I don't think that that concer...we
addressed the identical concern that the doctor had and this was
the solution for it because as the Planning Department stated the
use is harmonious and compatible with the adjacent area and will
be beneficial to the community. The people that live there agree
with that. So this is how we address the doctor's concern. I
think if he understood that, he would realize that if we took the
automatic teller out, we wouldn't need the second lane and we'd
have a bigger problem than we have.
Mr. Gort: Okay, thank you, sir. We now

Ms. Morales: Sir, how many parking spaces do
you have altogether?

Ms. Morales: Twenty. Isn't possible to reduce

Mr. Shockett: That was the suggestion by the
Planning Department. We can't do that. We can not eliminate any
more parking spaces.

Mr. Shockett: Republic needs those parking
spaces there for the customers. Because of their experience, you
need to provide spaces for the people that use the facility. The
drive-in is not a major facility at all. It's an incidental to
something that we have to provide for the . customers. The.. .

incidental but on the other hand, you're concerned about not
having enough serv...reservoir capacity and that's why you added

I'm...we're discussing here among members now. I think...I mean
the way I look at is this. The request for a change on their
part really will try to solve a problem which they may otherwise
have with what they are allowed to do. I mean we are saying that
from ten to nine is not much of a difference so it's okay to have
one teller. The way I look at it, is with two it's better, with
three like Hemisphere National Bank would still be even much
better. So why not let it go faster and that the way the need
for those nine spaces will be more reduced. People are not going
to go more or less because there are two, three or four. They
will stack more if there's only one.

there is one lane... there is always going to be one waiting and
one moving. You understand?
Mr. Moran-R ibeaux: Right, but I mean, you notice they
will finish ... I mean, if you divide the traffic in between two
tellers, the movement of a car that comes in is cut right in half
for both of them. So if a car is going to stay ten minutes in
the line, if you have two ... with only one teller, if you have two
tellers that car will stay there only five minutes. So it
actually will ease the backup situation. Look at it from that
point of view.
Mr. Gort: What he's saying makes sense but
let me tell you what my problem is. I know that corner very
well. There used to be a small gas station in there and that
corner is one of the worst corners there is on 7 th Street, the
reason being, as it was stated before, it's not one that goes
right across. It's a dead end in 7 th Street. You've got St.
Michael School down the street, three blocks down. In the
morning you've got very heavy traffic with people going to
school. You've got the heavy traffic of the people at the
shopping center right across the street. Then you've got the
people going to work that utilize the main artery to go to
downtown Miami. There's always a backup in that corner. The
backup goes all the way to half of that property in the morning.
I, myself, find the property...I think the use is fine and
they're complying with... almost they're complying with the
minimum of standard required by the City zoning code. But that
corner itself has got a lot of problems. Traffic is a big
problem in there. I think the Republic Bank... it wants to do a
service and we appreciate that but at the same time, they will
find, business wise, the feasibility of it is going to be worse
for them because people are going to have trouble getting to that
facility, getting out, in and out of that facility. I think what
they're trying to do is utilize a small space and maximize too
much. That's one of the reasons why I would like to see the
setback the 20'...and I agree, I don't think a 20' is necessary,
I think with 20' they can do it and I can see the stack up of 20
cars instead of 10 because there's always going to problems. Let
me tell you, they say drive-in facilities don't create problems,
in certain areas they don't create problems but in that area, I
can guarantee you, they're going to provide a lot of problems
because you've got a lot of small stores around there, you've got
a lot of the shopping potentials and one reason they're going to
put that it in there is because they've done their surveys and
how many customers they've got in there and how many people want
to utilize the drive -up windows and you're gonna always have cars
outside if you only have nine spaces. I'd rather have 20 spaces
than 9 spaces ...

providing 20. I think what's in front of us is are we willing to

long as we alleviate the problem of traffic and so much as we

that we're just creating a problem with traffic in that area and
that's my concern. I'm not so concerned about, you know, the ... I
even questioned about the fact that if they would only ... if they
would eliminate the automatic teller whether it's really, in
fact, a good place to have this drive-in teller with only nine or
ten, even in accordance with the zoning code without having some
kind of a traffic study being done or what kind of traffic
they're going to be generating into that automatic... or those
tellers. That's my concern. I mean, if it were located in
another ... in another street where traffic is not as heavy as it
is on 7 th Street, then I wouldn't have any.. .

we're considering.

problems but I have very ... a lot of reservations because of the

all to do any traffic study or are you amenable to doing one to
try to alleviate this idea?

the bank is going to put its facility on our property and the
bank has told us that they need these requirements. How they
arrived at that, I can't tell you but that is the requirements
they've imposed on us and I assume that whatever studies they've
done since they have a lot of branches, you know, they're going
in and they're prepared for this. So that's why.. we're not
taking a hard line with you. This is the bank's requirements and
if they're not met then we'll have to put that property to
another use, it will not be a bank. This is not the bank coming
before you.
Ms. Basila: Sometimes things like that have to
be done, you know.
Mr. Shockett I don't think that any other use
except for this use is going to be as nice and beneficial to the
neighborhood as we propose within the zoning laws.
Mr. Gort Any other questions? Let me tell
you how I feel about it. When I first looked at this and looked
at the presentation and looked at the two drive -up windows and I
agree with the doctor that the problem with traffic there, it's
bad. At the same time you've got to look at it. That corner is
going to be utilized for something. Something is going to be
created in there. Whatever is created there, one of the biggest
problems we have through 7 th Street, we've got all these pockets
of small shopping centers taking place and that they don't
provide enough parking spaces and offices and so on and we do
have a problem with parking in the area. It's ... I've got mixed
feelings about this application to tell you the truth.
Originally, I was all against it, the two... the two windows but I
can see it makes sense with what Mr. Moran stated before that if
they can do away with one and they only have one and the
requirement in front of us would be a minimum of just one ... bring
the stacking to ... down from 10 to 9 and the setback.

requirement which is something that is a great needed in the area
and you're aware of that. The parking is something it needs all
the time. From what I can see, what the person is having

Okay, I move that the request on agenda item number 3 be granted
for a period of 12 months in which a building permit must be
obtained. The requirements of Section 2305 were satisfied in the
record of the public hearing as stated in the City's findings of
fact and as demonstrated by the petitioner. Here what we are in
fact talking about is the reduction from 10 to 9 and the addition
of one automatic teller. Just want it to be clear.
